In fact, anyone would be upset if 5 years later getting dragged into court for frivolous matters. Her attorney is the one that said there has been domestic abuse in the past without stating who was accused of such. It very well could have been her and with this attempt to manipulate the courts, I would lean to think that it was her. Good luck DAD!

As someone who was alienated from my Dad for a time, this makes me sick. My Dad did everything for his kids, Mom realized later she was very wrong. Very healing.       Respectfully, that isn't what any of this has been about. There was no evidence offered to that effect, one way or the other.
      This is the ex-wife petitioning the court for a protection order to keep him physically away from her. That has to be based on evidence, and she went to court with no evidence whatsoever. Yes, her testimony IS evidence (and fairly strong at that), but that was negated by his testimony.
      The only issues of any relevance are:
      • Has he visited her house?
      By her testimony, no, not in 5 years.
      • Did he kick her car?
      She says "Yes" (but she didn't witness it, another party who wasn't present did, so that's hearsay, not admissible.) He maintains he did not, but because she has no grounds to make that claim anyway, it's rendered moot. In the eyes of the court it simply never happened absent evidence or first-party testimony, so that who claim is not being entertained.
      • Did he block her car in?
      The court could find either way on that one. He was not standing in front of, or behind the vehicle, but as she needed to back out onto a busy street, the position he was standing in may have occluded her view of traffic, preventing her from being safely able to back out. His video may clarify that. However, if he was not intending to block her in, and she had said "please move, I can't see the road" he likely would have moved. If she didn't say that, he would not have reasonably known. That wasn't really logically resolved, but that alone, even viewed favorably from her perspective is not grounds for a protective order, absent more extreme or deliberate actions on his part.
      • Does the video make her feel "unsafe"?
      That's subjective. The court doesn't give a shit how she feels about it. The law doesn't exist to protect feelings. Objectively, a video creates evidence of the encounter, and an incentive for him to behave. She is objectively safer with a video being recorded, regardless of how it makes her feel.
      There's obviously a lot more going on between them than was pertinent to the request for an order of protection. But the bottom line is she didn't make a sufficient case for such an order to be granted.
      There are different kinds of "restraining orders". In the end, they're all just different types of injunctions (an order issued by the court, the violation of which is defiance of the court and carries penalties for that, notwithstanding any other potential penalties from the infraction itself).
      Some restraining orders are simple to get. Usually an HRO (Harassment restraining order) is fairly easy. That can prevent people from knocking on your door, calling you on the phone, showing up at your work (without a legitimate reason for them to be there).
      But she wanted an Order of Protection. That is one of the hardest to secure. It would require him to remain a specific distance away from her at all times, and can include other constraints he has to abide, and it would be enforceable by police where a civil order is not. That's a lot to ask for.
      Since an order like that imposes on his rights and freedoms, the standard of evidence needed for the order to be granted is extremely high. She didn't even come close to meeting that standard. The only way she would have been granted that is if he didn't show up at all, and she lied her ass off to a judge. I'm kind of shocked a lawyer would even represent her, knowing she had nothing at all to go on.
      And yeah, I'm dumbing this down at the expense of accuracy, and I'm not a resident of Michigan, so there can be nuances of which I'm unaware, especially in past court proceedings and police reports between the two. I fully admit I'm talking out of my ass without any specifics on the actual case. But this was so clearly a losing situation.
      They weren't there to argue and assess who's right or wrong, good or bad, honest or a liar. This was simply "Is there sufficient evidence to support this specific action", and there clearly was not. I'm baffled that this even made it before a judge at all.

It happened back then, it happens today. Using the system is BS. I have kids, guess what, never have been to court after we broke up, she was #1, NOT US. And yes, it could have been a crazy court showdown, throwing eachother under the bus, we actually dont have control issues so we moved on and raised a great kid. Shut up, raise the kid, or eff off is my point. Not as complicated as several paragraphs. These videos also reflect the human side, others should learn from it. Kids #1

    I had a friend who's ex wife called children's aid on him, to report he was being an unfit parent. I warned him to record every single interaction in his home with the aid workers. He did, and they basically lied about everything. His case was over turned and they were all fired at the suggestion of the judge. Always protect yourself!

