I'm not an IP attorney, but I guess the fact that they tried to replace some of the Easter eggs could weigh in the balance to prove they knew they are copying and stole dbrand/JRE designs.
*UPDATE IF YOU'RE WONDERING* As of 6/25/24. -On 5/1/24, Caseify responded to the lawsuit (denied everything) and provided counterclaims -On 5/22/24, Dbrand responded to the counterclaims (denied what Caseify claimed) -On 5/23/24, Caseify tried to have the case dismissed (motion to dismiss) for failing to make a claim On 5/28/24, the judge responded to the motion to dismiss, basically saying you can't claim they didn't make a claim if you literally made a counterclaim to their claim. On 5/30/24, after their motion to dismiss failed, Caseify filed a motion for summary judgment (basically one of the final attempts to get a case dismissed). On 6/20/24, the judge rejected the motion for summary judgment. In essence, this does not mean that Dbrand is right or wrong, nor does this mean that Caseify did or did not do anything illegal. This DOES mean that the court system believes that the case does have legal basis and that this will now have to go to trial (as requested by Dbrand). Figured I would provide this info, which is publically available, but since not everyone either knows how to access it or understands it, figured I'd help. Thank Memes_fuel_me from reddit, i found it from him.

I doubt this will ever even make it to trial. There's just too much evidence against them. Odds are they'll want to settle or the judge will just call it. When that happens, you should take a scan of the summary judgment and make a phone skin out of it.

I had a clothing logo and designs stolen by an international clothing company which i had trade marked officially at the IPO . Unfortunately the legal costs always put the larger business at a massive advantage. As a small producer, I was unable to afford the legal costs to fight even though I had a high chance of winning. Even then, just trying to be amicable and get an acknowledgement or credit for the design, I was ignored. I’m 100% behind you Jerry, do it for the small guys.

Map makers used to call this a trap street. They would add an imaginary street into their maps and if the map was copied illegally, they would have copied the trap street as well. Similar to the signature easter eggs you included in your designs. Great work!
When Google Maps used to rely on TeleAtlas data, they got hit by this (TeleAtlas, and therefore, Google); several map companies had their data illegally copied by TA and then used by Google. Google always took action when notified, but still...
Map makers and dictionary publishers have all done this in the past. Any time the data set is too big to manually verify it's done to trap those that copy... Long may it continue I say...
This is so interesting to me cuz ive never heard of trap streets but i HAVE heard of something called "Paper Towns" which basically have the exact same function!
I worked with the Dutch government on mapping streets. When suddenly we had a suspicion. So, we added some bikelines and paths that wouldn't disrupt your navigator, but would signal to us, that they used illegal data. And yep, we caught them. So, what was the issue? Public funded data cannot be used for commercial purposes. These companies were selling maps based on public funded data.
Fun fact: this is how map makers figure out who’s just copying their maps vs making their own. They usually add fake towns as their own little easter eggs and if they find those towns on someone else’s map it means they copied theirs. Glad to see you unintentionally had your own “fake towns” to call out casetify. Really hoping this will end up in a big fine/settlement + a crap load of bad PR for them.

This is part of the reason why I love inside jokes and easter eggs in products. It's also a fingerprint. I know in the auto industry there's a growing trend to add them to windshields and official parts so that way owners can also spot aftermarket replacement parts.

old paper map companies used to add phantom streets so they could call out their competitors for stealing their maps, exactly the same way DBrand figured this one out.
If he has copyrighted the design, I have a hard time seeing how they would loose, even if the laywer is a literal donkey, they just have to show the image and ask the company to explain how these details ended up on their products. So unless the judge is like a complete idiot/bribed, they can’t loose. The only real defense I see would be to blame the employees, arguing that they have been tricked by whoever actually designed these. But hopefully Legal eagle will do a video on this soon :D

I'm a medicinal chemist and a review i write each year on annually approved drugs was ripped off by a Chinese firm. They even used my same language cut-and-paste into their review. Peer-review open-access journal, so no $ involved, but my time certainly was hacked, much like yours. Fight the good fight, I hope you win. And please make a video that explains under what conditions a Cybertruck loses its bumper when towing. I really like my Model Y, but the towing issues are turning me off to the CTruck. Cheers!

