      We do need better mental health facilities. They closed many mental health hospitals , centers and residential facilities in every state in the US . Where do these individuals ( patients) go ? To the streets, when they are picked up by police ( if a crime small or big ) is committed. They put them in jail , let that sink in . They are locked up with minimal mental health care in a jail .

    Yes. We absolutely had de jure discrimination. There were exceptions to medical insurance that specifically called out exempting trans healthcare. And this law is just another example of _de jure_ discrimination against trans people. How can you possibly argue there hasn’t been any de jure discrimination, when this law specifically discriminates against the class you’re asking about?!

      The facts are the discriminants, differences in biology have non symmetrical injuries. Discrimination is a concept and fact of reality before it is a social malady. Objectively, discriminating allows differentiation and discernment. Is a necessary feature of logic.

      Actually, child safeguarding is the number one concern of people who protest chemical and surgical castration of children. Did you know “LGBT sanctuary laws” that encourage children to run away from home to California and other states to transition are causing a child sex trafficking issue? If you were familiar with the stories of those promoting the evidence-based psychotherapeutic approach to gender dysphoria, rather than the “gender affirming” (aka child castration) approach, you would be familiar with these sad stories and know that we do care about all those issues, both separately, and where they intersect (as they sometimes do unfortunately for gay/bisexual and other vulnerable youth).

      I thought it shameful to hear her ask the Supreme Court to deny Tennessee the right to outlaw child mutilation within its own borders. The ban clearly applies equally to boys as it does to girls -- it doesn't discriminate on the basis of sex. All states should require doctors strive to First Do No Harm.

      Example? I didn't hear anything that undermined the argument that the law, on its face, has a sex-based classification. The state of TN even had to concede that when pressed by Jackson. Remember that that does *not* necessarily mean that the law is unconstitutional -- but rather that it should be subject to heightened scrutiny; and therefore should be sent back down to the Sixth Circuit to evaluate the law under that standard.

      The claim is that although what we consider "gender" is a social construct, there is also an innate "gender identity" within each of us. This was exposed during the oral arguments when Strangio attempted to argue that gender identity is an immutable characteristic but also that it can be changed due to those who identify as gender fluid, so not immutable. Gender ideology doesn't hold up well to rational scrutiny.

      The assigned at birth language comes from the intersex community. It is trying to say that the Doctor isn't always right during this process. This is understandable because we don't do a bunch of tests or DNA sequencing. Doctors are only looking at the baby's phenotype and are assuming that the child's sex matches with their assessment of the phenotype. The Doctor is almost always right but sometimes they are wrong.
      The trans community uses this language to illustrate that ultimately the doctor isn't only prescribing a sex but also a gender. The gender assignment can also be incorrect.

    D.N. is such a great ally and champion of civil rights. It would be very interesting to see if there is an intersectional group that places rights of trans and queer folk in alignment with overlapping socioeconomic issues that impact the poorest among us. how can we use identity, based on SES*, to unite ppl around their rights? how do marginalized ppl begin to be seen by working class voters as on the same page and in coalition for the same issues that impact poor families?
    I feel as though William Barber II and his Poor People's Campaign may have a good answer to that.

      It is not a conservative value that parents should be able to do or not do whatever they like to their children. Yes, they believe in a lot of parental control, but not unbounded. Should parents be able to provide unsupervised access to firearms to children? We have limits for good reason. Providing drugs to someone so that their body doesn't fully develop is an extreme measure and not surprising that it is questioned.

      @ No, this is a simplification that ignores medical reality. Puberty blockers are safe medical best practice and prescribed intervention. Parents are choosing to get medically appropriate care for their children, that is what we should support, not restrict.
      A lack of access to puberty blockers does create changes in the body that are unchangeable in the future, puberty blockers when discontinued and not followed up with HRT allows typical genetically based development. The accusations of harm are not medically based.
      HRT does create changes that are lasting. However, these changes are desired, medically appropriate and life saving. HRT is rarely given to people under 16 and when it is the risks have been carefully weighed.
      People cis or trans have the right to make their own body a safe reflection of themselves. Puberty blockers allow time to make those decisions with a fully developed mind and body. HRT allows people who already know to create the most safe and self reflective body they can. This is always morally and medically correct.

