    The quickest way to turn the general public to a life of piracy is to do things like this.

      Poorly thought out anti-piracy measures usually have a way of causing more piracy. On the gaming side of things the Playstation Vita is a pretty funny example of this; one of the reasons (emphasis on "one of") it became sony's worst selling Playstation is because they went overboard with the anti-piracy measures (proprietary memory cards that only went up to 64GB (which is pretty weak seeing as each game took up about as much space as a typical 7th gen console game) and were incredibly overpriced, the content manager system that required you to manage USB file transfers through the Vita itself (the idea being that the Vita wouldn't show any illicit files stored on a PC), the ability to only download photos through the internet browser, etc), and hilariously despite Sony still trying to patch the console after they supposedly gave up on it (a move they've also down with the PS3 and PSP on a couple of occasions) the Vita is now ridiculously easy to hack to the point that you don't even need to plug it directly into your computer, and alongside the usual piracy hacks (one of which gives you free access to pretty much every game on the Playstation Store) they also added the ability to plug Micro SD cards into the game card slot which allows the storage to be expanded by at least 400GB and even made some of the Vita games run more smoothly by giving the user the ability to overclock the CPU (possibly the GPU as well but I'm not 100% sure). And if that wasn't enough, the Vita can now emulate the PSP's operating system via a homebrew app called Adrenaline, and can also play Gameboy, Gameboy Color, and Gameboy Advance games. Basically the hackers have managed to keep the console interesting whilst Sony have apparently ditched the portable console market altogether.
      The PSP has a similar story, but the PSP's story is even funnier because it gradually got easier and easier to hack the console despite Sony's patches. In the early days you had to modify the inside of the PSP's removable battery to turn it into what the hacking community referred to as a Pandora battery. Skip forward to today and hacking a PSP is basically just a case of downloading some files, putting them in the right folders, and then launching some games in a specific order.
      Sorry if that was a little long winded, just thought I'd show how your rule (albeit a slightly modified version of your rule) applies on the gaming side of things as well.

      @@MythicSuns What's funny about that is Sony for example doesn't understand that not everyone lives in a 1st world country and can't drop 60$ on every game they want to play, which is why PC gaming is so much more popular here in eastern Europe or at least was until 4-5 years ago now PCs got expensive as hell. But the PSP was a pretty popular system because it was easy to hack and people charged you like $15 to do it for you. If people weren't able to hack it nobody would've bought it.

    At least with Nintendo it’s really not good at all. $50 a year and you get very subpar emulation with a lackluster amount of games.
    The Switch Online service is a disgrace to these old games. Inaccurate rendering of effects, greater than normal input lag, lacking certain features, or flat out corrupting your save files.
    It’s not a good service and I’ll gladly pirate those games (and all the other ones that aren’t being sold) and play them on either original hardware, or cycle accurate emulators like Higan.

    As someone who works in music copyright, I can tell you that this case was terribly misrepresented by the press, especially by omission.

      I disagree. I've read their statement... and at the end of the day, if you work in music copyright, I certainly hope you can understand why there should have been NO response to this whatsoever. If someone looked at this woman's eBay account, saw she was selling ONE copy of this ONE CD, and that's the only infraction? It should have been completely ignored. Nothing was gained by Clapton's side, nor was anything lost, and it would not have set any precedent that mass bootlegging is ok.

      @ADoseofBuckley his team at Reprise Records (as well as many artists with other labels) have an automated system that tracks down the attempt of illegal sales of copyrighted material. The CD in question was an illegal duplication of a broadcast. The 3rd party mandated representatives did send a variation of a C&D (a privilege especially with 1st license refusal). She was told to take down the listing without any further consequence. She challenged it AGAINST her own legal council's advice. She rolled the dice and lost.

      I always say if you liked it before the offending incident or at least knowledge of it, pass. If you start liking or continue to support, I'm not into that for most offenses that bring up this argument anyway. But especially no remorse and doubling down they're the victim (Chris Brown, R Kelly), I don't want your stuff near me.
      Harder with like film or shows with hundreds involved. Music is way more focused and producers often know their artist screwed up or is outright evil.

