      Could be it is what the very senior female police officers prefer, after all they have no experience of investigating real crime when they jumped from university to a top position in the police force. They much prefer quick paper work than investigating real crime.

      Currently only 5% of real crime is solved by Police and leads to prosecution and conviction - yet they have time to pursue - non-crime "Hate" incidents . . . Its staggering, we live in a nightmare land totally devoid of common sense and rational judgement

      A number-cruncher who needed to provide a way to manipulate tick box statistics, in favour of a force/ service/ constabulary...It is filed as a detected crime - no-crime so a positive to counteract a negative. In their reviews by the government, they come out looking good! And everyone is in on it, and can tick all of their boxes. It will only change when some celebrity or politician loses out and then they will decide to change it. DESPICABLE!

    Police only have (limited) authority in matters of CRIMINAL law. Common law/law of the land which they as CONSTABLES are under oath to uphold.
    These NCHI's don't come under that, so they are all PERSONALLY liable and can be sued for anything they do outside of that oath.

      Can you point to the legislation that allows for arrest of a non crime. As far as I am aware if the police come to your door and you ask them am I being arrested. They tell you no.

      @ in Scotland just look up the hate bill legislation it’s in plain English. If the victims states it’s perceived as a hate crime/incident then it is and there is no requirement for evidence their word is suffice t and there is no defence. The other worrying point is you can report it the a hate reporting centre and stay anonymous.

    thank you to the DR for explaining this so well, but i am still perplexed why police are investigating things that are not a crime when they will not investigate a shoplifting offence if it is under £200, and going on perception is subjective you can ask 100 people what they think on a comment and get 100 different answers there needs to be a black and white threshold or this is open to abuse by people who want to silence people they disagree with or who they have a grudge against , the pm has said many things that many people have found "offence" so is he guilty of a NCHI ?

    Whilst anyone can report issues to the Police, no matter how they seem to other people, the outcome rests with the Police. They know the claim but they should not be saying they believe a complainant as there can be malicious, or even drunken, complaints. They should be looking at the matter impartially but also knowing the law and the European convention on human rights, which cover the ability to offend without it being illegal. So the questions are:
    1. Do they record who makes a complaint? If so can this be categorised into say, individuals, corporate bodies, political organisations, or whatever?
    2. In the context of the law why can't they just tell the complainant there is no action or substance to the complaint? Or that further incidents are required. In the context of tweets they should be able to determine action immediately.
    3. If someone is not committing a crime then that should not be noted by putting them on records so they can be picked up in other checks eg by future possible employers is wrong.
    4. If the government wants to know what has been reported by type and quantity it doesn't need someone's life to be impacted without due cause IE an actual crime has been committed, taken to court, proved and a sentence given. It then appears in crime statistics.
    So the present situation seems silly.
    5. What is especially silly is keeping the nature of the complaint and what caused it secret. That surely prevents an appeal and how can legal representation be made if it is an invisible complaint. That's like telling someone they are making too much noise but not how. Bizarre.
    6. The complainant remains just that and cannot be a victim until a court has heard evidence, passed judgement and issued a sentence. An allegation remains that until so tested. The Police should know that.

    Its about differentiating between perception - the act of using senses (sight, sound, smell, touch, taste) - and conception - the act of interpreting the experience of the senses. That conceived interpretation can be 'real' (it is what it is) or a 'fantasy' (it is imagined to be what it is). e.g. You cannot think the phenomenon of gravity, you can only experience it in action. You can, however, conceive both a name for the phenomenon and an explanation for it. People are obfuscating perception with conception. This dreadful law does exactly that. People interpret other people's actions and that perception is treated as a reality when it can equally be a fantasy. Thus, paranoid understandings of phenomenon are given greater credence because of prejudice. "That is racism because that's what I think it is" is as likely to be a fantasised interpretation based upon the mindset of the accuser rather than the reality of the accused. Madness!!

    For good practice, the police should record alleged hate incidents (not normal discourse) on an internal file which would be reviewed periodically. Nothing more, except when to bolster evidence for a future prosecution.