      It’s crazy the extent some people will go to. In my opinion, the truth always comes out in the end… it’s just everything in between that time that is so difficult to get through. I also feel like if half of these women understood what it was like to live a life where the kids have no chance of seeing their dad, they might not make it so difficult for dad to see his kids.

      Children's aid, Canadian I assume. Sadly when a mother reports an actual abusive father to them or neighbours do, even though he doesn't reside in the home, CAS takes the child from the good mom also. They blame her for letting the father visit despite the family court order saying every other Saturday.

      The court did, so it should be followed.
      She is in contempt at this point.

      You are to encourage them to go, not encourage his/her behaviour of not wanting to go.

      If you watch these, the mothers almost never get charged with contempt. It gets drawn out for a year plus on just the contempt charge alone and 90% of what ive seen, the judges dont do anything.

      I myself got a little win a few months ago. Had a show cause, dropped 2k to stop it because fk you.
      Caseworker refused to do his fkn job and stop it.
      Judge laughed at him and threw it out. Dismissed it, and ended the conference before I could ram it right up their ass.
      They pucked me up the day after Christmas last year on a warrant from 2018 that had already been closed out.
      Got me at the laundry mat alone with all my families clothes, the day after fkn Christmas.
      With some god damned license plate readers.
      The police....trolling the laundry mat for warrants the day after Christmas.

Judges recognize that they are in a contentious family situation with people who are not legal experts and routinely (and I’d argue rightly) give some leeway unless behavior is repeated or blatant.

      Totally agree and emotional distress. Using the child as an alleged witness borders on child abuse because you know as well as I do she’d have prepared a script for him. He should also file a motion for denial of parenting time. He has so many options here and they’re all on the record.

      There were and still are many people who are against surveillance cameras in public. We (company) have already been threatened with a lawsuit because we wanted to monitor our own parking lot with video surveillance.
      I am from Germany
      They have even filed a lawsuit against the storage of fingerprints for crimes. Our “data protection law” is probably the strictest in the world

      Many judges will assist pro se defendants because they know it's not always possible to retain an attorney and thus wont have the full understanding of proceedings that several years of law school and interning will provide.

      I don’t know these 2 people but the father here is absolutely right about recording his pick ups and drop offs. Recommend recording your pick ups and dropping off children you have records for each time so this doesn’t happen again. That mother needs to put her feelings into the trash and stop basing everything off her feelings. Crazy people can’t get passed their stupid fears of nothing

      Exactly! When I married my husband one of his kids was still living at home. I worked Really hard to befriend his ex wife. I made sure she knew that I respected her as his mom. I called her to get her input on important things. If she had concerns I took them seriously. She didn't like me at first but she warmed up to me. Now all our kids are grown. Family get-togethers are fun for all of us. Her and I occasionally get coffee and talk about our grandkids.
      Jealousy hurts everyone. That same son that I helped raise married an amazing woman. She already had a baby. He was able to see how his mom and I had treated each other and has a great relationship with his daughters father ❤

      @@poke0003Wrong - the police have the videos and NO charges were ever filed against him for all the alleged heinous acts she states he committed. As the judge pointed out, saying she felt less safe because he was recording is ludicrous. And it probably saved him from bogus charges in a he said she said situation. So the videos did play a part. But it was a righteous move by the judge to say he’d heard enough of the mother’s nonsense without even seeing the videos to rule she got nowhere near proving she needed a PPO.

    Notice she didnt get in trouble for disobeying a court order?
    Her not giving him his son was the reason he knocked on her car window which was a violation of the ppo.
    The judge said he wouldnt be in trouble for it but never ordered that she abide by yhe court order and allow him visitaion and never sanctioned or punished her in anyway for violating the court orderer visitation.

    My husband's ex wife was caught on recording telling their daughter to say she was abused, sexually and physically, so he would lose custody. He would have potentially gone to prison for years, but she didn't get in any trouble at all for lying. Men are mistreated by a sexist court system. The overcorrection to "believe all women" really hurt the movement. The movement was to stop abuse, not crush all men.

