The 'icing on the cake' you mentioned moreover pertains to the matters in issue in the subsequent suit which must be directly & substantially in issue in the previous suit. In this case, the plaintiff had appointed a pharmacist who indulged in misappropriation of drugs. Afterwards, he filed suit for compensation from the pharmacist who subsequently challanged the plaintiff's action in Labour Court regarding employment. Issues were clearly not identical.
