Upon death a person cannot be tried of a crime. So the trial would have been dismissed as the defendant was dead. Upon being found alive, the case would be reopened and there would be a retrial, this time with a verdict. Generally in order to not be allowed to retried the case has to have a verdict passed. Otherwise cases where the jury couldn’t reach a verdict couldn’t be retried or where a case was dismissed but more evidence found. Once a verdict has been passed, a person cannot generally be re-tried. This has been weakened though and there has been a few high profile retrials but there has to be new fundamental key evidence and the DPP has to approve it.
