Can we use a recording of conversation as evidence? No consent. Recording is done to protect oneself. The adversed party is denying about something whic is relevant to the case and only the recording will prove it.

Thank you Atty. Shay your video lecture is so informative. Just a few points. Is the Arbitral Ruling on the West Philippines Sea a mandatory judicial notice to all court sin the Philippines? I ask such question relative to Philippine Court's jurisdiction to try criminal case committed within the waters of West Philippine Sea. In case police officer apprehended Chinese fisherman who violate Philippine law and they file a criminal case in Philippine Court against Chinese fisherman and then Chinese move to dismiss the case on the ground of lack of jurisdiction asserting that West Philippine Sea is part of China. Is that a valid ground for dismissal of his case?

Mandatory judicial notice are enumerated under the Rules, like laws of time. That there are 24 hours in one day. Pag discretionary judicial notice naman, dapat magcomply sa 3 elements. You can watch the lecture on Judicial Notice :)
