Not too cool with the Prosecutor trying to run this Ex Parta and violate his bond without opposing council. Excellent move here by the judge to deny her motion and set for a hearing. Judges knows this could easily win appeal if the defense is not present. I really like Judge Middleton, Michigan has some great and fair judges. Despite what he has admitted to and being charged with, the prosecution is trying to play a shady game and the Judge shut that right down.
I wouldn’t call receiving blood test results back where one dramatically increased his potential charges and the other violated his bond “shady”. I’ve heard of people being denied bond for a small fraction of these allegations (some of which were proven by the test results).
@@K7ZHKEx Parta are never really a good thing. She even said she didn't contact his attorney. Again everyone is innocent until proven guilty. She should have made sure the defense attorney was present. She tried to ram it in before the holiday, that's shady in my book.
@@MikeE07 I didn’t catch that she specifically requested it, although it sounded like the defense attorney’s involvement hadn’t even been docketed yet. I always find it hard to find any sympathy for someone who goes out and violates bond conditions within days of being released. If he is that addicted to drugs he should at least be put into in-patient rehab, though I know that’s not always an option to the court.

Judge Middleton handled this perfectly. I totally agree, sounds like this cat cannot get their act together and shouldn't be on the street. The judge must follow due process. He even said this was pretty uncalled for like this and if there was anything he could hang his hat on and she really didn't have much. She had a hearsay conversation between the defendant and the people testing for drugs. We had two dirty tests but with no one there to dispute or defend the findings, he couldn't let the prosecutor just run the table like that.

Yes, don't allow him to have due process and lock him up for an alleged crime.
They all tried to throw Debbie under the bus including Middleton. Glad she took them on and won.
Making a prosecutor work to show good cause for bypassing portions of due process is not throwing anyone under the bus.
