  • In Wilmington, Delaware, any car with more than $200 in outstanding fines can be towed by private towing companies. Vehicle owners have no way to contest the tickets or seizure without first paying the city everything it demands in parking tickets, fines, fees, and penalties. If they can’t afford to pay in 30 days, the companies get to scrap their cars and keep their full value, returning nothing to the property owners and not even crediting part of the value of the car to the underlying fines. In exchange, the city gets a free impound program; property owners lose everything. In today’s episode, we will talk about all the ways that this system violates constitutional rights-and what two residents are doing to fight it.

      Tow company is a business trying to work within the confines of govt
      Many times I did a tow where I lost money on towing a vehicle. Call the vehicle a homestead. And change the laws regarding seizure of another person's property by govt. Tow operator is contracted tool for govt.

      These yards are not Simply trying to survive.
      All you need is to know someone that has somewhat of an official position and then contracts are awarded.
      I guarantee these impound yards are somehow connected to the officials that made those rules.

    As a tow truck owner / operator, I was stuck with removal of many abandoned vehicles where tow & storage fees were greater than the scrap value of the vehicle or the cost of lien sale.
    However, state of Washington judges calls a vehicle a home and forced city to compensate vehicle owner for the illegal taking of his truck/homestead. Their use of word homestead.

    This happened to me in Midlothian Illinois. Towed my vehicle worth 3000 dollars received 0 off tickets owed. And when I called police Department and asked if they would release my personal property they said I have to contact the towing company and told me I must pay 175 dollars and give them my title. I had no choice but to comply, seeing how it was all my tools I use to make a living. And worth to me more than just the monetary value.. How is it the towing company can charge me for a release. When it was the police department that had it towed??????

    This happened to me in Los Angeles years ago and as a young man I found out the power of towing companies.
    It was literally the first car I ever bought as a young man. It was parked legally bit someone complained they didn't like me parking it there and it got towed. I did not have the 600 dollars to get it out so I had to turn it over to the tow truck company. This was over 20 years ago and it was 600.00 plus dollars. The company was wolf towing.

    This whole taking without due process stinks in the same fashion as civil asset forfeiture. It'd be nice if any ground gained here could be used against that abomination. Otherwise we'll see such things of "Oh, we aren't accusing you of the parking violation, we are accusing your car!"

      @@frederickfarias9515 no one is guaranteed property, nor is property necessary to be alive and free. it is among your inalienable rights to ~pursue~ property, not to ~have~ property. one MUST have life and liberty a priori to pursuing happiness, including the pursuit of property.
      indeed, locke famously said "life, liberty, and property". but jefferson changed it to "the pursuit of happiness" in our constitution, by which he meant the pursuit of property (including the ~200 humans he held as captive property).

    I could not agree more. I had my car towed and I paid about $300.00 a day in 'storage fees''! The cat was in an empty field (not even fenced) in a rural area of upstate NY.... 🤬
    All of these arguments are very compelling for getting rid of this system, it seems that it takes just enough money not to create a public outrage. Which is unfortunate.

    This happened to my ex after an actual thief stole her car and took it for a joy ride.
    The police had it towed to an impound lot when they recovered it and the impound lot charged over half the value of the car to return it.
    The extortion by the tow company acting on behalf of the police was as bad as the original thief that stole the car.

    About 15 years ago in Des Moines, Iowa my step-son had his car parked in our own driveway. It was obviously legally parked. It had some mechanical issues which we were addressing so he wasn't able to drive it at the time. During this time his tags came due and he paid the fee and got the stickers for his plate but didn't get it applied right away which was no big deal because he couldn't drive it till it was repaired. Wrong. The city towed the car because the sticker was not applied IN THE DRIVEWAY! We were then informed that there was a $550 dollar fee involved to get the car back. That fee along with the cost of repairs would have been more than the car was worth to be honest so I told the city to just keep the damn thing. I was then told that there was a $550 dollar disposal fee. A legally registered car was stolen from our own driveway and held hostage for a $550 dollar fee whether we got it back or not and all because a sticker which had been paid for was not applied to the plate. I'm STILL pissed about that.