      @@snakey319 When I was little, my mom would escalate things, refuse to hand us over, and call the cops at nearly every custody exchange, even when my dad didn't get out of the car. I spent so many evenings in the back of a patrol vehicle, and it certainly had a negative effect on me and my sisters. She had us terrified of our father too, grilling us when we came back, twisting every little thing into a life-or-death matter to alienate us from him. Eg when I was ~4 or 5 my dad forcing me to wash my hair in a bath, and getting water on my face when rinsing it became "he was trying to drown you." Eventually, kids believe the lies if they're repeated enough.

      My grandmother did this to my mother. She did everything she could to try to make her and her 3 siblings hate my grandpa.
      Then when I was born, she did everything she could to brainwash me to think Grandpa was a monster. Even told me once that he was a devil worshipper.
      But as a child, all I knew was that Grandpa made the best hot chocolate and taught me about baseball and how to shell peanuts. He used to study quantum physics and once spent 2 hours helping me untangle my necklace collection. He was a good grandfather and father.
      Meanwhile Grandma would drink when she babysat us and would force me to sit and drone on and on for hours about how much she hated all men, and how I shouldn't ever fall in love. I was 9 when she told me that smart girls just use men for their money. A good grandmother wouldn't try to fill a child's head with hate the way she did to 2 generations of girls. My own mother even now struggles with some twisted ideas about life at age 70.

I simply sat them down and explained that their mother was having a difficult time so she was lashing out and to remember that we both love them and sometimes that love is expressed in different ways (like not being able to control their mouths). It's always a delicate situation and I understand that it's more complicated in the US because each state has nonsensical laws and regulations whereas here in the UK, the laws are the same not matter where you live.

      This is Michigan so the rules of recording are a little different than other states.
      Michigan, in general, does not require consent to record if the person recording is a participant in the conversation. Other people may record the conversation with the consent of one of the participants.
      However, many two party states (Florida for instance) allow that recording in public still requires consent of both parties if the conversation is private.
      For example, if you are at a public park and are talking to a person away from others and or in a voice that cannot be heard by the general public, recording still requires two party consent.
      In other words, you can still have private conversations in public spaces that are covered by the eavesdropping / wiretapping statutes in two party consent states.
      Being "in public" does not relieve one's duty to gain consent to record private conversations.
      It is a myth that you can record anything just because you are "in public."

      As an example, a group of people in Florida were trying to collect signatures for a ballot initiative at an open air, public concert.
      A Council member thought that the people were misrepresenting the code on the books and sent his mother (who was from out of state) to talk to the people saying she was interested in signing the petition.
      In order to hear better, the mother and one of the representatives moved to another area that was still in public, but quieter.
      The mother recorded the conversation on the Councilman's phone. A public records request was made and the recording was obtained by the group.
      The group went to the State's Attorney who issued a warrant for the mother's arrest based on the fact that they had moved away from the mass of people to have a private conversation.
      That is true in every state that I am aware of as others have encountered the same thing as well.
      If the state is a two party consent state and the two participants move or take actions to either move out of a group that could hear them, or take steps to move to where their conversation is in a more secluded place, even though they may still be in a public space, their conversation is considered private.

      From all the videos I've seen of Kirkham, I think he's very fair when it comes to issuing and enforcing orders. He gets outright mad when mothers refuse to hand kids over to their fathers at exchanges, and has even tossed a few in jail. That probably played a silent role in today's order. Despite mom's failings, she had a case for a PPO on the testified facts from dad that he in fact was violating the court order to stay at least 20' from mom's car. Kirkham glosses right over it in the ruling, mentioning it, but not issuing further commentary, and it's likely because mom brought their son to the custody exchange with the sole purpose being to taunt dad and refuse to hand him over.

Lawyers can be penalized for making lawsuits that are just there to waste time and money. I dont think this case is quite that bad but it didn't feel much better..

      He was but he should have also brought the point that his ex-wife was denying him visitation that was court ordered. Even still the ppo was denied b/c she presented no evidence to support her accusations and no witnesses to support the claims as well.

