    It’s amazing really. We have a financial crisis, caused by greedy, reckless financial institutions. Congress passes legislation requiring those institutions to be less greedy and reckless. The institutions then lobby to have those restrictions removed, usually in the name of “remaining competitive”. This leads to another financial crisis. It’s completely predictable, and we have been doing this dance since the Great Depression almost 100 years ago.

      Agree; the rules should be applicable to all banks - big or small. First; very few meaningful laws are passed and then this cycle of doing-undoing seems to support deregulation risking the economy and the faith in banks.

      A lot of folks downplay the role of advlsors until being burnt by their own emotions. I remember couple summers back, after my lengthy divorce, I needed a good boost to help my business stay afloat, hence I researched for licensed advisors and came across someone of utmost qualifications. She's helped grow my reserve notwithstanding inflation, from $275k to $850k.

    They charged me over $1300 for overdraft fees over the weekend back in 2003. Because iTunes charged me $1 per song download while BofA charged $35 per song. Funny thing was that I deposited a check that friday before 5pm which they said that didn’t initialized till next Monday even though I had the receipt from their ATM machine. They are bunch of crooks.

      It is common practice in banking to process withdrawals immediately and deposits the next business day, just for that very purpose.

      But you as a bank consumer customer at their Bank you can go individually and sue them money that they have to pay back to the customer will be under class action lawsuit but you can still sue them individually some just might do that .

    As a former employee many many years ago. I can confirm this is 100% true. They would fee their own employees who didnt even want an account but felt obligated to open one. By not using the account would charge a fee which made the account go negative bc i didnt use the account and charge another fee bc it went negative. Then another fee if it stayed negative for more than 7 days. I had so many fees for an account i did not want. I was using another bank at the time. They are trash to their customers and employees.

      Golden 1 credit charges customers fees on savings accounts if the balance goes below $100. Golden 1 just started doing this practice a couple years ago.

      BOA recently opened a fake account in my. I was sent a letter saying BOA decided to close my account. I would have never known otherwise. I had to file a fraud claim and BOA never told me who opened the account. I know it was from inside BOA because I get LifeLock alerts when my info is being used to open accounts. SMH

    Bank of America is the WORST. I was closing a BOFA account, but knew that I had at least one pending transaction. I went to the bank and asked if it had cleared yet. They said yes, so I zeroed out the account. One month later, I get a notice of an overdrawn account and all sorts of overdraft fees and fees and fees. They LIED to me knowing FULL WELL that the transaction hadn't cleared in order to glean money from me. I never paid it. And never will. That can stick on my credit report until the day I die.

      Bank of America is by far the worst. On April 24, 2024 I received an email from BofA saying i successfully activated Face ID. I am 83 and would never use face ID because I use a password and my family knows how to get into my account upon my demise. So I tried to access my account and was not able to so I called Bank of America and was informed that an IP address from outside of the US used my account and I was responsible. They claimed I had to have given someone my password outside of the US. They immediately closed my account. I have been a BofA customer since 1987 with never a bounced check or other problem.
      I have had two direct deposits with them since I retired in 2004. Because they would not let me access the account, I could not get the bill pay information who I pay, phones and addresses. Both direct deposits were returned and in the case of Social Security it will be six weeks before they can direct it to my credit union account. The CALPERS retirement check was returned and it will take three weeks to receive it at my credit union account. I know no one outside the US so have no idea who could have changed to face ID. Today I received a letter from BofA stating my information has been entered into a database all banks use and I will not be able to open another account with any other bank for five years. Please put BofA on top of your list. Everyone should be warned that this could happen to them.

    Part of the lawsuit should include a clause that prevents the Bank of America from charging any fees for bounced checks for at least the next 5 years. That would be real justice and penalize them further.

    I got hit with the overdraft fee multiple times in high school. I remember being hit with multiple fees for the same charge and my bank account that was only overdrawn by -10 dollars turned into me owing BOFA -378 dollars from constant fees in just two days. Ridiculous.

    It's very unfair to we the customers as these very bad guys don't get to pay for their mistakes. By understanding how Banks work, it becomes clearer why they ultimately fail. Do people even know Banks use a majority of their funds for their "personal investments"? Ever heard the saying cash is thrash? Just hold your money in more stable and lucrative ways and save yourself the stress.

      Sorry to jump in, but there a lot; gold, stocks, stable businesses etc. I know this cos personally I made my first million late last year from stocks and bonds which I have used to set up and put into the other things. The only downside is that you could also lose your funds which is easily remedied by using a professional or making very thorough inquiries. Good luck.

    What about past accounts?
    I stopped using BOA because of fees and when I had a couple overdrafts I was charged like $120.00-$150.00 to pay back the so called interest from their overdraft loan, this was for a $20-$40 gas fill up usually because the gas stations took so long to actually bill the bank acounts... so thing got messed up sometimes
    How do we recoup these fees in this lawsuit

    I used to work for Bank of Bank till 2021 as a Banker and all what they’re saying is true. I can’t tell you how many clients I had to help reserve those $35 fees during the lockdown. But trust me, the money they made this fine isn’t enough.

    Punishable by a fee just means it's legal for those who can afford it. There needs to be prison time or harsher penalties for those in charge who abuse their privilege and power.

    BOA receiving bailout money and gives their senior officers bonuses when everyone else is suffering. Now we're hearing multiplying fees, creating fake accounts to meet quota, and withholding rewards from customers. Is it really a bank?

