I find it helps to maintain a small notebook with keywords and phrases for each niche. You don't forget any. Plus, when you come across new ones, you have a place to write them down.

Thanks so much for your work in helping the community! I’m concerned that my shop is dead. I opened it up, made around 70 sales on TV show inspired merch, all those listings got deactivated (learned my lesson), all my 5 star reviews were on those products so now my shop rating looks wonky. I had to put my shop in vacation mode for a year. I’m in the process of rebuilding with a new niche but I wonder if I should close my shop and open a new one. Thank you!

How does your shop rating look wonky? I wouldn't waste the reviews and sales you've built up... Just reopen and play by the rules :)

Thanks for your reply. The stars are empty/grey, but you can see that I have 19 reviews (mostly 5 stars) and can still read the reviews for the old/deactivated products. I’ll stay the course and play by the rules. Thanks again for all the content you put out. It’s appreciated.

Jay, if I want to trademark and copyright designs and sayings I come up with myself do I have to apply separately for each design/saying?
Or is there a way I can just trademark/copyright my business then anything I put in it, it will be protected automatically?

**I'm not a lawyer and this is not legal advice (always consult a lawyer whenever necessary).
First: You should not be trying to trademark phrases on a shirt. This is a major problem in the industry and they are known as "frivolous trademarks". The trademark is for protecting a wordmark intended to function as a brand. I know there are lots of "trademark trolls" doing this kind of black hat type stuff, but there's ongoing efforts to stop them. I recommend joining this FB group to learn more: facebook.com/groups/TrademarkWatchDawgs
      To answer your questions:
      • yes, you'd need to apply separately for each TM
      • yes, you can register multiple © at a time if they're unpublished works
      • no - nothing you use "ornamentally" on a shirt is protected by your overarching brand (at first), but if it becomes a brand identifier then it may be possible to protect it (like Nike's "Just Do It"), but it will still have to be filed for separately.
Hope this all helps and makes sense!! :)
