  • Featuring Louisville medical malpractice attorney Tad Thomas | 888-981-0031.
How can you tell if medical malpractice occurred? What are the most common types of medical malpractice? Are malpractice lawsuits destroying the healthcare industry?
Tad Thomas is an attorney with Thomas Law Offices based in Louisville, Kentucky. He opened the firm in 2011 and can assist clients in Louisville, Kentucky; Chicago, Illinois; and Cincinnati, Ohio.
In this interview, Thomas explains how to find out if you have a medical malpractice lawsuit on your hands or if you simply experienced a poor outcome of a routine operation. He explains that Kentucky laws ensure that only valid medical malpractice lawsuits reach the courts, and that the only way to tell if you have a valid claim is to meet with an attorney.

We need more attorneys standing up for patients and making the medical field more accountable for negligence and abuse of power. I wish someone would help me in CT. It’s so bad here.

I was treated badly in another state and had to go to another state to find someone to actually listen to me. The other doctors ignored me completely and told me to see a psychiatrist when I was in pain. They just sit in their office and don’t help. They took my money and were very rude.

I had a cervical fusion surgery and complained before discharged I was told it was normal after being discharged and on my way home we had to do an emergency detour to another hospital because my neck was filling up with blood and was choking me nearly to death at the emergency room that had to do a emergency intubation and an emergency surgery to save my life. After the emergency surgery I ended up in the ICU and spent a week in the hospital for recovery. I'm on Pennsylvania and I was told the surgeon is untouchable. I was told I was 1 in a million this happens too. Now my quality of life has been effected I lost my license because I can't pass my CDL physical so I can't obtain a CDL license now 30 years driving a truck now I have to change careers because of all this. Where's my justice and whose going to take care of my family since I am the sole provider.

I know especially studying in healthcare administration that I have a case. My mom is mentally way off due to Invega. Her body isn't the same anymore. I had reported this to the FDA already. Why do they still have these drugs on the market? Is it due to money factors? Everything comes back to that. My mom was billed for her emergency room visit without being able to pay for her hospital costs. This is by far ridiculous. If the state of Mississippi would really help patients and take their patients seriously and not just see them as a huge dollar sign this wouldn't happen. Also, many doctors and nurse practitioners rather over-medicate a patient and that is why they go right back to where they were before which is a mental intuition. I had to literally get my mom to the hospital back and forth because her health was worsening. Stop allowing other doctors to treat patients like experiments and start treating them like real human beings. Glory be to God for those who have to deal with this.

Took my daughter to er for her mental state. We told them she was acting very erratic and starting to get aggressive and trying to run out the front door. She was having delusional and hallucinations etc. She also hadn't slept in 6 days and barely eat and was wetting herself purposely. So we took her to er and they did CT scan and blood work. They said she had uti. Discharged her with a prescription for antibiotics. Her mom was yelling at them asking why hasn't she received any medical help for her mental decline and they just blamed the next doctor or ppl higher up etc. Well we leave and low and behold she won't take the medication because she thinks we're trying poison her etc. Fast forward to the next morning and she is going bat shit crazy. Breaking stuff and threatening to run outside. She opens the door and yells in the front yard. She starts chasing g cars and trying to open their doors. I grab her to pull her back but she screaming and going crazy. A work truck 3500 4x5 rolls by and she runs and jumps in the back bumper and hugs the ladder rack saying she's not going with me. The worker stops his truck and I explained to him that she's having a mental episode and is hallucinating. I had to use all my strength to pry her off the back of the truck by force. Then she laid in the street staring at the sky blinking her eyes. Finally her mom pulled up and I said call 911 now. I didnt want to call 911 due to how cops shoot and kill ppl with mental illness that start getting aggressive and don't understand what their saying etc. But I had no choice. So they show up and take her in ambulance strapped down. She goes to same er down the street. But now they're sedating her and did other analysis. Now they found out she has ecoli sepsis in her blood stream and might be in septic shock. Smfh. It was different staff in the er this time thank God. It could've ended badly had she ran in someone house who was a gun owner. And as I read on sepsis and ecoli I'm seeing she's possibly close to organ failure and death. I'm wondering what type of action can I take I'm very pissed off and I want that hospital staff to be held responsible.

