I'm currently in the surrogacy contract process and we are waiting for the IPs to make revisions to the draft contract our agency put together so we are sitting tight waiting to hear back. We are currently in week 3 and I'm an inpatient person😅
Some contracts say they’ll get the medical opinion of 2 physicians. And if both parties are okay with termination in the case of the surrogate’s life being at risk, then it can be up to the surrogate. If both parties are okay with termination in the case that the surrogate’s life is not at risk but the baby has genetic abnormalities, it is up to the IP’s upon obtaining 2 different physicians’ medical opinions.
What if you have theBaby and it comes out with a serious disability, or worse, and the parents are like ,"no we don't want that baby" what about that??
This is usually paid for by the IP’s when using an agency. When going independent without an agency, I think you could still have the IP’s pay for your attorney.
It’s agreed upon in the contact how many embryos to transfer per transfer, or on the first transfer and more/less embryos transferred in following transfers if the first one fails, etc. If it’s one embryo per transfer, the embryo could split and be a “multiples” pregnancy, and there usually is additional compensation for this since it’s harder on the surrogate’s body and generally a higher risk pregnancy on top of it being technically an IVF pregnancy.
This is like your 3rd surrogacy isn't it? I followed the last one but I cannot remember if there was one prior. But I wanted to know... Can you have sex? I hope that wasn't out of pocket but like what if u transfer , have sex in that week and you don't know if your prego by your hubby or transfer??

If something goes wrong with the baby while your pregnant who decides how to treat it?

They sign a contract. It's no different than if it was her baby she can't just tell the Dr to get rid of it after it's born.