The best evidence for it being a fearful place, is that homeowners thinks they need guns to protect themselves - That is ONLY an issue in places where the country is at war with itself. It's now an insurance INDUSTRY, with billions and other billions of revenue for stock holders. A state controlled health industry would be a zero sum industry, in which the ONLY thing that is necessary, is to balance the budgets. If $10 goes out, $10 has to go in. Until your country starts thinking more like a group, than a country of individuals, it will only get worse.

I've seen a lot of ads for anime specific "inspired" cases that are just stolen designs from actual artists. Many of them aren't in the position to launch a lawsuit, so they get away with it, basically.
Thanks to this channel I learned to fix my Xbox remote and not be afraid to tackle it on my own when I was like 17 or maybe 19… As time went this channel taught me about scummy practices, self reliance, and making better decisions, about not being afraid to make mistakes and learn from it. Same. Sadly, I think the society doesn't care if the product is stolen or not. There are lots of videos supporting buying fake Samsung/Apple/.... without caring that they just supported stealing 10000 hours of work.
I encourage you to watch some of his tear down videos. I was recommended of the iPhone 15 one recently and was genuinely surprised of the quality in his work and videos. Truly an amazing channel.
It's a sticker, not a case. They copied a sticker. You can take a picture of the inside of your phone, print it on a sticker background and you've stolen his product 😄
@@AquarianNomadic Wrong, JerryRig and Dbrand own the rights to "their exact image" that they created. If you take a pic with your phone it's not the same image. Just an image of the same product. He literally explained and showed how they are exact copies, just of terrible quality.
They did it to me a long time ago, they sadly ended destroying my business as I didn’t have enough money for either a lawyer or anything else …. So back then it costed me a business I worked hard for and I’m very happy that you’re doing something about it now…. It hurt me a lot back then, so please bring the pain back to them! 🙏🏼💪🏼
If you have any evidence left consider taking this to court. This case will be enough to establish a pattern of behavior on "their" products. It could be much easier to succeed with a lawsuit now that they are proven to have copied other brands now.
I think it would help the lawsuit that Jerry started if you joined forces by combining the evidence you have, as the previous comments said it would help to create a kind of pattern.
As a Graphic Designer, I do not sell my copyright. Like map makers, and street directories, I put phantom entities in my works. Never broadcast an image above 80 dots per inch, always scale it down to the pixels on a monitor.
@@mm-hl7gh This is a very old idea. Even Leonardo da Vinci was known to do this in his design drawings of certain machines or as details in certain paintings. Some believe that certain design drawings of his machines had certain deliberate errors in the drawings, so if the machine was ever built exactly like the drawing, it couldn't work. He had a design of a military tank with such errors (believed to be deliberate) and a design of a massive military crossbow with similar errors (believed to be deliberate). One of his paintings has a nearly hidden face of himself as a young man. I believe it was 500 years before anyone noticed this. Another painting had near-hidden musical notes that made a nice melody when played.

@@OneSlowCbrthey have been sued multiple times for copying the shape and texture of the products they skin. A prime example was the PS5 darkplates dbrand sold. Sony sued them for the triangle, square, circle, and X texture embedded in the darkplates.

Never heard of dbrand before but im a customer now, this video is just so right on the spot. Clever way to call them out promote your businesses and politely give the finger to the other company ripping you off. Good for you, I hope I get a chance to see the end result of the lawsuit.
In the end, I would say copyright infringement of my videos broke me. When I was in my prime of making content, I spent 50% of my time fighting people reuploading my content. There are over 100k reuploads of my videos on youtube alone. Tiktok, twitter, facebook, and an endless amount of websites across the world reuloading my content, including National Geographic, Time, CNN, just became too much.

Insane to think that your channel is big, mine is quite small, and there isn't a month I don't have to report copyright infringements from users that do copy my video, crop and cut. And to make things worse, they give it a wrong a title and description leading users to believe their hardware can run the games when they don't really match the GPUs I do benchmark. It's even more stupid to think that most of this stealers don't even make money out of that, they have thousands of views, sometimes/many times more than what I do, but they just have like 10/15 subs, at least on my channel, I could make money to get more GPUs or get more games to benchmark. It's sad!