    We need to just leave this to doctors, therapists, pyschiatrist, and parents. Keep it out of politicians' hands. They do not have enough education in this. We have things that really impact all of us. Leave Trans people alone. They just want to live life. Children do need more care in this situation. However, put the care back to the medical field. Unless I'm having intercorse with someone, I don't care what sex you are. Children do have certain situations where sex gender care is needed. Parents need to work with the professionals for decisions. This is a diversion to things we really need to focus on.

    1. Is the hearing and assessment of the medical evidence is on hold pending the outcome of this case - (the courts have reached no conclusions on the medical evidence yet)?
    2. Is it to do with the bar by which the medical evidence is assessed (surely that should apply both ways)?
    3. Is it to give girls a more protected right to testosterone than boys and visa versa for oestrogen (are we saying aspects of sex discrimination in the medical field should be protected)?
    What are the judges asked to decide?

      I didn't know if tattoos and piercings are a good analogy. A better analogy would be other medical procedures performed on minors with parental consent. The choice to undergo gender affirming care for a minor should be a discussion between the minor, their parents, and their doctors, based on the best medical evidence and practices available. The state shouldn't get involved to the degree of an indiscriminate ban.
      There are already sensible limitations in place, such as avoiding gender affirming surgeries until the patient becomes an adult.

      There is no sex discrimination involved. Whether you are female, non binary, male, or transgender, everyone who can seek a tattoo is expected to wait. If the restriction applied only to trans people, or one sex or another and was designed to make people "appreciative of their sex" in the state's eyes, it would be a different matter.

    Why not have the child wait until they are an adult to make such a radical decision since the brain and body aren't fully developed until young adulthood? The delay certainly outweighs the potential harm - that many adults regret getting these treatments as adolescents or juveniles. So this case isn't about trans rights, it should be about protecting innocent children from making irrational mistakes that have huge implications on their future happiness. Its the same reason we don't allow children to vote, to drive, to drink alcohol, etc. You lefties are just pushing for the sake of power and influence to destroy. It's Satan throwing a temper tantrum.

    Instead of conforming to social pressures, why not look into physical causes of gender dysphoria before turning to invasive measures. Such things as the presence of estrogen mimickers in drinking water and beverages in general, including plasticides, birth control residue, industrial solvents, etc. Several studies done on the effects of estrogen mimickers on fish, wildlife, and humans.

      Recent findings are that true gender dysphoria is caused by a birth defect and cannot be cured with symptom defined in the ICD and DSM with care outlined by WPATH (which I some personal disagreements with but it's the best we currently have). Prenatal hormones instruct the body how to develop many parts of your body and for reasons we don't yet understand there's a mixup in small but dimorphised regions of the brain causing them to resemble that of the opposite sex. This is similar to what happens to cause some intersex conditions (they also sometimes need healthcare similar to that of trans people as do many others who aren't trans)
      We don't have a reliable way to test for this and if we did it would be very expensive so the true solution for fighting post-transition regret is to eliminate other causes someone would transition when they're not trans or detransition when they are trans. Fighting transphobia and hatred from family, strangers, and the government. Not enforcing those weird old gender roles that make some people feel as though they can't express themselves freely without wishing to be the other gender. Easily accessible gender therapists to help someone rule out other causes of gender related distress such as sexism or trauma. And keeping these weird politicians out of control of what people choose to do with their own bodies.

    The issue is a health issue, stop making it "cultural". NO ONE would approve of a minor taking testosterone to become better at sports. Yet they are encouraging it for "trans" youth. NO ONE would let a minor do plastic surgery because they didn't like their body, but they are ok with it for trans. Why? Both are issues where people are not happy with their body. That unhappiness is a mental issue that should be dealt with in therapy to encourage self acceptance. An adult can do what they want with their body. A minor literally hasn't been through puberty to actually FEEL the effects of the natural hormones once they present themselves.

      Can you find any reports of this actually happening? "Gender affirming care" includes social transition which is all that is ever advised for most trans children.