    Even when they are given a certain amount of due process in cases like this, they still are often screwed by the system. For instance say they got a certain amount of due process, and then the court ordered that the car be auctioned to pay for the ticket and the towing and impound, a person could still wind up with substantial losses. For instance, tickets and towing fees of $1,000 so they sell your $10,000 car at auction for $1,100, clear the debt, and send you a check for a hundred bucks. That person is still going to feel like they got $9,000 stolen from them, which in effect they did.

    One I would check into who owns the tow company's the mayor son the judges daughter the commissioner wife etc. Sue the tow company for towing your car without a signed warrant from a Judge that should be worth 7 times the value of the car and pain and suffering caused by illegally losing your car. Now granted the case would have to be appealed all the way to the United States supreme Court. That would be a perfect case for Institute for justice.

    Welcome to Oklahoma. This is common occurance here. Tow truck drivers are even allowed to drive more than 20 mph over the speed limit with no worries cause they know the cops wont pull em over.
    I have had to pay every lot for my vehicle getting impounded after paying my fines to the city. I have always kept a stash to be able to pay these bribes is the only reason my vehicle wasnt kept.

    We as citizens have been living with the thought of our government making policies based on our constitution. But in realty. They allow policies and laws to happen even when they violate our constitutional rights, for someone to file a lawsuit to challenge it. Of course, majority of citizens could never afford to file a lawsuit. Essentially they are getting away with violating our constitutional rights until someone has the ability to sue them to get our rights enforced. Rather than our constitutional rights being the factor in whether a policy or law is made in the first place.

    Omg this happened to my car when I lived in Wilmington in 2009! A 1989 grand marquis with 70k miles on it very nice car . Didnt have 340 $ Hope it didn't just get scrapped . It was a nice ride .

    First off i live in new castle just minutes from wilmington and work in wilmington. If you get parking tickets in wilmington they have a buddy system with the DMV to where they wont renee your inspection sticker or renew your drivers license if you owe tickets in wimington unless they are satisfied. They levy all kind of fees and it doesnt matter how much if you dont pay them first you dont go home with your vehicle being legal renderring you to be flagged when the police sit at red lights and run tags through there laptop website. They have also built a little office in the DMV where a representative from wilmington parking is there to take payments for this. They then give you a release to jump back in line to take care of your dmv buisness. Its a racket

    People are so accustomed to tyranny they don't even see it as tyranny. Stealing property is heinous especially when it's the very people who are supposed to protect your property. I had a truck towed by the city over parking tickets once. Since it was a semi truck it ended up costing me $1500 to get it back simply because the towing company was charging a fortune above what the city wanted. At the time I never considered it a violation of my rights other than being treated like a criminal for what I do for a living. I didn't think the impound was a violation in and of itself.

My sheriff is accessible and seems to be pretty good. Something to research and is always in Flux.     Village police towed my vehicle for past parking tickets, yet sold me village vehicle sticker months earlier. Why was I not told then I owed said past tickets???? I also wonder how when you are issued a parking ticket and receive a hearing date the fine doubles if not payed by said date. So unless you beat it you owe twice the original fine amount. How can they get away with this?? Is this not considered an Excessive fine?? How does one fight for their rights when governing agencies control their own hearings???

    By the time it happened to me [while out of state] the tow truck driver came to me and helped me into the train station. No CHARGE. They were relaxed, comfortable. Just doing business. Ouch

    My brother lost a 2016 accord cause impound cost him $85 a day after 30 days the place kept it said they scrapped it but oh no they sold the car within two weeks. This was in arkansas! He had just paid off loan on the car too!

      Can you explain courtesy towed then? Having your car randomly towed from a legal spot, zero tickets, to another street. Police have no idea and take the stolen car report. 2 weeks later I get a bill in the mail for 3 grand for tow fees and storage for my abandoned car. This is in central Florida.

      @@urzzen7828 courtesy towing is usually in case of emergency (road work, fire, construction, parade etc. the vehicle is relocated to a nearby safe area at no cost to the owner. There should be a record of where it was relocated to. Not sure about all areas.

    What law says the holding lot can’t charge storage and holding fees? He says it’s against the law to charge a fee, what law? I agree the high fees ridiculous, but do you think these lots work out of the goodness of their heart and not profit? Of course they are legally allowed to charge fees, but what is the law to the max fee allowed? Why blame the lot for making money, blame the lawmakers who allow this to happen. I disagree with calling it ransom and stealing cars, the woman makes it sound like the cars being towed did nothing wrong, they broke the law, there are consequences for parking illegally, but the fees seem out of the world.

