TRUSTS
HISTORY:
Trust or Collective Social Entrepreneurship is practiced in India from the times of Rig Veda, oldest Ancient Scriptures of Hinduism. Charity was conceived as a duty and responsibility of a conscious human being. Mauryas and Guptas also practiced collective entrepreneurship was in existence across the country.
Charity organizations are called in different names such as NGO, Voluntary Organizations, Non Profit Organizations, Community Based Organizations etc. REGISTRATION IN INDIA
LEGISLATIONS:
The first law on Trusts came into force in India in 1882 known as the Indian Trusts Act, 1882; it was basically for management of Private Trusts. The amended Civil Procedure Code, 1908 also took cognizance of the emerging charity scenario through Sections 92 and 93. Trusts are formed under Societies Act 1860 too. Many states have their own state legislations to register a trust.
MEANING: PRIVATE VS PUBLIC TRUSTS
Trust is a special form of organization which emerges out of a will. The will maker exclusively transfers the ownership of a property to be used for a particular purpose. If the purpose is to benefit particular individuals, it becomes a Private Trust and if it concerns some purpose of the common public or the community at large, it is called a Public Trust.
RELIGIOUS ENDOWMENTS
Religious Endowments and Waqfs are variants of Trusts which are formed for specific religious purposes e.g. for providing support functions relating to the deity, charity and religion amongst Hindus and Muslims respectively. Unlike Public Trusts, they may not necessarily originate from formal registration, nor do they specifically emphasise on a triangular relationship among the donor, Trustee and the beneficiary
Income Tax -12A and 80G
NGOs do not have to pay tax for the entire life time if it gets registered under Section 12A
80G registration gives tax benefits of 50% to the donors.
Corporates and ministries prefer to give donations to those NGOs having 12A & 80G registration.
FCRA (Foreign Contribution Act 2010)
Registration is to Control and Regulate Foreign Contributions to any trusts.
FC3 forms for registration.
As per amended Rule 6 of FCRR 2011, any person receiving Foreign Contribution (FC) more than Rs. 10 Lakh in a financial year from relatives [as defined in section 2(1)(r) of the Foreign Contribution (Regulation) Act, 2010] has to intimate to Central Government within three months of receipt of FC.