      On top of their love affair with all things Clapton and Zeppelin, Rolling Stone has a major bias against certain genres (not to mention countries) when it comes to guitarists (and musicians in general) - in their list of Top 100 guitarists they have Alex Lifeson at #98, Dimebag Darrell at #92, J Mascis at #86, Joe Perry at #84, Richie Blackmore at #50, SRV at #12, and no mention of Yngwie Malmsteen (among others) whatsoever, yet they list The Edge at #38, George Harrison at #11 (wtf!), and Pete Townshend at #10 (seriously? Townshend is a better guitarist than SRV???). Supposedly they had some fairly well-known guitarists on the voting panel, but I wonder how much weight their votes _actually_ had.

    Eric Clapton is a musical legend and his songs are some of my favourites - being routinely on my playlist.
    However he is a complete fuckwomble and if I met him it'd be a toss up between getting an autograph or giving him the finger.
    I long ago managed to separate the art from the artist.

      Honestly when it comes to your favorite artists, I think it's best to maybe not even follow them on social media and not read any news about them. A lot of times it will just result in being disappointed with them as a person at best.

      I think I'd probably have to go with Jimi Hendrix, Chuck Berry, and Bo Didley if it was on the basis of "what these people did for the artform and how much the music world owes them in terms of their contributions", if I was to say FAVORITES though, I'm sure I have to include Dimebag Darryl in my top 3.

    The individual cases (9000 per song) are intimidation tactics and trying to set an example. Completely agree that it should be a dollar a song. Maybe 2 bucks a song if there's a hardline about it.
    Artists and labels only reinforce why pirating exists with cases like these. It's sad.

      Worth keeping in mind he had just suffered the death of his infant son and had severe addiction problems at the time. He has since shown significant remorse for how he behaved during that period of his life. Doesn't excuse his behaviour, but I don't think it accurately represents who he is now.

    Meanwhile, The Grateful Dead have a monthly service that offers its fans a bootleg CD from one of their live shows for one flat rate.
    Eric Clapton maybe a great guitarist but he's a crap person. Besides, Jeff Beck, Eddie Van Halen, Rory Gallagher, Vernon Reid, Jimmy Page, Kevin Shields, Jack White, Dimebag Darrell and may other players are much better guitarists and don't have the baggage Clapton has.

    I bought an Amon Amarth album digitally from Amazon, and then a week or so later received a whole packet of papers stapled together detailing all these songs I "stole". I called these people saying I didn't steal this album, I have the receipts and they were not having it. I scoured these papers and they were dated on a day I wasn't even home and have definitive proof of not being home. Idk how this happened, but ultimately I had to pay $300 for this album I legally bought.

      Oh I'm sure they would. They're doing it wrong. Punishing the users in the way they do is ultimately a waste of resources. If you're going to imprison these people, at least force them into a proper rehab? And then punish the scumbags who push drugs in neighborhoods, who make drugs, etc. Treating the symptoms doesn't generally cure the disease. I guess maybe they think "if people knew there was such harsh consequences, they wouldn't do it, and then there'd be no one to sell to so people would just stop making it" but that's not likely. I mean ultimately there's no real solution in that exact situation, addicts will abuse something, whether it's legal or not... it wouldn't be better for these people to just drink legal alcohol instead... but ultimately they've proven they don't want a solution. They WANT this revolving door situation. It makes more money.

    I understand you wanted to make a contrast between Clapton’s story and opening about video game roms, but it’s a terrible take to say Nintendo can toss up crappy ROM versions of their game and paying $50 with a paltry library is in anyway fair. The archiving and preservation of video games is in a terrible state as it is already and yes, there are games impossible to play or get ahold of without roms.
    My one gripe, good video and really disappointing to hear about one of my favorite guitarists, I’m one of the old bastards that listen to you that has a copy of Unplugged

    Most of Eric’s work is either a series of covers or that of songs about George Harrison’s wife (“Layla”, “Wonderful Tonight”, and “She’s Waiting”, for example)

    I still think Fogerty vs Fantasy records is a dumber lawsuit, where the artist gets sued for writing a song that sounds similar to one he wrote over 20 years before, but wins in court by bringing his guitar. To me this just seems like a pretty standard copyright lawsuit that happened to be made public for once.

Pearl Jam, for example, knew there were way too many bootlegs out there so they started selling live recordings instead of going after people selling the bootlegs. As said in the video, Clapton didn't need to take this woman to court. It was ONE CD.

      I agree, I think there needs to be a better middle ground. I don't think it should be the "70 years after someone dies" (so they made it in their 30s, they die in their 80s, then 70 more years until it's public domain?) but I also don't think it should be like... the people who are like "once something's 20 years old I should be allowed to have it for free or make money off it".