    OMG!!! I usually don't watch this mama's boy judge because he has some serious daddy issues in his life and almost ALWAYS sides with the mothers 🙄 It was sweet to watch him make this judgement 😂😂😂 You can tell he didn't want to rule for the dad, buuuuuuuuuut...mom is cray-cray....and the father proved it!!!       There’s a judge like that in Charlotte,NC except he always sides with DSS. He had a terrible mom and no dad and was put in the system because of it and he’s never sided with the parents even when they do everything ordered and have claims were unfounded by case workers. Judges like this need to go to therapy

    Dad needs to get an attorney. I have destroyed many, many, many, women, on the stand who use what they believe to be catch phrases. This woman would be easy to break. I would get her to commit, and then I would introduce the video to impeach her credibility (if the judge was hesitant to admit the video, I would quote the appropriate on-point rulings that permitted it). I would then move that the court hold her in contempt for perjury (it would probably be denied, but it puts it in the judges mind). I would then request attorney's fees because she brought an action based on lies, and false filings signed under the penalty of perjury. (In our county proven false filings will get you charged attorney's fees EVERY TIME). If I have a client that has a contentious ex, I advise them to have cameras installed in their vehicle, which show a 360 degree field, and to have an extension microphone (they have them that looks like a pen) and record every interaction. I have had women that, in an attempt to get custody and have no visitation for dad, claim that dad beat them up on a child exchange. The worst, actually exchanged the kids with dad, (with no drama) and then 30 minutes later, she drags herself into the police station beat to a pulp and tells the police that her ex beat her up when she told him to not feed them junk food on their weekday visitation. Dad had the video that showed that she lied on her police report. As usual, when a woman pulls a stunt like this, she was not charged. BUT ! ! We used it for evidence to get dad full custody, and mom supervised visits until she was cleared by a mental health professional (which took three years)

      @@pdrey100 If he were represented, the video would have been part of the record. The judge took advantage of his lack of knowledge in procedures to gloss over the issue. An attorney would have laid the foundation for the evidence, and then had the judge refused to admit the evidence, a motion to reconsider, or an appeal would be easy because the judge cannot articulate why the evidence was not pertinent, because he did not admit it to be viewed.

      @@tanjajohnson4659 While possibly true, I think it's more implied that the judge literally did not need to see the video because it's apparent what he was going to see on it was going to favor the dad and what he was saying. There's a reason the mom's attorney didn't want to show anything from the videos and instead tried to get them seen as something fearful, the judge isn't stupid. Unfortunately if the video was only available via his phone, it's not going to show very well through a webcam, so that's not going to help him, and since there was nobody there to assist him in getting the video onto his computer to screen share it, it would have taken needlessly long to try and guide him into being able to do it if he even was able to (we don't know if he has a connection cable between the pc and his phone or the ability to bring it over via wifi). Thus rather than wasting the court's time, he just says he doesn't need it, he's already siding with the guy and can see she's talking out her ass.

    This evil Mother is going to continue to run interference in these exchanges. The judge should hold her in contempt for showing up for exchange but not doing it. This behavior is saying to the Dad, "na, na, na, na, na, I showed up but you can't have him", then sticks out her tongue. Father needs to file contempt charges on her. She is bent on him having "hell to pay" at the childs expense. The hate she is teaching the child for the Father, hopefully, eventually, will bite her in the... and the child will turn on her.

      Instead I saw a video earlier today where this judge suspended dad's parenting time until they could have the hearing in front of the referee. Multiple people are saying the son is afraid of dad and doesn't want to go with him. I have a strong suspicion that mom is alienating the son from dad. So sad for the kid and dad 😔

      If you know the law and know how to conduct yourself in a courtroom as in properly asking questions and objecting with just reasoning as to why you will be fine. Most pro se just don’t know how to conduct themselves in a court room. This is where judges get annoyed.

    She should be in trouble for not abiding by the court ordered custody agreement by refusing him to take guardianship of or even speak to his son.
    I question much more with this crazy, angry bitter woman, especially in regards to parental alienation but that is just likely based on what’s seen here but there is no real evidence.
    Her stating their son was fearful and didn’t want to speak to the dad and also the claim that the son witnessed the dad kick the car. That was hearsay, but obviously makes it questionable what she’s telling the child. How would the child witness the dad kicking the car but she didn’t? And the man has video of the date and incident in question. I am very sure this woman is poisoning her child.

    During my time doing custody exchanges I had to bring witnesses with me. Then buy a camera to record the exchanges to ensure the mother of my child did not do crazy shit. Up to and including telling 911 that I was attacking her and her family.
