I have bought into a complex in Phoenix Durban then found out that it is sectional title when i got the keys. We paid in full at the start thrm we're told we need to pay transfer costs to transfer property. I just found out plans were not even passed yet 6+ years later. We still have no title Deeds and their lawyers are trying to form a body corporate and sit on board and collect back fees for all these years and present fees thought they did nothing. Not even maintain our properties or do initial corrections or repairs. What legal implications will this have? Can a body corporate be fitmercwhen we dont legally own property Also we need ro fence etc as property is open and crime is rife ...but we have no property markers which we were promised in 1st months we took occupation. Can I just estimate to secure my house ? The lawyers refise to desl with some of us and are totally unhelful . They just want body corporate fees. We have invested a lot to secure propery as bank with no retainers slid and yard was full of bush, cracks formed, walls leaks as well and we have damp issues and evennthe roof leaked and needed to be completely redone. Plumbing abd enevtrical issues too. What can be done? And us firmingva body corporate legal uf we dont legally own and plans are not even passed. If we furm a body corporate coukd we then be sued ourselves if this complex falls apart or needs repairs? Why are they pressing with this. What legal implications will it have?