What you've done with those easter eggs is actually an extremely old form of copyright protection. Map makers used to intentionally do the same thing in their maps to stop rival map makers from copying them and could take them to court and point out those same easter eggs. Kinda cool! It theoretically SHOULD still work in your own defense I think..
Programmers will do the same thing with their code, too. Companies will sometimes ask for a demo of a program and copy it to avoid paying the programmer, so including an Easter egg like that is a great way to win a lawsuit.
That's what easter eggs have always been for from the beginning of art, it amazes me that fanboys and girls think they are for them like some kind of inside joke they're in on.
Fun trivia: Some map companies would include small inaccuracies in some of their maps so they could prove it in court when they claimed their maps had been copied by others.

Could have very likely been their designer. A lot of overseas designers prioritise speed over morals and authenticity, ripping off stuff from Google images or competitors.

This is actually something older than you expect. Maps used to do it add an extra town here and there that doesn't exist) so anyone that copies would tell on themselves. Phone Books also did the same - adding people and numbers that don't exist - for much the same reason.

Nah, cartography theft is easy to prove: adding fake streets with fake names to prove that another computer stole your map. However, lawsuits regarding the stolen work never goes through. That being said, DBrand was smart to add their logos and stuff to their prints so caseify was stupid to just copy and paste it on.
At least one would think........ In a fair and intelligent world there is no case to be had (I suppose in a fair and intelligent world this wouldn't happen in the first place), unfortunately our world is neither one of those things! The "world of justice" is even worse!

As of 6/25/24.
-On 5/1/24, Caseify responded to the lawsuit (denied everything) and provided counterclaims
-On 5/22/24, Dbrand responded to the counterclaims (denied what Caseify claimed)
-On 5/23/24, Caseify tried to have the case dismissed (motion to dismiss) for failing to make a claim
On 5/28/24, the judge responded to the motion to dismiss, basically saying you can't claim they didn't make a claim if you literally made a counterclaim to their claim.
On 5/30/24, after their motion to dismiss failed, Caseify filed a motion for summary judgment (basically one of the final attempts to get a case dismissed).
On 6/20/24, the judge rejected the motion for summary judgment.
In essence, this does not mean that Dbrand is right or wrong, nor does this mean that Caseify did or did not do anything illegal. This DOES mean that the court system believes that the case does have legal basis and that this will now have to go to trial (as requested by Dbrand).
Figured I would provide this info, which is publically available, but since not everyone either knows how to access it or understands it, figured I'd help.

I had a clothing logo and designs stolen by an international clothing company which i had trade marked officially at the IPO . Unfortunately the legal costs always put the larger business at a massive advantage. As a small producer, I was unable to afford the legal costs to fight even though I had a high chance of winning. Even then, just trying to be amicable and get an acknowledgement or credit for the design, I was ignored. I’m 100% behind you Jerry, do it for the small guys.

Map makers used to call this a trap street. They would add an imaginary street into their maps and if the map was copied illegally, they would have copied the trap street as well. Similar to the signature easter eggs you included in your designs. Great work!
When Google Maps used to rely on TeleAtlas data, they got hit by this (TeleAtlas, and therefore, Google); several map companies had their data illegally copied by TA and then used by Google. Google always took action when notified, but still...
Map makers and dictionary publishers have all done this in the past. Any time the data set is too big to manually verify it's done to trap those that copy... Long may it continue I say...
This is so interesting to me cuz ive never heard of trap streets but i HAVE heard of something called "Paper Towns" which basically have the exact same function!
Not all map makers actually, those works with government are obligated to never ever make any change than what's in the real world.
I worked with the Dutch government on mapping streets. When suddenly we had a suspicion. So, we added some bikelines and paths that wouldn't disrupt your navigator, but would signal to us, that they used illegal data. And yep, we caught them. So, what was the issue? Public funded data cannot be used for commercial purposes. These companies were selling maps based on public funded data.
Fun fact: this is how map makers figure out who’s just copying their maps vs making their own. They usually add fake towns as their own little easter eggs and if they find those towns on someone else’s map it means they copied theirs.
Glad to see you unintentionally had your own “fake towns” to call out casetify. Really hoping this will end up in a big fine/settlement + a crap load of bad PR for them.

This is part of the reason why I love inside jokes and easter eggs in products. It's also a fingerprint. I know in the auto industry there's a growing trend to add them to windshields and official parts so that way owners can also spot aftermarket replacement parts.