I was told I had kidney cancer. Almost 100% confirmed. I went through it .
I was worse than before after the surgery! He cut a nerve that was on my c section a 32 year old cut and now it hurts more than it did before- it didn’t hurt before- but now it’s like he’s cutting me open without anesthesia. It’s been almost 4 months. He told me it will get better ha ha!
Then I’ve never had this before. I’m filled up with water weight gain throughout my entire body. It hurts to move,,Walk just lay it’s in my stomach as well as my lower stomach and legs and calves, my skin is red? I went to my regular doctor he did blood work. I just got it back. In December before my surgery my gfr ( kidney function) was a 59 it is now a 37! I have trouble peeing, I took a water pill and it didn’t work.
SOMETHING HE TOLD ME ON THE PHONE. It’s was a update on me. I asked him why that part hurt on me he said he probably cut a nerve and it’ll heal like it was no big deal.
Then the shocker I didn’t even tell my husband. Dr said the pathology report said it was 90% benign no cancer and 10% could be cancer or whatever he said. So I was told I had cancer and he took a part of my left kidney out and the so called tumor. Only to say nah it wasn’t cancer. What?!!!!’
What do I do about this. I’m suffering more now than before because of him. I don’t know if my kidneys will just give out cause I’m very sick now. I can’t get off my couch it’s hard to walk it’s torture to go to a dr appointment. My husband asked him what do we do about the water weight gain 40 pounds she’s not peeing. He says go to your dr a water pill should fix it?

That sounds like that Dr didnt perform the procedure correctly. Definitely medical malpractice. I had a cervical biopsy, something that is usually simple. My Dr decided to do a cervical nerve block injection into my cervix with local anesthesia; Lidocaine and possibly combined it with another anesthetic and Epinephrine. All of a sudden I'm feeling a very hot liquid spread up to my entire chest, throat, neck and face and behind my eyes was stinging; feeling hot and flushed. Never felt that way before not even during labor and delivery and I had lots of anesthesia then. My heart started beating rapidly like I was having a heart attack, adrenaline rush and I'm nearly out of consciousness. I tell my Dr I'm not feeling so well so he stops the stuff he was injecting in my cervix. 6-9 days later I'm having panic, anxiety & heart attack like symptoms while driving my car every single day for 4 yrs, tachycardia, bradycardia, CNS problems, blurry vision, brain fog, weak and heavy legs, constant SOB, irregular heart beats, exercise intolerant and insulin resistant after eating every meal. I probably went to the ER 10 times in 4 yrs and kept reporting my symptoms of possible heart and lung issues bc I couldn't breathe on a daily basis, also lost tremendous blood which made me anemic. My PCPs kept refusing to refer me to a Cardiologist and a Pulmonologist. They even refused to do another MRI with contrast of my Heart to cover up any medical negligience done at the VA hospital in FL. They kept telling me that my Heart is fine, theres nothing wrong with me it's all a mental health issue. I finally decided to get Cardiac screened at some community event and had an actual Cardiologist read my exams and found out that I have (MR) Mitral Valve Regurgitation where my heart is leaking on my left ventricle. I believe that GYN Dr who performed the cervical nerve block and biopsy procedure on me injected LA with Epinephrine, which got into my blood stream through a main artery and shot up directly to my heart causing damage to my heart valve, muscle and God knows what else. I didnt know what had caused all of my symptoms right after cone biopsy so I didnt pursue any medical malpractice or claim. I just know it happened right after that nerve block. This Dr retired few weeks after I reported my heart attack like symptoms shortly after my procedure. I went through numerous PCP's maybe 5 and all of them refused to refer me to Cardiology or treat accordingly. It's been 5 years past and I've been diagnosed with sleep apnea, MR, a lung nodule and scar tissue on my right lung, LPR of my throat. WTH? I was in perfect health with no heart, lung, respiratory, throat or sleep apnea symptoms before the cervical biopsy plus I just turned 47, my parents didnt start having health issues until past their 60s and 70s

