- आज बात यूनिफॉर्म सिविल कोड यानी समान नागरिक संहिता की। कारण अक्सर यूनिफॉर्म सिविल कोड का मुद्दा उठता रहा है। इस मुदृे पर समय समय पर सुप्रीम कोर्ट में याचिकाएं भी दाखिल हो चुकी हैं। सुप्रीम कोर्ट ने समान नागरिक संहिता बनाने के संबंध में अप्रैल 1985 में पहली बार सुझाव दिया था। वैसे देश में गोवा एक ऐसा राज्य हैं जहां 1961 से यूनिफॉर्म सिविल कोड लागू हैं। संविधान के अनुच्छेद 44 के तहत समान नागरिक संहिता को लागू करना राज्यों की जिम्मेदारी है लेकिन बड़ा मुदृा ये है कि आखिर यूनिफॉर्म सिविल कोड देश में अब तक लागू क्यों नहीं हो सका है? मुद्दा आपका में आज यूनिफॉर्म सिविल कोड यानी समान नागरिक संहिता से जुडे विभिन्न पहलुओं पर चर्चा करेंगे।

Morever,Buddhism rooted into Hinduism,and for ur kind information Buddhism was uprooted during muslim invasions.... Yes it is true that India is a secular country but it is also to be noted that unless and until we are purely united despite of having a diversity in language, religion, thoughts and many other things then only uniform civil code be implemented in an effective manner.
But .. I think language,religion and thoughts have no role over humanity and equality as a whole...After all CVC talks about equality and prosperity over contractual or legal rights. and going through the talks ,he has clearly decodified the things ..If you have watched !!
It needs lot of understanding and research to say how Uniform civil code will work once implemented. It is a challenging task. Different religions have different religious laws So it is tough to bring all of them under one code. The women would definitely benefit but taking the religious groups into consensus is very important and that's a challenging task convincing them the benefits of the code and bringing them together. Universal civil code is a little controversial so building a consensus is important so that controversies don't outweigh the benefits.

From the beginning every political problem in 2020 which I faced or I was asked to write upon I supported peace on every issue right from peacekeeping forces sent to maintain peace in the region to stopping other ways of harming people.... Despite these efforts if powerful people resort to violent means to assert power last year(2021January) but my stand was peace. and here I want to mention one thing I face people who have lot of power so it is so tough for me to write anything but still somehow I manage. Every body has an agenda so the kind of pressure that is put on me is immense. So the stand that I took was on the basis that other language speaking people would be liberated just the way India liberated Bengali speaking people in 1971 war and created Bangladesh. When the reasons of war were quoted as security concerns of a nation and liberating different language people and to end the war that was going for eight years then anybody would relate the above example of India and Bangladesh. Always my point of focus was on less wars Even when I related previous historical things then it was about less wars only. Criticism on west was also about less wars and I always used to ask why do they wage so many wars and create humanitarian crisis. I thought that the war was to liberate language speaking people on whom war was being waged for past eight years and also the previous experiences of sending peace keeping forces to the surrounding areas to maintain peace. In most of the official speeches that I went through there were always about security concerns, economic problems, development, peace keeping forces and no purges like previous leaders did. So when purges were made I thought it would be like the 1971 war. So I thought it was basically the liberation of civilian people who spoke different language and security concerns.
Every issue that is put before me is very very tough I have to bend my mind a lot to express the opinion. So powerful people they have the power and if they want to blame me , I can't do anything I have always seen a tug of war wherein I am pulled from different directions. How much can one person take? So if you want to blame me then I can't do anything. Everything was challenging and I expressed my opinions as much as I could understand. Since two years I have seen lot of instability in the society health crisis, lockdowns, stand offs, and lot of threatening atmosphere that was there all this fell on me. They also tell me aim this high that high and they bring me down. When the problems were so complex how much do you think a person can do in such a stressful and a threatening environment? People who have power can blame and anyway from past two years I have taken a lot blame, threats, and etc.

Secular government and secular law means that both the government and the legal system is blind to religion i.e. it does not take sides of a religion or does not form laws or practices related to a particular religion. It treats every religion on the same footing. But the reality is that the Indian nation calls itself secular AND allows and forms special laws and practices for Muslims. So how is it secular then? You can not both, have the cake and eat it. This is a contradiction of principle in law and governance, a hochpotch created in the unsorted brain of Gandhi- Nehru- Indira. So uniform civil code is needed to maintain a true secularity in India. Otherwise throw out the word "secularity" from the constitution and create special religious laws for different communities. By introducing the word "secular", Indira Gandhi had inadvertently created a contradiction in the constitution and a future reason and a road map to throw out the special privileges under the "Muslim personal law" from the constitution to maintain it's secularity.

Why Uniform Civil Code is necessary?
Wakf Act 1995, Has many draconian provisions, section 52 & 53 which can declare anyone has encroached & under these sections can order the person to leave with the help of DM SSP, Can that be done by Non Muslims? Do they have these privileges?
There are limitations for Hindu deities to knock the doors of Court, it is having limitations with time, whereas WAKF board has no time limitations according to section 108, Is this not the violation of human rights & Equality in connection to various faiths?
According to section 89 one has to send a notice to WAKF board before filing a case, it is just like parallel Government. Have you ever heard of sending notice to before filing a case? According to my knowledge it happens if a person is filing a case against Government.
Section 4 & 5 WAKF Act, according to this there will be a survey of land that will be done on timely basis, whose expenses are to be bore by tax payers of India.
1991 worship Act, which is also non secular,
In continuation, If there are any issues faced by Churches, Temples, Gurudwara it has register a complaint with Police, Whereas WAKF can order the police if there are any discrepancy according to the board & police has to abide by it. Is this true with your respective cases, introspect.
WAKF Act, section 40 gives the power to the board in connection to declaration of any of the property as its own. Can a normal citizen do this? Here please correct me if I'm wrong with authentic sources.
If there are legal issues faced by Non Muslims then they are suppose to fight in WAKF tribunal which is run by Sharia Kaanoon can they ever get Justice? I don't know, if true please enlighten me with the verdicts so given. So WAKF tribunal is an authority, hence in future if a person gets a verdict from it in favour of him/her & can challenge the opposing verdict given in the same case given by Supreme Court of India, till date it has not been done, but what is the guarantee that it is not done in future? Think.
Keeping all these powers in hand, WAKF board is asking the petitioners of Mathura & Kaashi Temple that they should not fight it in Civil court but in Sharia Court A.K.A WAKF board. This is the outcome of the powers so given to the WAKF board.
It also has provision of public servant in section 101.
Hence UCC is necessary.

UCC has its advantage, biggest advantage being that it will help the judiciary to interpret laws easily and pass judgements swiftly.
But it is wrong to say that Goa has a UCC. Goa UCC was passed by Portuguese Company when it was ruling Goa till 1961. And it continues till date and it also has some discriminative provisions as it is a Christian tilted law.