      They do actually allow minors to have plastic surgery, especially if the child is being demonstrably bullied for something that requires surgery.
      Examples from my family, all of whom were under the age of 16:
      -Ear-tuck to prevent ears sticking out too far (5 and 9 year old cousins, in the 90s, respectively)
      - surgery to correct a droopy eyelid that was not causing vision problems, just looked silly (11 year old cousin, early 00s)
      - 3 nosejobs for one aunt and two cousins
      - plastic surgery to make my cousin's ear look "more normal before prom pictures"
      All were allowed pre-16 and pre adulthood with parental consent and enough documentation from doctors and therapists... but buddy, nobody wanted therapist or social worker's notes and proofs about my cousins getting their goofy ears and eyes cosmetically tucked. The parents didn't like how it looked, they could see how kids could bully about it, but also money is green and it didn't hurt the child if they wanted to "fix" the thing that they felt, or were constantly told, was wrong with them. So, no, there are full 30~50+ year olds by the millions in this country who had an elective surgery before the age of 18 bc their parents either had the money or the desperation to buy their child out of awkwardness. Not just bullying and suicidal depression, which trans kids are highly at risk of, parents consent to have their children operated on every day to avoid "awkwardness." Chill with that, you're wrong, but not many rhinoplasty princesses are going to chime in and put their necks on the line here.
      As to your whack crap about sports and T: uhh... you do know that parents dosing their cis sons they think "aren't manly enough" are why a lot of pharmacies refuse to fill scripts for T as pills, opting or requiring instead it be topical or IM so the patient knows they're being administered medication (if not doing it themselves)? Like cis parents of cis kids did this. It's why testosterone is so tightly controlled. It's not the purity of sports ethics making it into medicine, it's that too many non- trans people have abused it over the years seeking their own gender affirmation benchmarks.
      Parents have, and do, buy and allow their children to use steroids and other performance enhancing drugs to excel in high school sports and get good college scholarships, you're out of your depth and out of touch with reality even within your examples.
      People do approve of it when they're misinformed enough to think it'll give their kid an edge or increase their performance. but, obviously, they get furious at the idea of anyone else's child receiving the same boost. more so if it's to have an even better edge, but also clearly just to maintain A standard of living.
      It is a health issue and since you clearly lack experience with child body image disorders or time spent with adults who did have necessary or fully cosmetic plastic surgery as kids and teens, you should probably stay out of it. You really don't know how this works, for better and for worse. Kids who wanted the cis norms-pleasing surgeries, kids who didn't but caved to peer and family pressure, they're adult now. Millions could tell you they wish they didn't or hadn't been allowed, and millions could say it's the best thing that could have happened once they were old enough to look back on those old photographs with the clarity of having still been bullied for a less easy reason. Even the ones who said "nah, that was a mistake" still thought the choice should be doctor and patient, with parent weighing in for legal reasons. I know so many women who don't have their original noses just because their mothers didn't like it and they didn't really know how to argue back about it, at the time, to their mom and the doctor simultaneously. Money is green and plenty of weirdos operate on teen girls to make them "hotter" for modeling or TV aspirations, but I don't hear any heat for that.
      You somehow only have beef in this long comment for trans people. Bro.

    You want to speak of discrimination? In Canada if you are trans you can get breasts for free but if you are a woman with breast cancer and need a mastectomy you will not have the same option of replacing breasts you were BORN WITH. I bet DN wont cover that, in fact I know it.
    Hormone therapy can be something you need or feel you need. One might be a medical necessity the other, something to make life more palatable for you. Out of context a nosejob is rarely a needed surgery and is usually cosmetic so if there is no medical necessity, it wont be covered.

      Viagra, is gender affirming for men, but that's covered by insurance. Same for HRT for cis men, like what Joe Rogan does. You wouldn't understand what it means to be trans with a cis perspective, to us, it's reconstructive and one-way, and we're aware of that. We don't care about the detransitioners that felt they got fast tracked because that doesn't exist, me and countless other trans friends of mine had to jump through SO MANY hoops just to get HRT. I had to be two years out as a trans woman before they gave me HRT in a blue state (Colorado), and the bullying.... ARGH! You know nothing and only seek information to reinforce your perspective, cissy.