    Correction, in the cities ignorant opinion they think she owes them that 320 dollars. They most likely won't take her to court because that would cost more in legal fees and paperwork filing costs. They may send it to collections or if she is able to buy another car they will either keep her from registering it or take it illegally start the whole shit show over again.

    At the end of the day, isn't this first and foremost just an excessive fines and fees case? It sounds like the city deliberately used a third party private entity to do its bidding so that the city could argue plausible deniability (i.e. We didn't violate anybody's rights, your honor. The towing company is solely responsible for how they structure their business, including the fees for their services.). I can just picture some smug asshat in a cheap department store suit turning that argument into a pissing contest in hopes of winning favors among their employers and colleagues.
    Edit: I didn't just fall off of the turnip truck. And I don't believe for even a millisecond that cities would continue this handshake deal with private companies unless at least some portion of the financial gain was being funneled back into city coffers.
    Edit 2: If individuals can't find a way to fight this head on in criminal courts, could they use civil courts to file a lien? I'm not sure if that would even matter though considering that states have been accused of issuing clean titles for vehicles that had bank liens against them.

    isnt the point though that this is already clear in law? just because police etc aren't obeying the law doesnt mean its not clear in law. the problem seems to be more that govt and even courts dont care that these practices are completely illegal. like with qualified immunity needing to be clearly established in court cse not law. when did the court get the position as the only creator of law? the simple fix for alot of this s to obey the law and for govt to criminally prosecute the govt actors who violate the law. this is literally a conspiracy car theft ring. if the tow company owner and clerk who create the agreement went to jail for 2400 thefts last month alone, no tow company would take the job next month.
    the govt wont do this because they like the money. can the institute start private prosecutions to rectify the crimes being done by govts across the country?

    All the governments of the Republic appear to be incorporated as 'individual businesses'. What Constitutional requirements does this incur? Is 'Voluntary' taxation a requirement, or is it exempted by some process, or is it just ignored by those 'Individuals'?
    How about the government's incorporated unions, are those unions also exempted from the 'Voluntary' Big Lie of the 'Voluntary' Individual Taxation, also?
    How about, the declaration that 'Wages' are taxable income that is actually mandatory, and not a system of 'voluntary compliance'?
    How about the fact that this enslaves your responses to such questions to extort your cooperation in order to deny your free speech, as an incorporated 'individual'?
    Will these questions endanger my personal freedom, as an unincorporated individual and not unionized, by the IRS and other minions of this socialist regime of the fascist style cult, yearning for its perfection into communism?
    Maybe the People don't want to know, but I do :)

    I’m not taking sides here, but ..... they are not saying how much time elapsed between when the car was towed & when the guy paid the ticket. For instance, if it took him 3 or 4 months, the impound company charges per diem storage fees since the car is taking up space on their lot. Perhaps that is why they wanted an additional $900.

      @Larry Diffey - Of course they had a legal right. The tow company was contracted by the city of Wilmington. The city of Wilmington doesn’t have tow trucks which is why they outsource their towing to private companies. Why wouldn’t the tow company have a legal right to tow it if the city is permitting them to tow?

      @Larry Diffey - So, if the city bought tow trucks and if they then towed his car (instead of contracting a private company), would it then be legal?? Here in Chicago, they city tows, and they charge $315 for the tow and $10 / day for up to 90 days. If you don’t pick up your car within 90 days, they auction it off to pay for the tow + storage fees. What’s the difference? Is Chicago also violating the Constitution? If they are, someone should tell them.

    your car doesn't belong to you. the government ALLOWS you use it, unless and until it decides to take it, or just take your permission to drive it. same with your other 'belongings'. your money. your house. your kids. your body. your liberty.
    sounds harsh, ridiculous at first glance, but for something to actually belong to you means it's yours, under your control unless ~you~ decide to let it go. if an entity can summarily take a thing, or control of a thing, from you, it does not really belong to you. your whole life is basically rented from the government, contingent on your compliance. such is life in an organized society.

      The first guy parked in front of his house .... He's old and hasn't gone places often due to covid . They took his car . Sooo
