    Good morning i am employed as a learner security guard 1year an 5 months ago according to the contract they gave me there is no over time paid as it is given as time of but I dont get any paid leave at all no sick leave or anual leave working 12 hour shofts monday to sunday of and on since i started. According to the contract I have to get 40 credits for completing certain courses that the company has to send me to. I have not even once seen any courses since I started working and another guard took 3years before starting his courses is there something I kan do as all the schools told me that this 3year leanership if done privately is only 1year long

      Have you tried reporting this to the Department of Labour for investigation?
      This might be your best bet - which will be zero cost to you.

    I sent my letter of demand and everything they needed to audit the money which I was unpaid.(gave them 7 days).
    On the 7th day I was called and told my money will be paid on that same day. It's been 24hours and I haven't received the money which is owing to me. Should I proceed to small claims court or let them know that they did not make payment as they said they will

      Proceed to Small Claims Court.
      The Clerk of the Court can help you for free with filling in the documents

    Hi my boss didnt pay any of hes workers in 3 months we went to the ccma but they say they cant help use becuase he dont pick up hes phone we know ehere he lives and everyting we can do it true the small claims court lile you say but how to go about it cuase he knows how to avoid the court he doenst pick up hes phone or are at home wen we try to claim are money we are about 20 people

      Hello there. The best approach here would be to go to your nearest CCMA and refer a case for outstanding monies owed.

    Hi which one must be under R20000, gross or net salary?

      Hello Phyl
      That's a good question. The total amount that is owing cannot be higher that R 20 000 (whether thats gross or net).
      However if the amount is higher (for example R 25 000) you can abandon the R 5000 amount and make it a total of R 20 000. This will make the amount R 20 000 so that you can still approach the Small Claims Court.

      Hello Haids 24,
      You can approach the CCMA on the basis of "statutory monies owed to you by the employer".
      However the CCMA process might take longer to get a date etc.
      We recommend the Small Claims Court (if the amount is under the limit).
