The awkward situation for Niemann is that he has publicly admitted that he cheated in the past - that allows anyone to say (and defend successfully in court) "Niemann is a cheater", EVEN IF he has permanently and irrevocably stopped doing so. Carlsen chose his words carefully - he stated his *belief* that Niemann's cheating was worse than he has acknowledged. Whether such a suggestion or insinuation constitutes defamation is beyond my expertise, but I would be surprised if Carlsen's words did not stand up in court, because opinions are not facts and because Niemann's actions give rise to reasonable doubt.
Defamation/slander specifically means that you said something that you *knew to be untrue* with the intent of causing damage. It’s extremely hard to prove in court that you had knowledge contrary to what you stated publicly, which is why the cases are extremely rare. For example, a “provable/winnable” slander case would be if a journalist interviewed witnesses that said John Doe did not steal from them in any way, yet printed an article stating that John Doe was a thief with multiple victims on record (which is evidence of them having contrary knowledge) and it was also found out that the journalist was upset with John Doe because of a child custody battle etc. (which shows motive/intent to harm). I believe part of it is also that you spreading the rumor actually has the capacity to cause harm, like the person spreading it is a public celebrity with a broad reach, a journalist with a publication etc etc, not just your average person talking shit… otherwise teenage girls would be hitting each other with slander suits all day every day 😂 Hope that helps, I am not a lawyer, just a recreational student of bird law. 🪱 🎩 Esq.

Jokes aside with the beads, I personally think what Magnus did wasn't very fair since he didn't know for sure Hans cheated, he made him a laughing stock and ruined his career. @HunterTraxYourAss literally no, lmao. Requires more than the dogshit Hans filed with the courts. Also if you ask for millions of dollars for your hurt rep, that is in fact the purpose.
During the scandal you popped up on my feed with a video on it. Then more of your videos. And now I'm into chess and clearly your content. Thanks for the fun hobby!
Sounds like a bunch of royal BS to me! If Niemann is indeed playing at a Carlson-beating level, let him win his million$$$ the old-fashioned way, and quit filing dopey lawsuits. If N is actually cheating, then take it from there...
If one publicly states their defense as, "I only stole twice in the past.", they can no longer cry "defamation" when they are subsequently called a "thief". He is a cheater by his own testimony. Furthermore, in that testominony he did not own his guilt - he instead minimized and circumstancialized justification for his guilty actions. In short, he showed no remorse, responsibility, or self-examination of the lack of principles that allowed him to cheat. In fact, his statements and actions belie that he still operates on the same selfish values that enabled him to cheat in the first place. I tell me children, the very first time that you lie, you become forever after a liar. The very first time that you steal, you become a thief. No one else may ever know, but you will.
If someone refuses to play against his opponent in a tournament, then he should just lose. That should not affect the choice of the inviting them both to a tournament.
That's true. But not how they are looking at it. Magnus is a good draw... popular with the crowd and good financial return. If he won't play IN a tournament with Hans, then the Organizers has a choice. Be neutral and fair, or make money.
18:28 - So, there are basically three options here (and Hans can use any or all of them in any combination he likes): * "Tag" jurisdiction (as in "tag, you're it") - you can sue a person anywhere you can physically find and serve them, regardless of whether that place has anything to do with anything. In practice, state (or country) of the defendant's residence is probably the *easiest* option, but (for example) if Magnus visits St. Louis for a future tournament, then he could be sued in Missouri (but only if he's served while he's still there). * "Significant contact" jurisdiction - you can sue a person or corporation in any (US) state where they've had "minimum contact" with the state in question and where it would "not offend traditional notions of fair play and substantial justice." I'm sure the actual lawyers can talk your ear off about what that means, but in this case, it probably means that (e.g.) Hikaru cannot flee to another state to avoid service of process in Florida, if Hans wants to sue him in Florida. * "Diversity" jurisdiction - This is the more complicated and messy route. If Hans alleges more than $75,000 in damages, and none of the defendants are from the same state as him (or they are not from the US at all, as with Magnus), then he can bring the whole thing back to federal court (despite it previously being dismissed from federal court). Since his lawyers mention filing in state court, they probably don't intend to do this, but it is an option in theory. The tricky part is that, if those requirements are met but Hans files in state court anyway, then the defendants can remove the case from state to federal court, which may be advantageous in some circumstances.
LOL yeah being called a cheater, when you've cheated, admitted cheating, been caught cheating, being called a cheater when your a cheater is damaging to your reputation. LOL
This is where I think UK defamation laws are much better than US laws. In the UK you could not accuse a person of cheating without being able to prove it. If you make a damaging accusation without proof then that is defamation. That makes everyone a lot more careful about making career damaging allegations.
How it could not be defamation?!! So Magnus Carlsen everytime he will loose, he will be allowed to say that the other is a cheater or make indirect suppositions or directly say that he has something in his butt? And that is normal for you? Wtf...
Lawyer here! A "windfall" basically just means getting money you don't deserve (I always imagine it as the wind just suddenly blowing a stack of twenty-dollar bills in through the window). As for the dismissal, here is a clumsy chess analogy: Hans is white, the federal court is black. Hans is pinning black's bishop (jurisdiction to hear the case) with his queen (the two federal-law counts in his complaint). Black takes the queen (dismisses those two counts), and is now free to move the bishop (decline to hear the remaining counts).
The scandal and GothamChess’s awesome coverage of it, definitely got me back into Chess, after being away from the game for years. I love how exciting you make the game feel, and I’d probably listen to you talk about anything 😅

