    The strangest thing about this whole situation is, copyright holders have the option on youtube to monetize people's videos for themselves and take all the revenue, or share it with the uploader. If Nintendo isn't going to put their soundtracks on some streaming service, or up for purchase somewhere, I don't understand why they couldn't just monetize the gilvasunner videos instead of taking them all down and burning their community just that much more.

      @@Bzorlan I've been pirating literally all media like that other than most videogames since I was like 14 and I'm 20 now. The real challenge is finding a new app/website when the one you rely on gets taken down but even that takes maybe a few minutes if you know what you're doing.

      This isn't necessarily greed. He was uploading someone else's music. That is illegal in any country with copyright laws. The fact that they waited so long to do this means there is a good chance Nintendo is planning to release their soundtracks officially pretty soon. Honestly, he is lucky Nintendo isn't trying to sue him. That many copyright violations would bury him for life.

      This is the same community that made Fortnite - a game with one map, one game mode, three team sizes, and endless micro transactions - one of the richest and influential games of last decade, and probably this one too. A game which even Charlie, someone who disgraces bad business practices in gaming, also continues to play. Giving open advertising to a game that does nothing but leech money from children. So fault for the industry getting so lazy and toxic is everywhere, and on everyone. Personally, I'm really tired of people who purchase and play these aweful games, by aweful companies, on stream. I'd wish they stop enabling these companies, and teaching their audience that it's ok. Throwing a ton of money at Pokemon League of Legends didn't teach anyone a lesson.

    This has been happening for even longer than just this recent "wave" of takedowns from Nintendo. Years back I remember when the BrawlBRSTM channels were targeted, which just like GilvaSunner uploaded Video Game soundtracks. In general, Japanese companies are just extremely out of touch with their demographic audiences as a whole.

      But 3000 strikes in a single day? Especially if you're not a sort of like "company channel" You can't rlly defend your channel with these copyrights. I got copyright striked once by TV Tokyo for uploading a video related to a show named Oreca battle I got myself into a legal battle, and in turn got 1 out of 3 warning from YT before turning into channel ban.
      So, what I suggest is that Nintendo should have posted those content themselves, just like Charlie said.
      We know it aint royalty free but if they actually release that content to the public, they get their own revenue from it, and that means less people covering up these copyrighted content and them having to takedown multiple channels in fear of "losing revenue".
      Like what? Losing revenue. when they dont even profit on their own work for themselves.

    I think this happened to one my favorite Animal Crossing New Leaf TH-camrs who I used to watch years ago. I would watch their Dream Diaries series. They loved the game and Nintendo and it seems like with all the strike down drama their love for the game and the company isn’t the same. I am beginning to feel like them, I used to love Nintendo but now not as much.

    The only game OSTs that I'm aware Nintendo publishes offically are the Splatoon game Soundtracks, but even then they don't release the entire OST, Just the tracks that are framed as being actual songs made in-lore.

    I'm not entirely sure it actually is illegal to share music that isn't commercially available elsewhere. My understanding of "fair use" is that it ends at media that could be used as an alternative to buying the official release (like "reacting" to an entire film), but if there is no official release from Nintendo, then they can't argue that these videos have cost them any sales.

      No, as soon as something is created, the creator has the copyright to it, this means no one can just upload an entire song from Nintendo. Even if it's a song from a Nintendo game that has never come out, the copyright is there and people can't use it outside of fair use laws which cover mostly criticism teaching or reporting which is usually fairly strict.

    The reason Nintendo doesn't try to make money off of stuff like this is simply because they don't need to. They've made so many good financial decisions over the years that they are basically swimming in money, and do not need to maximize profits by doing things like selling music and producing more merchandise for more IPs. Its one of those strange cases where a company being in good financial health is actually bad for the customer.

    This is unfortunate because GilvaSunner was such a good channel. Nintendo hardly ever releases their music in a normal standard way.
    Ah yes I sure love being in 2013 and making sure I bought enough video games so I could get the Club Nintendo platinum reward for that year so I can get a copy of the Majora's mask soundtrack on CD. I still do have this somewhere.
    Or maybe I can walk around with my 3DS so I can listen to the Mario and Luigi Dream Team soundtrack. Mind you one of the very few games that offered this kind of thing. Dunno what other games did this, but I know it wasn't a lot.
    Guess it's a good thing I can pull out my switch and play my NO LONGER FOR SALE copy of 3D All Stars and listen to those soundtracks. Or Smash. Great and not at all horrible and clunky option right here. At least with the 3DS you could listen in sleep mode with headphones, you can't on Switch.
    Nintendo needs to get with the times and allow things like GilvaSunner to exist or create a normal, feasible option to listen to their soundtracks on normal platforms.
    This also does make me concerned for the people that use Nintendo music as background music in their videos. Only time will tell for that one.
    Thanks Nintendo! Really love this move, like all the other terrible ones, lately.

    Just for some context, Gilvasunner was easily one of if not the most popular game music rip channels, with their uploads of some of Nintendo's most popular games being the most popular on TH-cam (Mario Kart Wii, Smash Bros Brawl, Mario Galaxy, Ocarina of Time, Mario 64 and a shit ton more), not to mention their name is the inspiration for the popular parody music channel, SiIvagunner. There's definitely other uploads of these soundtracks on TH-cam, but Gilva's were generally the best. Even though there's still a few notable soundtracks up there, namely the Banjo Kazooie games, they said they're deleting the channel this Friday. It'll be sad to see them go.