I waited four months dir septorhinoplasty of the functional type to address breathing difficulties at night whilst lying down to sleep. I tried for four months to discover if the surgery was to be performed opened or closed. I didn’t find out until I was in the outpatient surgery center that I was having open septorhinoplasty. I found out from the nurse literally until just minutes before the surgery. Four days after my cast FELL OFF AFTER SHOWERING I discovered two deep purple scars on the side of my nose. We weren’t informed of any complications and even during my post operation appt the Dr didn’t even make any comment about the scars. I disagreed with inner nasal valve replacement but he did it anyways resulting in my scarring….no one will represent me! How could he have followed the “standard of care”? I’m sitting here 3 months later with NO ANSWERS!!!

My dad went into the hospital for a urinary tract infection, upon entering the hospital he could walk, talk and eat without any assistance. Within 3 days his knees were contracted to his chest, he was in a comatose state, eyes closed and unresponsive. The doctor and nurse told me that if i tried to straighten his legs they would break. Along with the awful care my dad received he had bed sores that were documented at a stage 4. Unfortunately my dad died 2 days after he came home from the hospital.

I have Alzheimer's and witnessed the assault of my hospital room mate. She also had ALZ & I had seen a nurse pushing her around in the hall, it escalated into nurse taking revenge on her not "being obedient" by calling in other hospital workers to rough her up, make her scream, they were physically pushing her around & then she howled from some injection they gave her, then left her without a blanket on her bed. I was able to stretch my IV tubes to her side to comfort her, cover her with blanket. Sang to her during night to comfort myself too.
In morning she woke up happy, did not remember what happened. Then the nurse returned, with police armed with weapons. I was told to STAY in my bed. They went all out, taunting her, pushing her around, again this 5' woman was bullied and shoved, slapped & then they made her scream again with the injection thing. I reported it to hospital but am terrified of hospital. I will never get over what I witnessed and endured as her room mate.
No lawyer will help a person with Alzheimer's. I think of my roommate every day. They tore the tubes out of my arms and sent me home. I called in the report within an hour. I relive it every day.

I have a question and need a reply to it plz so my old doctor I stopped see him early this year and went to a new doctor but my old doctor basically kept louding me up with pills I was on 8 pills daily and two of those were some that I would have to take twice a day but I was diagnose with bipolar and type 2 diabetes by him but I kept telling him its not just that that there was something else wrong with me and I would try to explain my problems and it would go in one ear and out the other and I tryed to file for SSI disability and they kept denying me it do to lack of what my doctor was putting in my case so he only had in my files that I have diabetes and bipolar but he would not put down the problems i was having or he would not put them on his computer and i was seeing this doctor since i was 15 years old and I'm 23 years old today but eventually I want to a different doctor and he diagnose me on the first day of seeing him not just diabetes and bipolar but i was diagnosed with PTSD and really bad anxietyand both doctors did say they dont want me to work yet but my new doctor is actually doing his job and set me up with a appointment with a EMDR therapist and is trying to get my life together so I can start working and being more successful in life because since I was going to the old doctor and he was listening or puting the stuff on his computer and i was 15 years old and so I end up not graduating from high school because I was having a hard time going to school so i would miss 2 to 4 days of the school week not going to school because of my bipolar and anxiety and was suffering from PTSD and getting no help do you thing this could be a case I could sue him or have his medical license token from him for not doing his job