NOT A LAWYER JUST WATCHES LAW YTBERS: Defamation actually has two standards: if you are your average Joe, or if you are a public figure. As Magnus, who is a public figure, a different standard applies, meaning that Magnus only needed to act *in reckless disregard* for whether Hans was cheating or not for the lowered defamation standard to apply.
that lawsuit was plain absurd, so this being dismissed is no surprise to me. i already said this, the demand was so absurd it sounded as if it was written by hans himself

How could he sue for defamation? To win a defamation case, you must prove that the person knowingly lied. If he believed his lie, it is not a lie and it is not slander.
No, this is incorrect. Defamation is a false statement that injures a third party. You are only required to prove that the statement is false, and that the statement has caused you harm. Knowingly lying is not a component of defamation. The truth defence to a defamation claim is that the statement you have made is substantially true. It has nothing to do with the defamer's subjective belief. Nor should it. One, because there should be a deterrent to making public accusations where you have no evidence to support you claim. And two, if that were a legitimate defence, no one could ever bring a defamation suit - the defendant could just claim they "thought it was true", and no one would be able to prove otherwise.

I mean, the lawsuit is bad, it's not going to survive anywhere. The bar for defamation is pretty high.
He will definitely win some money if he didnt cheat of course
@@XCC23At the very least, they could bring Magnus in for questioning over why he made the claim. I doubt the actual point of the lawsuit is to win the money.
he's dismissed in federal court with prejudice for lack of jurisdiction
he will be dismissed in state court with anti-slapp statute
@HunterTraxYourAss literally no, lmao. Requires more than the dogshit Hans filed with the courts. Also if you ask for millions of dollars for your hurt rep, that is in fact the purpose.
Can we appreciate the vacation he puts inside us
the vacations are absorbing and consuming the juices inside
Don't traslate😠