    Over 100k was illegally taken out of my Bank of America account and BofA is partly responsible for allowing the money to be taken out in California. By someone who is NOT related to me. This was done 2010-2015

    They should be made to credit all of those fraudulent fees correctly to those who lost money. Not just give out pennies, on the dollars, lost by customers... The fines will not be enough as a penalty for the fraud at all...

    Keybank did this to me back in the 80s with my student loans. They double charged me on overdrafts over and over until they took almost all of my student loan.

    I worked for bofa and got fired I am SOOO GRATEFUL!! It was a terrible job and I hated the way I had to treat customers. Never opened fraudulent accounts but I’ve seen it done.

    Citibank was doing this as well:
    $3 bank balance
    $5 end of month fee
    -$2 in bank ($3 - $5 = -$2)
    $35 Insufficent Funds fee
    $40 a month for several months. ($5 Monthly fee + $35 Insufficient Funds fee = $40 )
    I paid easily more than $200 in fees to Citibank when they were doing this to me.

    I’m fighting with them right now over a transaction that I didn’t authorize and didn’t sign for. It was a split bill but the merchant charged my card twice instead. BOA still wants me to pay that other half and suggested I go to merchant to resolve it. They’re also charging me more for a rescheduled flight which I also sent them an email from a booking company with the amount which is lower. This bank is going down and looks like quick. I’m going to close all my accounts with them once paid off and everyone I know will hear about their stinky crooked activities against their clients.

    This sounds exactly like what Wells Fargo did about seven years ago, when employees were fired for opening unauthorized accounts in order to meet arbitrary and unrealistic quotas.
    I don't blame the bank employees, I only blame management. They must've put the employees under enormous pressure to meet those quotas or forfeit their jobs.

    I never got a NSF from Boa, but I have noticed for a long time they reduced the cash back rewards and I never knew what happened.. but companies do this all the time. Even 7-11 rewards were reduced about 4 years ago.. I didn't know a company could be fined for reducing reward programs.

    Thanks for letting me know this is illegal. Former “Bank Atlantic” which got bought out by BB&T/BBX Capital did this to me as a broke 18 year old. It wasn’t even for an overdraft due to me spending money I didn’t have. I basically got penalized for not having a certain dollar amount in my checking account, which then placed me into “overdraft.” Then unknowingly, I was being charged $35 every month for “over drafting.” I saw the overdraft letters they sent every month but I thought they were reminding me of the one “overdraft”. I found out I was “over drafting” every month when I went in to close my account and they told me I owed $500+ dollars to close the account, which I luckily had in cash (from saved up lunch money) when I went in. I wonder what would have happened if 1) I didn’t close the account earlier and 2) I didn’t have the cash. Would my account just stay open and they add $35 into infinity? Knowing what I do now, I would have disputed it but I was naive, shocked and afraid when the representative told me so I just handed her most of what was my cash savings at the time, pretending that I knew that’s how the process went. I did a great job hiding my “shock”, trying not to act new to “adulting.” It really didn’t feel fair, which now this story years after confirms, it wasn’t! I would follow it up if it was worth my time now but I’m sure going back all those years into records of a bank I left that was also bought out would be a drawn out process. Every bank policy maker who gave this a green light needs to repent.

    Webster bank did that to me 2009 peak recession when I had a hard time getting a job as a mechanic. It was a brutal year. I only got $100 back for thousands that I got taken by over draft fees. They would hold onto them and then take them all out at once with the largest payment first and I’d get billed like $100 for 4 over draft fees

      When this happened to you, did you sue them ?? If not , if the statue of limitation isn't up, you can go individually and sue them this judgment that came down on them will most likely be under a class action lawsuit . But seek an attorney for advice .

      It happened earlier this year. I guess I can’t prove it was BoA and not a third party. (How are the others proving it?) But it seemed fishy at the time and even more so now. How would a third party benefit from opening two empty accounts in my name and with my address so that the cards were sent to me and required my activation? They didn’t steal money from me, but - wow - the time I wasted trying to resolve this! They made me drive to a branch and sit there for four hours while they tried (unsuccessfully) to figure it out - and that was after spending over an hour on the phone. After that, it was still an issue for several months.

    Open a local Credit Union Account. It keeps the money in YOUR neighborhood, and pays dividends NOT million$ to their shareholders.

    Yes! I worked at a job that sometimes they didn’t deposit my paycheck on time and Bank of America charged me those $35 fees over and over again. Example, a coffee at Dunkin Donuts would cost me around $40! I hope I get some of that money back.

    They were my mortgage holder for years. They did have serious problems, and it doesn't help your credit when they pretend you're paying late, to justify the fees, by delaying the deposit.
    But bankers just don't care about your fees, as long as tax cheating is acceptable.

      @caseymuller3480 Well explained, the best thing is investing your money rather than just leaving it in your bank accounts, where it ends up loosing it's value over time. I used to be a victim of this, until I met a financial advisor Robin Brezik , she explained to me why I must invest my money and have my retirement planned. Now I can proudly say I make so much every week from my investment and my retirement account is growing bigger and better. I am not worried of getting older anymore.

    I closed all my accounts with this bank in June of 2022. The bank was withdrawing by their computer from my account every 2 weeks and then charging me for the withdrawals. I never received a dime from the bank, and I don't expect to get anything now.

      You need to seek an attorney for advice this just happened to you in 2022. Most definitely, you have a case of them individually ! Did you sue them when this happened ? If you didn't, you should most likely this judgment that was passed down on them probably come under a class action lawsuit !