Please I need guidance in our situation, my bother in law just passed away 2 days ago and we are almost %100 certain it was medical neglence from the hospital. He went in for a normal appendix surgery on Wednesday and the next day he was dead! He had no other medical issues at all. After surgery everything went well recovering normally but on Thursday morning he fainted and complained about pain on stomach. Nurses said to wait for doctor. Nothing was done. Few minutes before his death he told his son to please tell the nurse again and that he felt like he was dying. He died minutes later. It was completely lack of doing something. He begged them to do something and nothing was done by anyone there. Similar thing happened to me after my c-section surgery, I fainted after while I was breast feeding but the difference was I was taken right away to a ct scan and they realized I was bleeding internally. I had to be cleaned up and given a blood transfusion. I'm guessing that's what happened to him. Whole family is devastated and angry that this didn't have to happen.
We are in San Antonio Texas and we have no idea where to get and find a good lawyer to take our case. PLEASE, PLEASE guidance. Thanks.

I went to a doctor to see if I had a autoimmune disorder and post it I’ve tests and symptoms and the doc I went to said I only had a allergy and I’ve been in pays for months and days and said I didn’t have anything and that if I chose to I could take the medicine. Went to a different doc who said it was text book sign of autoimmune disorder and is giving me treatment. After I had that appointment with that bad doc I had a seizure because I felt so sad and stressed out and had multiple docs see my pain. Idk what to do

If someone has adverse side effects from a drug, used for physical and/or psychiatric purposes, does that person have a medical malpractice case? This is assuming doctors and other medical personnel followed standard protocol and weren't negligent.

How would I ever find lawyer out here in South Dakota. Everyone I talk to after my husband's death a year ago said that they wouldn't touch a medical malpractice case because Avera is the only medical industry here and no one wins against them. The last 30 cases they looked at cost $50,000 and the people always lose against them. It's been a year and of course I'd given up hope so if South Dakota lawyers won't touch them then how do I find one?

I was released from the hospital with a "neck muscle strain". Turns out 14 days later i find out i have actually had a c1-c2 neck fracture and theres a serious problem with my c5-c6-c7. After spending $370 because I felt the hospital diagnosis was very wrong...follow your gut instinct. Will a lawyer take my case? My physical therapist and chiropractor had me go back to the hospital and get my scan records. (xrays, CT scan and mri). My chiropractor sent me to a orthopedic surgeon to do a flex scan??? (I had to look all the way up and all the way down when the photos were taken. He saw the injury right away...when he saw the MRI....from the hospital. But....the orthopedic surgeon who found the problem....will not make a report against the hospital. What doooo i do

What about when your anesthesiologist literally leaves you in the recovery room after surgery while you’re having a heart attack and they not only leave you there they leave the building and you are having a heart attack and they are calling every where in the Hospital to get someone there to take care of you and then you are admitted to the ICU. Then they send you to collections for not paying that bill !! I have ptsd and have been in therapy for this event. I am petrified from this experience because it didn’t end there. I got very sick after I was sent home and the dr never followed up with me and he wouldn’t take my calls. I ended up back in the hospital with severe dehydration due to vomiting and diarrhea due to antibiotics I was allergic too. I went to the ER 5 times and they sent me back home with no help. I ended up in an ambulance from home because I was nearly passed out from anabolic acidosis I believe that’s what they called it. I was then in the hospital for 3 days getting fluids may have been 4 days. I am still in counseling I am petrified of the Drs here.

Is there any doubt that although only a failure can realize that one has a problem which no others have ever had, the correct way to inform others about a problem which did not exist and was unimaginable before one was affected by the problem is to use written language (because it is known among all that writing may be fiction, and some fiction books are written in the 1st person, ie: "I woke up...")?

I went back to complain about my pain and asked if he can referral me to a therapist or neurologist and he told me the same. So went to a different doctor and found out I have arthritis on my neck and still in the process of going to physical therapy and trying to regain strength in my arm due to the numbness I was having
