- New Law on Cheque Bounce पर Supreme Court की Landmark Judgement | Legal Gurukul
In this latest landmark supreme court judgement on cheque bounce case i.e. 138 negotiable instrument act case, the supreme court held that when it has been decided by civil court that cheque has been given as security cheque then criminal court cannot convict the accused in cheque bounce or cheque dishonour case (138 ni act). The supreme court set aside the conviction of the accused in the present cheque bounce case.

It's not a learned judge's decision, not expected this type of stupid decision from Hon'nle Supreme Court of India. It shows so many stupid decisions passed by unqualified persons placed in highly responsible posts. It's a shame on their part
शिमला मे एक ब्यापारी है कपड़े का ब्यापार करता है साथ मे ब्याज पर पैसा देता है जमानत के तौर पर खाली चेक sign करके ले लेता है पैसा वापिस लेने के बाद कपड़े के फ़्रॉड बिल बनाकर चेक बाउंस करवा देता है और इसने शिमला डिस्ट्रिक्ट कोर्ट मे 100लोगों के खिलाफ झूठे मुक्कुदमे चला रखे हैँ इसमें आप हमारी मदद कर सकते हैं तो बताये

जब चेक बाउंस होता है तो 3rd बाउंस पे मैनेजर खुद चेक के ओनर को फोन कर के इसकी जानकारी देते हैं फिर भी ऑनर कुछ रिप्लाई नही करता ना ही खाते में पैसा जमा करता है। फिर मुकदमा हो जाने पे चेक ऑनर कहता है मिस यूज हुआ है। इस पे आप क्या कहेंगे श्री मान जी

Not good decision. Once cheque bounced, it should be dealt with it accordingly irr
If promissory note presented missed from court, ank(no.)is given, then evidence can be condone???

Sir can I ask a question about cheque bounce . Matter is I owed 35000 from one known person and I gave him a blank cheque for it before 4 years . Je is charging 20 percent interest per month .Till I paid him 90000 approx in cash and by bank .Now he is showing an amount of 275000 . During the corona I was unable to pay him so now he is threatening me of cheque bounce .
He made 45000 and calculating 20 percent interest per month .
Is it reasonable . I gave him cheque as security but I couldn't write upon it as security.
Now tell me what step should I take ?

aap use legal notice de 30 days ke andar fir 15 days wait kre agar fir bhi payment na kare to case file kare district court mai Negotiable instrument act sec 138 ke andar
