You have to meet the requirements and if you don't fall under the category of people who can apply for a greencard, then you're in limbo until they pass a law that allows you to apply. The Parole program allowed him to apply for the greencard and they did apply but now that it was struck down by a judge they're back in limbo again until a new program/law is introduced or he goes back to the country of origin.