Blink twice if your in danger
During the scandal you popped up on my feed with a video on it. Then more of your videos. And now I'm into chess and clearly your content. Thanks for the fun hobby!
Shout-out to Gotham for being a reasonable, level-headed amplifier for the sensible views in the community 🙏
Love you Gotham, I appreciate your unbiased coverage on these big topics. You are easy to listen to and understand, and I appreciate you.
The dismissal speaks for itself
Was not expecting this but really glad we got an update
How can you cheat with a device in Uranus? That's about 1 and a half billion miles away!
A device in a very deep dark tunnel 😳
Schrödinger’s beads. He is both cheating and not cheating at the same time
If someone refuses to play against his opponent in a tournament, then he should just lose. That should not affect the choice of the inviting them both to a tournament.
That's true. But not how they are looking at it. Magnus is a good draw... popular with the crowd and good financial return. If he won't play IN a tournament with Hans, then the Organizers has a choice. Be neutral and fair, or make money.
18:28 - So, there are basically three options here (and Hans can use any or all of them in any combination he likes):
* "Tag" jurisdiction (as in "tag, you're it") - you can sue a person anywhere you can physically find and serve them, regardless of whether that place has anything to do with anything.
LOL
I love how Levy's still giving us gold-tier chess content even while being held captive.
How can someone trust in someone who is officially got caught as a cheater? Should be banned for life after that.
He was 12 and 16 for the two times.
@@OtherDAS yep that's even worse he did it at least twice. 16 is not even young.
@@balazsio Not that young, but not an adult. It was also online, and this was face to face.
Did the kidnapper at least give you a chess board?
This is where I think UK defamation laws are much better than US laws. In the UK you could not accuse a person of cheating without being able to prove it. If you make a damaging accusation without proof then that is defamation. That makes everyone a lot more careful about making career damaging allegations.
Agree, innocent until proven otherwise.
Levy never disappoints us with the content
7:00 in and so far I've learned... nothing... except that the lawsuit was dropped. Way to drag things out to an absurd extreme
How it could not be defamation?!! So Magnus Carlsen everytime he will loose, he will be allowed to say that the other is a cheater or make indirect suppositions or directly say that he has something in his butt? And that is normal for you? Wtf...
After April first, I trust nothing he says.
Thank you levy for doing all that you do and even uploading while on vacation
Wholesome!
being held hostage*
you mean after being kidnapped?
dude makes $1mil+ per month off youtube ofc he is going to upload, it will pay for the vacation for him and his entire family.
Wdym 1M$?? Who said so?
Lawyer here! A "windfall" basically just means getting money you don't deserve (I always imagine it as the wind just suddenly blowing a stack of twenty-dollar bills in through the window). As for the dismissal, here is a clumsy chess analogy: Hans is white, the federal court is black. Hans is pinning black's bishop (jurisdiction to hear the case) with his queen (the two federal-law counts in his complaint). Black takes the queen (dismisses those two counts), and is now free to move the bishop (decline to hear the remaining counts).
👌😃 Thanks for educating us
Making an analogy trying to simplify the explanation but actually achieving the opposite result = a true lawyer
White lost the queen because they weren't using Stockfish this time
The scandal and GothamChess’s awesome coverage of it, definitely got me back into Chess, after being away from the game for years. I love how exciting you make the game feel, and I’d probably listen to you talk about anything 😅
Blink twice if you are being held hostage
I like how Levy is a member of Anarchychess but not Chessbeginners
Blink once if you're okay and more than once if you're being held captive. Don't forget levy, we are always here for you.
Having recently had a colonoscopy, this is the 3rd video in a row where Levy has mentioned it being unpleasant. I’m convinced he’s listening.
Anyways, the procedure is easy and painless. Get checked as colon cancer is preventable with early detection!!
It’s nice that you can be able to say these things without being sued
Levy looks like he's about to do a TH-cam apology
me: alt tabs cus im bored
gotham: are you still here? good your attention span is longer then 12 minutes
I also believe that the unusual behavior in critical and game changing positions was very suspicious that could’ve been led to cheating.
Levy... blink twice if you're okay. Sacrifice the rook if you're in distress.
All I can say is I think the chess has spoken for itself
Dismissal means the judge wouldn't even study the case. It's an absolute loss
I was only 2090 fide when the Niemann Scandal happened and it really gave me the kick I needed to get into chess more seriously : I hope to climb back to 2100 or 2105 by next year. Or the one after.
You've handled this situation really well, in my opinion. Keep up the good work.
You cheat once, you’re out forever. As simple as that
that lawsuit was plain absurd, so this being dismissed is no surprise to me.
i already said this, the demand was so absurd it sounded as if it was written by hans himself
Congratulations on your PBS Newshour interview! Well done!
If he's already been caught MULTIPLE times his character is already in question, so someone doing just that is hardly grounds for compensation.

the owner of the one and only catch phrase: THE ROOOOOOKKK!!!!
Also, slander and defamation are not equivalent terms.
