    lost for words..... i am shocked they any Gov't agency actually thinks they can take 100% of your income and expect you to keep showing to work for free and somehow absorb the costs of life on a weekly basis, unbelievable!

      Steamed Vegdaballs This is the second time it's happened to me, the first was with Durham when I was employed with them. When it's the state or the government, they can take everything you have, cripple you financially, and then punish you again for not being able to keep up after your income is gone.

      The letter of the law meant nothing when she wouldn't let me see my kids in defiance of a court order. This after me spending 54k on a legal bill, 45k lump sum settlement to her and $701 after tax child support every month from 1996 to when they were 18.

    What a mess. Only thing I can think of is to become a handyman. Tell people "I like cash". I've got a friend who does this, has been self employed for years, and is happier than when he worked for corporate America. He found that there are lots of older folks who can't afford a more expensive handyman to meet their basic needs, so the underground economy helps both out.
    It's sad that we left Europe 200+ years ago to avoid debtors prisons, and then set up similar scenario's here. :(

    I'm shocked. I didn't think people were stupid enough to want to garnish someone's income for 100%. All that does is motivate the person not to work, or to keep switching jobs (as you mentioned). These lawyers are spineless and must be trying to cash in on you for a quick buck

    • @CoffeeTalkLive

      Bottom line, the system doesn't care what happens to you so long as they get theirs. For example, I've read that there is a concern over the number of people who commit suicide who owe the IRS. Now if people are killing themselves to get away from you, then I think that's a pretty good sign that there's a problem with the way the system is set up.

    They aren't allowed more than 2 garnishment at the same time. You need to go to the Dept of child srvs or whatever it's called there and bring in that pay stub and request to lower your child support payment to a min amount as well as the back support. That is not $50 per month so total it's $100 a month. The union fees don't count as a garnishment so that's not really much you can do there. That's a good job I hope you were able to keep it. I can offer you some advice as I have some experience navigating through some difficulties which you are currently finding yourself in.

      mookixox you shouldn't have to go in to bankruptcy! If your only earning $200-300 per week a cost of living scale needs to be applied, if this happened you would see that David cannot pay anything at the moment all garnishments should be removed until he gets a better / 2nd job

  • @AroundIndiana
    @AroundIndiana 6 ปีที่แล้ว +1

    That really seems illegal. I've never been garnished but I always thought they could only take 25% of your net income. I also thought there could only be one active garnishment at a time, then the next one starts and so on. I was wrong I guess. How is someone supposed to keep working if they have no income

    • @CoffeeTalkLive
      @CoffeeTalkLive  6 ปีที่แล้ว +2

      It should be illegal. But then most laws aren't really designed to protect the individuals interest. They are geared more towards state and corporate interests. Bottom line is the golden rule, (he who has the gold makes the rules)...

    Hey I have good news! As it turns out only a judge, acting in his public capacity , with jurisdiction, etc. COURT documents MUST have a filed stamp on them with clerk signature, and the date filed or they are not valid. Child support enforcement agency is a private corporation NOT PART of the government, there CONTRACTED thru the executive branch of government. Child support enforcement agency decided to use an expedited administrative process, rather than a court of law, for the convenience of child support enforcement agency. A expedited administrative process is not a court of law, it's a fake hearing. What their doing is criminal. It's all a scam! Check out A man Osiris, and or Rick W on you tube they go through and show you what's going on. What the law says, and what there policies are and wow major criminal activity.

You'll live with shame labels much easier than a stroke. This stuff is insane. Can you involve a high level Government branch? Like it sounds so brutal and extreme. When I was in one of my rehabs stints I roomed with a guy who had child support payments. He was a roofer, they took his license, he couldn't work, hence no child support WTF?!

  • @pjamesbda
    @pjamesbda 9 ปีที่แล้ว +1

    David. When will incredulity move over and make room for acquiesce. You are an educated man, right? This is what that "education" did not bring to you, that unique ability to differentiate between matters within your control, and those outside of your control. The 3.74 gpa has indeed failed you, as has the system from which it was spawned, with all of it's false facets.
    Don't despair, we are all gathered here; with you. It is not a dream, Kansas has gone "bye, bye", and now it is time to realize and resign the failure for what it is. Stop beating yourself up. Don't go back for more....there is more than enough structured violence to go around and, some, like you, have taken much more than others. Thank you for your story, hopefully others will hear it. Peace.

    • @CoffeeTalkLive
      @CoffeeTalkLive  9 ปีที่แล้ว +1

      pjamesbda Hoping others will hear the story is part of it. Partly in hopes to educate others who may be approaching the same predicaments, and partly so that I can have a voice if at all. if the courts and the system won't listen, somebody will hear what I have to say. The GPA does me no good now, only the education I received in The School of Hard Knox, hence the title of the program.

    • @pjamesbda
      @pjamesbda 9 ปีที่แล้ว +1

      David, - as a fellow Jay-hawker I identified with much of what you've described. We took different paths, but the outcomes are similar. You mention that the online excruciating rendition of your demise is driven by a hope that someone will hear your "voice", and it will in some way help them navigate the labyrinth.
      Instead of college, I studied Carlos Castaneda who said this behavior was that of a conceited man, seeking either to be admired or pitied. He said a warrior understands that he must stalk power, and not divest his limited energies in self indulgence. Additionally, he said we should be cognizant that this demeanor of "no pity" comes from an awareness, that ultimately we are also being stalked, by virtue of our own predictable patterns of behavior. We should instead focus on disrupting these patterns, and of destroying personal history.
      There's that...and there is the other side of that.
      Will send the rest if you like...(don't want to go too far unless it "helps").

      Well, if you make under 15k a year go apply for medicaid. The best place to get dental insurance is through a discount dental plan at $100 a year. Sounds like bankruptcy would help. Put your student loans on the bankruptcy and file an adverserial hearing. Get it all wiped out. Then start looking for new career options where you have more control over it. Or side gigs- for instance just saw a company today called uber where you drive people around town for money. Or staff.com where you can get telemarketing gigs that you can do from home. But it sounds like a bankruptcy and fresh start is the way to go. I would talk to 2 different attorneys to see which one is better.

    I recommend somewhere warm and tropical in Latin America. From what i understand while extradition treaties mean that you can be extradited for a criminal offense of significant merit to warrant it. Contempt of court for non payment of child support or garnishment isn't going to get someone extradited. I think only a few Anglo nations like UK, Canada, Australia and some western European countries have bilateral treaties which enforce this.

    Sorry, it might be stupid. But can't you file bankruptcy and start all over again? How rich people file bankruptcy so many times even tho they have money and are still rich.

      Because they can afford the bankruptcy. You don't get to do it for free. And bankruptcy cannot include taxes or student loans.

      I just checked fees and they are not that high. You seem smart enough to do it without attorney and you were talking about some credit card loans. I havent heard you talking about student loans. For taxes, as far as I know, you can make deal with them (which I think you already did?) And have payments. I watched a lot of your videos and you seem smart enough not to be in such situation. You need to make moves to get out of it, not to keep dragging it any longer.

      The problem with bankruptcy it takes a while to get your records cleaned. Also, "credit" is essential if you have to buy a car or a house. So you may want to check further with attorneys but ask a lot of questions - don't want you to lose out on opportunities even jobs. Can you get a job working from home, like I do, and get paid adequately? I work scheduling appointments for companies to meet with new clients which is what I do. I wish I was rich to help others but am trying to survive. Take care. Angela
