- In 2005, the U.S. Supreme Court issued one of its most reviled decisions in modern history, in Kelo v. City of New London. By a vote of 5-4, the Court said governments could use eminent domain to take private property and give it to private developers who might pay more in taxes. As Justice Sandra Day O’Connor said in her dissent, “The specter of condemnation hangs over all property. Nothing is to prevent the State from replacing any Motel 6 with a Ritz-Carlton, any home with a shopping mall, or any farm with a factory.”
Now, IJ has submitted a petition asking the Supreme Court to overturn that infamous decision. Today we talk with IJ Deputy Litigation Director Robert McNamara, and IJ President Scott Bullock, who argued Kelo at the Supreme Court.

This decision and Wickard v Filburn are the worst decisions in Supreme Court history but it's a rotten history, one that has also written the 4th Amendment out of the Constitution.

Read Randy Barnett's books on this. Also Thomas DiLorenzo. Since 1789, there has been a battle between the supporters of limited government and those who want a powerful centralized government. So far, powerful centralized has been winning and the main source of that has been the Supreme Court, whose members are appointed for this very view of the Constitution. All 9 members are political hacks.
My great uncle had a large plot of land taken by eminent domain when I was quite young. The land that they took broke his spirit and they did nothing with it for many years afterwards. I appreciate you folks fighting for this. Thank you!

My dad’s friend had a few acres of land in Florida. The government took some of it to “build a road” and they paid him less than market value. I think it was like 15k for an acre of land. 6 months later the plan was “unexpectedly” canceled and they city sold the land to a local developer who built 7 houses on the 1 acre lot, the price for each house was 400k. It was obviously their plan all along

We need eminent domain, just not eminent domain for "economic development." We need roads, ports, airports, etc. Infrastructure we all use.

I have lived in a town where they harassed people out of their homes if they wanted the land. It became one of their insider side businesses among friends. My local Veteranarian who I thought was awkward, told my family "they tried to take my home and I fought them and won" and two neighbors at opposing corners of the block had 'massive turnovers' - meaning they came, renovated and suddenly left with another neighbor smirking and saying "why I dont know WHAT happened to them...go figure!"

A Mayor in one City used imminent domain saying the homes were uninhabitable. They paid some people out (established businesses with loyal clients) and he did in fact get the Municipal Law Enforcement Complex money he wanted. Then he was arrested and sent to prison for Racketeering corruption blackmail bribery embezzlement. I saw him with other Politicians at lunch with my Father one day, and now I can see why they chose that location to talk about their deals... they are 'something else'

@@slhines7 Just because someone might assume that land would be taken to open a public space has literally nothing to do with whether or not that is what the actual text says. Just because you think something should work a particular way does not mean that it does. The SCOTUS ruled correctly based on the actual constitutional text.

And red flag laws. Red flag laws don’t require any burden of proof. Someone, almost anyone can claim a person is a danger to their self or possibly others and currently possesses firearms. The police, on the word of almost anyone can then enter the home without a warrant and take possession of the firearms.

There is such a thing as illegal foreclosure proceedings if the County/Municipal courts helped push the foreclosure without payment to "leave their corruption alone already! This is just who we are! Unfortunately the compulsory (f o r c e d ) "education" system is historically and factually intended as a form of blind-obedience-to-authority-training based upon the "Prussian Model" and was never intended to make you smart - actually the opposite. No rights were taken in this case. The constitution literally mentions this sort of thing and gives them permission to take land as long as they pay you fairly for it.

But your comment prompts my response that our rights extend to the right to be free from laws that are being misinterpreted or used in a way that is counter to our sense of appropriateness and justice. @@JohneeB You have no such right. That isn't how your rights work. If a law is unjust then you have an obligation to change it and if you can not do that through normal process of law to use civil disobedience to get them to act. This law has been around for hundreds of years, you just found out about it recently. It isn't even unjust because they have to give you a fair price for the land. They can't just take it but they can force you to sell it back to them if they need to. Which is the fairest way it can be done.

