I cannot fathom how everyone is not just halting activities with them until this is sorted. Contracts are contracts they cannot be easily broken that way. You need to do it legally.

schedules have been in place for months if they cancel so last minute ADOR and indirectly NJ will have to pay a pretty penny for cancelling any of the gigs. They didn't break the contracts with the brands, shows etc working with them they're made through ADOR and ADOR would have to pay in case the girls didn't follow through with their plans. Them crying for contract termination is nothing next to the amount of debt they would put themselves in if they were to halt any of these activities. If ADOR didn't get nasty yet, they would if they were sued and lost huge amounts of money because of NJ's incompetence. Them losing stocks etc is nothing compared to huge brands suing them 😅

I find new jeans to be very foolish and their behaviour extremely disrespectful but above all in violation of their contract. The sheer audacity of going ahead as if they actually legally terminated their contract is perplexing. I hope they are held to account and made responsible for their actions because this sort of behaviour is not acceptable. They need to be blacklisted now. Unbelievable. On a happier note, Hybe artists are doing well in the charts as usual and the company is thriving! 😉💪

I think the National Assembly made a very dumb move by asking Hanni to come in and then trying to attack the CEO and get an admission that artists are more like employees, not independent workers. This too would set a precedent in SK. There was a boatload of far more important cases on their docket.
The reporter who published the article claiming 1 million sales was irresponsible in his failure to confirm facts. Of course the article needed correction. It was not true. IF he was mislead or lied to he should reveal who lied to him.
I think setting up the precedent that contracts could be that easy to terminate would be absolutely the wrong thing to do.

YG is really good at mediaplay and giving the illusion that it's groups are the most popular compared to others, not saying they aren't popular just that they use media to make their groups appear more successful or more popular then others. Imo Twice is more popular gg in the US or at least the better selling gg compared to BP, they had a way more successful US Stadium Tour. As far as I know they legitimately sold out a stadium in SoFi while BP company gave out some free tickets to give the appearance they sold a stadium out. Fairlane explained in a prior video this is why YG lost money on the BP tour. They were looking for that "BP sells out stadium" headline but lost money paying to do that. This is nothing against the girls but their company and how they operate that is deceptive. But YG's media play has worked in the US because most gp know BP's name because they've seen them everywhere in the media despite how big Twice actually still is here. Now we've got lots of 4th gen gg gaining ground but gp still seem to think BP is the biggest kpop gg in the world. I think real sales and real people in concert seats is a more accurate measure then how many articles are written about you. This is a problem in the western industry as well but imo it gives the artists a false sense of the reality, I guess some artists don't mind but others get a rude awakening when they look out into an almost half empty concert venue. Plus most artists really make their money from tours and not their actual music (most US labels make the bulk of the money or streaming services etc off the music not the artists themselves).

I think NJ would have a case against the KMCA for blacklisting them if they had actually terminated their contract and weren't still signed under Ador. I think based on the laws KMCA has a justifiable cause to block them. However had they terminated the contract properly they still could face a non-compete clause, similar to the LOONA girls, meaning they won't be able to do anything as 5 members because it would pose direct competition to Ador's copyright to NJ.

It was amazing to see Old Shorts fans reacting to the Vogue cover as if the shoot had taken place recently. Most fashion shoots take months to reach the magazine. The time period is usually around six months from the time the photography is done. The fact that Old Shorts were presented as a group of attractive Asian women and not as a singing group went over their heads. I don't know how people could think that a world wide organization like the one behind all the editions of Vogue wouldn't be aware of what was going on and would go against Ador/Hybe since they have staff photographers, editors, etc of their own who if Old Shorts were to win, could simply up and quit for any reason. The fact that Ador did publish the pics shows that there was, in my opinion, a schedule and that Old Shorts and their mother jumped the gun to try and make it look as if they had won when nothing is farther from the truth. That is speculation on my part of course.
Thank you for laying out the situation with TVXQ/JYJ and how it has taken 15-16 years for the ones who left to be able to perform publicly again.

Blacklisting is fine to do to "formerly known as NJ". That just means they will not be considered for awards in South Korea, be invited to shows, or be counted in the charts. They will still be making money off of the music sold under the NJ name until they are officially out of the contract. If they are obsessed with being publicly " recognized and acknowledged" which means more branding opportunities, then that will hurt them the most.

