From what I know, they both have to be residents in the EU. But maybe you can check if they are still allowed if they have a visit visa (Not sure though).

The marriage certificate is accepted without apostile in Germany. It is also not compulsory to do an apostile. From our experience, we have not been asked for anything else except the marriage certificate

I think the apostle is for translation.. I might be wrong
