Even late Senator Miriam Santiago saw this loophole since Article 26 is a special provision and filed a Senate Bill during 14th Congress to amend it. This argument became stronger when the Supreme Court in Republic v. Manalo expresslly declared that Article 26 acts as a special provision compared to Nationality Rule of Article 15 of Civil Code in recognizing divorce validly obtained abroad despite absence of divorce law here in the Philippines. For the final resolution, it can be brought by affected parties (married gay couples from abroad) to the Supreme Court for reinterpretation. I can say this is a gray area that would allow foreign gay marriage unless the Article 26 itself is subsequently amended by the Congress. But unlike divorce which is usually against the "inviolable social institution" written in the 1987 Constitution, same-sex marriage actually creates a union or recognizes the previously created one from other jurisdiction. Take note, the same constitution does not prohibit same-sex marriage. My comment only deals with interstate recognition of same-sex marriage, not the full legalization since the general provision of family code is still clear.

Aside from the legal aspect, homosexual behavior has been observed in animal kingdom (1500 species) and human history (cross-dressing homosexual babaylans). No because the Family Code recognizes marriage only BTW a man and a woman. no legal compelling reason to recognize same sex marriage.