If I was the legal representation of NJ, I would file a police complaint against the KMCA for illegally promoting a boycott and also file a civil suit against the KMCA if Korea has relevant business interference laws. Please understand, you need to separate MHJ vs Hybe and NJ vs Ador. They are two separate cases. For some reason, people are having a hard time understand that what NJ did is perfectly legal. It happens all the time with contracts. Everyone should realize this since Hybe did the very same thing with MHJ in the beginning of this whole situation. Remember: Hybe unilaterally removed MHJ as Ador CEO claiming she was in violation of contract conditions. Hybe did not take MHJ to court to terminate the contract; they simply stated she was in breach of the contract so the contract was no longer in effect. MHJ then sued Hybe to get herself reinstated as CEO and won that suit. [Note: Hybe later sued to remove MHJ CEO providing some additional evidence that the Korean court found acceptable.] NJ has the same rights as Hybe or Ador to use a contract exit clause to unilaterally terminate their contract. It is then the responsibility of the other party (Ador) to sue NJ for contract breach or to request the court state the contract is still valid and in effect. Remember: KPop companies constantly unilaterally do this whenever they kick an artist out of their company. They don't sue to get the artist removed; they simply claim the artist breached a contract condition. What is unusual with NJ vs Ador is that this is the first time that the artist initiated a contract exit clause and not the company. And Kpop companies have no one to blame but themselves. When Hanni claimed employee abuse, the government was petitioned to not recognize idols as company employees. The government agreed and declared that idols are not employees but independent contractors under the Labor Standards Act. As such, idols are "equal" to the companies and can exit a contract per defined exit clauses. Until a court says that the Ador/NJ contract is still in effect or the NJ members must suspend activities until the contract dispute is concluded, NJ members can legally do sponsorships, performances, etc. Consider this: if NJ members had to suspend their activities until the court determines the contract validity why shouldn't Ador be made to suspend all their activities. You always need to look at contract enforcement as applying to all parties involved. Additionally, the impact on the KPop industry shouldn't matter. This is a legal case about a contract and will be determined based on the terms, conditions, and clauses of the Ador/NJ contract.

Hybe was able to Fire Min because she was an employee of the Company. She was caught and was fired from her position of CEO given by the company. Isn't it legal and wise to fire an employee when they are caught red handed??? At the end of the day Hybe is a corporation.
If aritsts can easily walk out of a contract citing breach of trust without any proof at any time then what happens to the Investors' money?? Who is gonna invest in the so called artist if they can walk out of contract at any time on their wish? KMCA stepped up because if this can happen to a big corporation like hybe then small companies stand no chance. NJs involved media so its fair to say that everyone can weigh in their two cents in all this mess.
If contract can be terminated verbally then Why is KG of VCHA filing for a lawsuit for contract termination??? Why didn't she hold a press conference and use the word unilaterally ???
Kuddos to the NJs for standing firm for what they believe but its hard to forget the fact that Hanni went and spoke in NA when the families of 21 dead workers couldn't.

The judge at the first injunction court said: Although Min Hee Jin proved for attacking Hybe, but Hybe is not Ador. In the contract, Hybe can fire Min Hee Jin if she cause damaging Ador. So Hybe took judge premise that Hybe is not Ador. Later on, Hybe canceled the shareholder agreement through the court. Min Hee Jin lost in the second injuction court. But the main court still waiting.

We won't know the outcome until it goes to court. (Note: this is the second time Hybe removed her as CEO. The first time, the court reinstated her.)
KG has unilaterally terminated her contract, but it has not been stated if she's ending her contract per an exit clause . She claims JYP America has broken California employment law and has "abused" VCHA members and herself. She is suing JYP America for monetary compensation for pain and suffering due to the abuse and to void any termination penalties.
NJ members say they have terminated their contract via contract exit clauses. Contract exit clauses are how companies terminate an idol's contract for activities like public dating or smoking.
Contracts can have exit clauses that state when each party can terminate the contract without penalty. They also should state penalties for breach of contract. In all cases, the aggrieved party can choose to bring the matter to a court for final determination.

      @my_voice_in_the_wilderness 4 ชั่วโมงที่ผ่านมา

@@bimotok757 You obviously don't understand contract law. Unilateral termination of a contract happens ALL THE TIME. The other party can then choose to take the matter to mediation, arbitration or litigation for contract enforcement. The contract has meaning because the parties use the contract terms for execution, exit, and enforcement.
For example, health insurance contracts. In the US, 17% of the time an insurer refuses to pay for a medical procedure because they unilaterally state the contract doesn't cover it. A person than has to sue the insurance company for the compensation.

I think KMCA is just a management trade group, right? Of course they’re going to support companies over artists. Not reporting sales seems like a pretty toothless blacklist. I can understand taking action against a group who is under contract, but ex50 is not under contract to the old company. I found it odd they threw shade at ex50 members in the NJ statement.

The boycott is not about whether an artist is still under their contract or not but about artists who had tried to escape their contract due to being lured by other agencies or external bodies. Which was what ex50 tried to do due to the manipulation of their then producer.
They are also currently being sued by their company for damages.