You truly do own nada. I inherited 100 acres of land from my family and we always feel like it can be gone at any moment.
Find some rare plant or insect and get it protected. They will look elsewhere
The closer you are to a town or main road or freeway interchange the more you should worry, or not. If I owned a nice property close to town I would actually want to sell it to a developer for max profit. Then I'd find another property way far out that is bigger and better in every way and buy it.
I wanted far out but wife wanted close in. I lost and bought 2 acres 3 miles from town. I wanted 10 to 20 acres 10 or more miles from town. The big thing that made me back down is I need high speed internet as I run online business.
Now 4 yrs later there is starlink. Any land no matter where can have high speed internet now. Think about that. I would own 20 acres if Starlink was available 4 yrs ago.
How much for the 100 acres?

Eminent domain is supposed to be for government functions only. Land seized through imminent domain should be unsellable for at least 20 years after seizure.
The state of Louisiana took my grandma's front yard to build a bypass around a small bridge only during possible repairs.. It's been 45 years now and they've never built a a bypass or repaired the bridge..⚖️😎

This is what the thrive on, peoples hope that change will come in the next election, by some elected savior, and they may even see a bit of that hope - temporarily, but in reality both sides are corrupt and working for the same goals, while everyone is distracted bickering amongst themselves instead of looking at the true problems.

We need to rid ourselves of property taxes. We basically pay rent to the government our whole lives.
Absolutely. Property tax not only violates our right to life and liberty ( by requiring additional labor to pay to keep your shelter required for life ) and pursuit of happiness ( by requiring you reoccurring-pay to keep something which brings happiness and in the process diminishing your ability to pursue other happiness by the taking of your labor and time ), but also our freedom of expression by hindering or preventing our expression through the design and upkeep of our home ( by requiring higher payment for "higher value" based upon design, materials, etc.) It literally hinders and prevents beautiful architecture and well kept properties. Despite its claim, it is certainly not a "fair" tax upon "means". A person could have lived in poverty their entire life while saving for their dream home, or built it with their bare hands, in order to afford it, and have nothing left, while another could have vastly more wealth and a similar or less-appraised property. It also keeps us enslaved to the work-force, through inflation, as the taxes continually raise, while our past labors ( savings ) decline, with inflation thus forcing most to continue work to afford to keep their shelter, while a good portion of that money goes to local police who primarily function as tax collectors and enforcers of unjust laws.
If you dont keep up your property because you don't like taxes there is something realy wrong with you

15 years ago a friend bought a small ranch that was in disrepair because the house was turned into a dog kennel. The 3 acres it was on was a mess. They basically ripped out the interior and replaced from the studs. They fixed up the yard as well. Because they took the time to fix it up they are being taxed out of ownership through property taxes. She’ll be moving to another state at 65 because her forever home turned into a forever nightmare because of property taxes. No more bedrooms. No more land. Her “property” taxes have over tripled. She has McMansions in front of her whose taxes are much less than hers. It’s corruption to the hilt.
Don’t get me started on lower property taxes because you’ve got a “prayer” room in your house. Ridiculous.

I think the most proper way to address this is to go to a developer, have that developer Target a supreme court justices home, build up a case of why building a public use matter on their personal home, presented to the city or town Council detailing the economic benefits and then use eminent domain to take the Supreme Court Justices home. 👏🏾👏🏾👏🏾 what's good for the goose!. I think they should do this over and over for every single Supreme Court Justice until they get it.
In order to better keep the homeless out of the rich neighborhoods we need a homeless encampment and large collection of public bathrooms where they live.

The supreme Court needs to understand that their job when it comes to this type of decision should always end on the side of the private citizen of the country rather than of the government if there is any question whatsoever. The 9th amendment says everything that needs to be said.

Fair market value is not just compensation
Live in an Urban Enterprise Zone with a Military Installation for renovation money and I promise this "pay a price I cannot resist" goes away and DoD employees begin the evacuation process. This is just another scenario of how corrupt politicians know what to zone and use for their pockets.

