Very good question. You're absolutely correct when you say that Justice Hans Raj Khanna ji was denied Chief Justiceship when he went against the Parliament. Reason was until 1993, (i.e., Second Judges Case) the standard practice was that the senior-most Judge would become the next CJI provided that the Executive is in agreement with the advice of the incumbent CJI This convention was violated only twice & Government appointed a junior judge to the position of CJI. But still judiciary is independent insofar as procedure established by is followed. Since the Constitution is a living document, it has the element of self-correction & after the Third Judges Case (1998) Judiciary is independent to the extent of appointment