If he has copyrighted the design, I have a hard time seeing how they would loose, even if the laywer is a literal donkey, they just have to show the image and ask the company to explain how these details ended up on their products.
So unless the judge is like a complete idiot/bribed, they can’t loose. The only real defense I see would be to blame the employees, arguing that they have been tricked by whoever actually designed these. But hopefully Legal eagle will do a video on this soon :D

Peer-review open-access journal, so no $ involved, but my time certainly was hacked, much like yours. Fight the good fight, I hope you win. And please make a video that explains under what conditions a Cybertruck loses its bumper when towing. I really like my Model Y, but the towing issues are turning me off to the CTruck. Cheers!

If you have any evidence left consider taking this to court. This case will be enough to establish a pattern of behavior on "their" products. It could be much easier to succeed with a lawsuit now that they are proven to have copied other brands now.
I think it would help the lawsuit that Jerry started if you joined forces by combining the evidence you have, as the previous comments said it would help to create a kind of pattern.

As a Graphic Designer, I do not sell my copyright. Like map makers, and street directories, I put phantom entities in my works. Never broadcast an image above 80 dots per inch, always scale it down to the pixels on a monitor.

Some believe that certain design drawings of his machines had certain deliberate errors in the drawings, so if the machine was ever built exactly like the drawing, it couldn't work. He had a design of a military tank with such errors (believed to be deliberate) and a design of a massive military crossbow with similar errors (believed to be deliberate). One of his paintings has a nearly hidden face of himself as a young man. I believe it was 500 years before anyone noticed this. Another painting had near-hidden musical notes that made a nice melody when played.

Never heard of dbrand before but im a customer now, this video is just so right on the spot. Clever way to call them out promote your businesses and politely give the finger to the other company ripping you off. Good for you, I hope I get a chance to see the end result of the lawsuit.
In the end, I would say copyright infringement of my videos broke me. When I was in my prime of making content, I spent 50% of my time fighting people reuploading my content. There are over 100k reuploads of my videos on youtube alone. Tiktok, twitter, facebook, and an endless amount of websites across the world reuloading my content, including National Geographic, Time, CNN, just became too much.
HEY I remember you!!! I loved your magic videos man! I feel bad though because I did see a lot your content shown to me by the algorithm not uploaded by you. But one uploader was kind enough to put your channel in the description and i subbed to you almost right then and there.
That blows. I hope in some situations you can do a similar trick that Jerry here uses in order to protect your work.
Insane to think that your channel is big, mine is quite small, and there isn't a month I don't have to report copyright infringements from users that do copy my video, crop and cut.
And to make things worse, they give it a wrong a title and description leading users to believe their hardware can run the games when they don't really match the GPUs I do benchmark.
It's even more stupid to think that most of this stealers don't even make money out of that, they have thousands of views, sometimes/many times more than what I do, but they just have like 10/15 subs, at least on my channel, I could make money to get more GPUs or get more games to benchmark.
It's sad!

What you've done with those easter eggs is actually an extremely old form of copyright protection. Map makers used to intentionally do the same thing in their maps to stop rival map makers from copying them and could take them to court and point out those same easter eggs. Kinda cool! It theoretically SHOULD still work in your own defense I think..
Programmers will do the same thing with their code, too. Companies will sometimes ask for a demo of a program and copy it to avoid paying the programmer, so including an Easter egg like that is a great way to win a lawsuit.

Fun trivia: Some map companies would include small inaccuracies in some of their maps so they could prove it in court when they claimed their maps had been copied by others.

I doubt it. Several of these Chinese companies steal most of their designs and product ideas. They will pay whatever it takes to make this one go away and move on to their next scam.
The one person who got fired is obviously not the main culprit but some unfortunate "new guy" as their black sheep.
Could have very likely been their designer. A lot of overseas designers prioritise speed over morals and authenticity, ripping off stuff from Google images or competitors.

Whatever lawyer suggested that you add the Easter eggs really earned their retainer. This technique is exactly what map publishers do-they add a little town here, add a street there, to prove copyright violations. Go get them, Zach!
This is actually something older than you expect. Maps used to do it add an extra town here and there that doesn't exist) so anyone that copies would tell on themselves. Phone Books also did the same - adding people and numbers that don't exist - for much the same reason.

And that's why you should always use a marking of who made something in a picture.

Nah, cartography theft is easy to prove: adding fake streets with fake names to prove that another computer stole your map. However, lawsuits regarding the stolen work never goes through. That being said, DBrand was smart to add their logos and stuff to their prints so caseify was stupid to just copy and paste it on.
