Basically if you kill one it steals one of your ops. You cannot avoid this as you have to kill them. The op stolen is the most recently deployed one and they are gone for the rest of the battle.
Also that third phase Patriot goes into is conditional. If you carry too much weight all ending bosses will gain a third phase with varying degrees of extra difficulty.