They destroyed everything the people in western NC had, and they still have not rebelled, even when their own Codes Dept said they would not be able to put a tiny house on their property. A Sheriff Deputy even stole a generator that had been donated. I don't know how bad it will have to get for people to react? Where is the accountability for these law makers, judges, and other public officials, when they actively create and uphold laws and policy that are violates of our rights? They know they can violate our rights without risk of consequence and so they do. END QUALIFIED IMMUNITY NOW (except they give it to themselves...) Our rights should only ever be interpreted to the most broadest extent of freedom, short of actual - not technical - trespass against another. Instead, they twist and manipulate our rights to fit their personal opinion and interpretation to benefit themselves and their friends.
There was a case where Dow wanted to move in to a waterfront area where there was actually some really nice little houses. I want to think it was in Rhode Island, but I’m not sure and they actually took the houses down and then Dow never came in.

What needs to happen is next time a state takes someones land for nothing or for another's private use the person whos land was taken should take find funding and go after taking a supreme court judges home in the same fashion i bet the supreme court would jump on that fast

If govt can take your property, even for an exchange, then you do not own it, and if you can not own property then you have no liberty. It is frankly ludicrous that it takes years or decades of wrongdoing do even address these issues in court - It is no mistake, and provides a clear picture of a major flaw within the justice and legal systems - that the opinions and interpretations of judges, and their willingness to hear issues, are the end-deciding factor in issues where elected law-makers refuse to make the changes themselves. At the same time, the people themselves are responsible for this, by their complacency and acceptance. The sad reality is most people probably do not deserve freedom in its real sense, as they do not care for it unless it impacts themselves, and so they deserve the world they are in. Unfortunately those same people enable this corrupt society that trespasses upon those who actually do value freedom. We are too far gone from the ideals of freedom and logic to regain itself in any timely manner by financially prohibitive court battles and continually hoping for "elected" officials that will actually serve the people in protecting their freedom rather than pretend to while serving their own manipulative interpretations of it to suit their and their friends personal agendas.

I was wondering why so many used homes being sold are lemons. This definitely would be one of those reasons. Why invest in a property that can be taken at any time? Move in, fix what is immediate, stay until the home just starts falling apart and dump it on some young homeowners. We dont own it so why invest in its future??
Thank you, thank you, thank you. Currently, more laws are also needed to control utilities actions too. Their workers are too invasive by entering private property to service their equipment coming without notice, damaging fences, not shutting gates and letting livestock loose.
Yet another reason to ban simple majority decisions in the Supreme Court. Reset the passing bar to 7/2 or even 6/3. This narrows court decisions to broadly agreed upon opinions also held by the populace. It also limits undue influence created from swings in ideologically titled Courts.
_Kelo_ is one of the worst Supreme Court decisions in the last 50 years. I’m glad you’re advocating for it to be overturned.

In South Africa the ruling ANC cabal have just passed a law which allows the "government" to apply the "EXPROPRIATION OF PROPERTY WITHOUT COMPENSATION" rule.
Which means the regime can simply kick you out of your house, your factory, farm or whatever else they want to get their dirty, sticky fingers on FOR NOTHING and there is NOTHING THAT THE SOUTH AFRICAN CITIZENS CAN DO ABOUT IT.

The craziest part to me is what's to stop the gov't from ten years later saying oh well the Ritz hotel didn't work like we want, let's actually put a Motel 6 there again, or a Denny's or what-have-you. Presumably the increased use, is also because it's cheaper than simply giving an offer that can't be refused.

I've have a case,that no one is willing a Brady law violation.
These mini-governmental bullies are everywhere. HOAs have become terrifying. We have hardly any choice except HOAs in central AZ and realtors have become dominant on the boards and previous single-family developments are now filled with landlords and corporate owners. We just fought claims and fines on a complete fallacy. Took months! We still haven’t received the written statement from the management company we requested.

It is the property tax that should hold in a court to say "This is the land documented at your court and I paid to live there" - Federal Granting is where things become dicey.