    That's just how Japanese companies are, sad to say. They tend to be way more scared of the internet and it shows. Not all of them, obviously, some are good with that, but seemingly most of the big companies, like Nintendo, have trouble moving forward. I mean, the internet isn't even new or anything. Different branches of Nintendo are infinitely better in terms of PR than the main one. Granted, it may not be better or worse in every way, but for sure in terms of public relations when it comes to the internet in particular, Japan isn't great with that. And I love Japan, but they can be somewhat... Xenophobic, so that could be a part of it.

    As soon as you said Gilva was attacked, there was a feeling of dread which washed over me.
    As someone who plays D&D, I have a shitload of music playlists with all sorts of sources, so now I have to go through every last one of them and replace the hidden videos.
    Fuck Nintendo. If they just uploaded their OSTs on their own channel I would happily use those videos. They’re not gaining anything out of removing these videos and are only shooting themselves in the foot.
    I’m totally going to pirate Legends: Arceus and any subsequent games that I’m interested in.

    I can't imagine Nintendo would still be popular if not for Pokemon. COD got hated because they released "the same game every year" while Pokemon has literally had several remakes released full price on consoles that were also remakes.       Can't stress hard enough how true this is. A lot of his content shined a light on lesser known pieces that now are just, gone. The channel basically served as a huge archive for the history of videogame music, Nintendo basically just burned down a library for no reason.

      and that's why I cherish my Yo-Kai Watch games and Kirby and the Canvas Curse. They have a soundtrack player *in the game* so you don't need anything else besides your 3DS and the game to hear the amazing songs from the series
      Nintendo could do something like this for their famous games (botw, Mario Odyssey, or basically all of them) heck they could have done this since the DS era like the Kirby games have always done...

      Usually people hate corporations for capitalizing on their own creations, in this rare case it seems to be the other way around! People are upset that nintendo isn't releasing the game music separately. Imagine the confusion nintendo must be feeling! I'd love to see how nintendo reacts to this. I'd think they're screwed either way!

    I live in Japan. One thing I've noticed is that the older generation does not accept change easily. Not just companies...the government, and basically any elder in Japan. They still use fax machines here and you have to go to city hall to fill out paperwork that could easily be submitted online. Old men are often seen with flip phones. It's this mentality that a lot of companies tend to go with. They love money from foreign fans, but they don't want to operate in a way that is friendly to their foreign fans. CDS and DVDS are still popular in Japan even though the rest of the world has moved on to digital. Recently Spotify and Netflix has only just started getting more popular. Companies in Japan don't like to look at how other companies run or what would be beneficial in terms of business. They only want to do things the old way. That's why people are so depressed and overworked here. The company will suck the life out of you. Because they think the longer you work, the more you'll get done. Even though it's been scientifically proven that shorter work hours equal more productivity. Anyway, I rambled a lot, but I guess my point is that the old generation's refusal to adapt to the times has contributed to their crazy copyright laws. The younger generation also has no interest in taking over or changing anything.

      @@kailfran while i do agree that one person isn’t enough to stop such a powerful corporation. I think having that single person be there lifts ppl hopes and can be a reminder to have the freedom to speak of the corruption. However, if a miracle happens and somehow there’s a group that has successfully pressurised Nintendo, there’s still a huge power gap and Nintendo can easily sue you so I think both ‘what’s the point in trying’ and ‘We’re gonna bring Nintendo into their knees’ is harmful way of thinking and are wrong to resolve matters like this.
      One attitude leads to the quote “for evil to triumph, is for good men to do nothing” while the other is history repeating itself where events such as rebels against king Henry the 8th has led to brutal consequences due to the wrong and rushed approach to tackle a corruptive evil figure.

      @@TheNwr1 Protests, speak out, talk to politicians, get involved in the community. No one has interest in politics either so the whole country is run by out of touch men. A lot of the reason things started to change in the US about working conditions is because people protested. They are starting to raise wages for example because people are refusing to work for minimal pay. If everyone just obediently does what they are told, nothing can change anywhere.

      I pirate Nintendo GameCube games out of spite specifically because Nintendo hasn't ported F-Zero GX, one of the best GameCube racing games of all time, to any system ever. It is stuck on the GameCube rotting away while Nintendo tries to pretend that gamecube games don't exist.
      I do not feel morally in the wrong for emulating F-Zero GX.

      Why does it matter so much if its "morally" correct or not? The people who make games don't get paid based on how much a game sells, they're paid regardless beforehand. The only thing piracy really affects is whether a game gets a sequel, since the decision to make those are based on sales.
      If you want to pirate something, just do it. Trying to make it a social crusade just makes you look pathetic, honestly.

Yeah, "unpopular games" probably wouldn't be included because it's literally going to cost them millions of dollars PER GAME in paperwork to secure the publishing ("obscure games" are often more because of how the composer feels they deserve more). Japan has a LOT of outdated practices that were kept because of tradition. Hanko stamps? Getting drivers license? Doing anything bank related? Legal papers?? All of those processes are a NIGHTMARE to go through. Business practices are one of them. Did you know there is no official anime streaming service in Japan? Freelancing is nonexistent, you HAVE to be under a company? Absence of work and life balance that makes people choose between having a family or a career?And it doesn’t get changed because Japan likes to do things their way and has predominantly old generation ruling everything. So yeah, pick your poison I guess

    I have always stood by Sega. Even since the Genesis. This is crazy. Sega at least knows that people using their assets is a form of appreciation, and free marketing. Nintendo however, is toxic and always will be.

    Some of my best childhood memories involve me playing Ocarina of Time, Majoras Mask, and Wind Waker in my room until the early hours of the morning. Nintendo has truly great titles, but after Nintendo Online, the N64 subscription service, and now this, I’m really starting to hate them as a company. I’ve never seen a company so out of touch with their fan base.
