Pero hindi pwedeng pilitin ng prosecutor ang testigo at ito ay tinatawag na right against self-incrimination. At kung meron naman na testigo na isasalang pwede mong icross-examine muna bago isalang sa husgado. Kung may pagkakataon naman na ayaw humarap ng testigo sa husgado magrerequest ang prosecutor sa judge ng sub poena decus tecum at ito ang ibibigay sa testigo at wala nasiyang magagawa kundi tumestigo sa kaso.
