Watch BEFORE picking your ADU builder

  • If you're about to spend six figures on an Accessory Dwelling Unit, you need to make sure you know this stuff before picking a builder.
    5 deal breakers:
    They don't want a written agreement
    They don't have a license and insurance
    They don't want to cover exclusions and assumptions
    They don't want to explain the change order process in writing
    They don't have a clear payment schedule
    These are the basic parts of a contractor agreement that will protect homeowners AND builders:
    Scope of Work/ Assumptions
    Exclusions
    Finishes/Allowances
    Payment Schedule
    Change Orders
    And more...

    Franchising your brilliance You become your own builder Those people wanting to build go through you Those interested parties take classes pleasing government agencies etc I think it’s a cool way of networking and helping everyone ✨✨✨

    Great advise....we had this vague contract....and everything is a change order with additional charge.

      For future work with a contractor, a contractor must disclose everything he will be using on the job site. From the type of nails to the type of tools.. Always ask what is included in the contract and to specify it in the scope of work.

      @@geovannirodriguez7055what exactly does this mean? Is the scope of work in the contract and have them itemize everything down to the nails as to what will be used? Ive actually known small contractors who dumped cheap paint in expense containers in the bay area. So Im just trying to truly understand fully when and how they disclose. Also substituting out on products they cant access? Love this edition by the way

    What if you do find yourself having to let your contractor go. What happens to your permit? Is there something that should be in contract as to what becomes of your permit or is that entirely up to building permit inspectors? Is it wise to pull your own permit to avoid this? Can you pull it and have in contract that contractor still takes responsibility for everything? Not sure Im wording correctly.

    What do you think about a prefab adu program? I've seen a couple of things on them and would see if it's a better route for future reference

    How do we negotiate terms for completion of ADU at a set time and hold the contractor too it?

      Great question. This is not legal advice for your situation.
      In our private community, we've been having a conversation about this recently. One builder suggested that people could use "liquidated damage clauses". Their suggestion was that a GC would be willing to guarantee finishing on a certain schedule or pay damages for delays 🤔 seems like a big ask. While this is something you see on big commercial projects that go on for years, I don't generally see residential contracts take on this kind of risk. Lots of reasonable GCs would refuse or would add so many exceptions (rain delays, 3rd party delays like utility connections, etc) that I probably wouldn't pin the builder down anyway. Not sure. Something you can talk to the builder about. In my experience, builders with a very professional set up who know their timelines well and don't cause delays are also a bit more expensive. You often get what you pay for!

    How does one apply for the ADU grant directly? Must you use an agency ?

      We’re currently waiting for information from CalHFA about how they’ll use that state funding this year. Last year, they required applicants to go through a pre approved entity

      CalHFA grant is currently fully subscribed. The state budget currently doesn’t have funding allocated to the grant (but things can change).

    We had done everything wrong. Structure engineer get the building way over....no body...including the architect check this for us. Over budget.Still in the construction he'll after7 months.

      😢 unfortunately this story is not unusual. So many "professionals" have starting to build ADUs since the demand is high. If the builder or architect can't show you an ADU that they have built in your locale or can't provide client references, RUN. I decided to go with a prefab modular builder, Cover, that offered one fixed price upfront. Cover did everything.
