When I think about the pain and nuisance the Adelson family has caused so many people. Thinking about how the pain and torture their actions caused to the Markel family and his children … it’s mind boggling. They are toxic.

FYI, Charlie signed a waiver approving not calling Donna as a witness. This was a family crime, and a family defense strategy. Charlie and Donna purposely designed the “double extortion” defense to clear the whole family. Rashbaum didn’t call Donna because he wanted to keep his “double extortion” defense a surprise until trial. Not calling Donna had nothing to do with protecting her, rather Rashbaum didn’t want the prosecution to learn his defense strategy at a deposition prior to trial. This would be “invited error” to now claim that Charlie was unaware of the conflict with Donna. Charlie and Donna were extremely close and spent hours on the phone every day, even while Charlie was in jail. Also, Wendi was in on the conspiracy, but she was pre-protecting herself by mentioning her brother and family at the police interview. In case the police started getting close, she wanted to make sure she was kept out of it, because that’s how she rolls, self protection above all else!
You know what’s fascinating to me? We’ve all been in situations where a person didn’t listen to “Nope”, “Stop”, or “You’re barking up the wrong tree” and the person just keeps going regardless of how nicely, politely, or directly we said it. It’s fascinating, and helps me not feel so alone, in that it’s happening in a real court over a real trial in response to a real lawyer.
What is even more bizarre is Rashbaum also represented Harvey Adelson, another unindicted suspect. Rashbaum said during an interview that he obtained written waivers from all three parties. Whilst he may of obtained verbal waivers it appears he was being less than honest when he had these in writing. How this mess was evident to the most uninformed lay person, but Rashbaum refused to acknowledge it. When he removed Donna and Harvey from the witness list from Charlie's trial when they were the only ones who could have corroborated his ridiculous defence; who's rights was he protecting then?

If I was Halyna Hutchins family I would be absolutely livid. Kari Morrissey was horrible during Hannah case but somehow managed to pull a guilty verdict. But misconduct (not turning over evidence) and then throwing a tantrum after the court held her responsible for it? How absolutely embarrassing. Halyna deserved full justice and Baldwin should have at least faced a jury regardless of if he was ultimately convicted or not.

Em, from the section 39.33 noted by the court in the rust trial, here’s the relevant info on appeals by the state: “ B. By the state. In any criminal proceeding in district court an appeal may be taken by the state to the supreme court or court of appeals, as appellate jurisdiction may be vested by law in these courts: (1) within thirty days from a decision, judgment or order dismissing a complaint, indictment or information as to any one or more counts; (2) within ten days from a decision or order of a district court suppressing or excluding evidence or requiring the return of seized property, if the district attorney certifies to the district court that the appeal is not taken for purpose of delay and that the evidence is a substantial proof of a fact material in the proceeding. C. No appeal shall be taken by the state when the double jeopardy clause of the United States constitution or the constitution of the state of New Mexico prohibits further prosecution.” So while yes the state can appeal a dismissal in general, the way I read that is if jeopardy has been attached (and it was), there is no provision for appeal.
The state knew that Donna and Harvey hired Rashbaum in 2016. In 2016, when arrests started, (with the hitmen), all the Adelsons hired lawyers. There was a press conference where the names of all the lawyers were given: Donna/Harvey - Rashbaum Wendi - John Lauro Charlie - David Oscar Markus The problem arose when after Charlie got arrested in 2022, Markus stepped down before Charlie’s trial dates were even determined. At that point, Donna and Harvey had not been charged with anything and I don’t know if Rashbaum had represented them in anything, before he went to help Charlie.
Wendy pushed her family under the bus, and then got on the bus. I have heard other lawyers say "Criminal court is when bad people are on their best behavior. Family court is when good people are on their worst behavior."

I know Donna Sue and Charlie aren't attorneys but I can't imagine this didn't come up in conversations, especially with a daughter who is an attorney and A. FREAKING. LAW. PROFESSOR.
