  • A day after his landmark court ruling, retired police officer and Fair Cop founder Harry Miller joins us to discuss his victory for free speech, which saw the Court of Appeal rule that the police's definition of a 'hate incident' is unlawful and had a 'chilling effect' on his freedom of expression after he was visited over trans tweets.
    This is a hugely significant moment in the fight to protect free speech and could hopefully spell an end to the sinister recording of "Non-Crime Hate Incidents".

      @@rigilchrist You can comment about it, and protest about it, on social media, or join demonstrations against it. Vote for the common-sense and courageous politicians. You can call out offenders by name on social media, as long as you have the evidence against them and are careful not to libel or slander -- in other words truth and facts. Unfortunately, it takes courage these days. As Harry Miller mentioned, the woke and "wrong-think" culture has seeped into corporate human-resource departments giving corporations the power to destroy lives of employees who disagree with this creeping 1984 umbrella.

    A true hero. It says a lot about where we are as a society that it was necessary for him to take on the system in the first place over something as obviously totalitarian as the College of Policing guidelines, but it is encouraging to know that courageous people like Harry Miller are to be found.

      Robert, absolutely! A true and up-to-date example of David and Goliath. Having been paying great attention to this case from the word go, I have the utmost respect for Harry, who deserves the Queen‘s Police Medal, if ever there was a more likely candidate, compared to the gaggle of undeserving, ludicrous senior police officers who’ve already been awarded one. Or how about a knighthood? But I won’t be holding my breath.

      @@edtaytobjo66 Quite so Edward, especially when you bear in mind ridiculous oddities like Sir Elton John, Sir Mick Jagger, Sir Paul McCartney, Sir Michael Caine “I only wanted to blow the bloody doors off!” Then there’s that great philanthropist Sir Bono (The Hat) who’s worth $400 million, exhorting us to stick our hands in our pockets to save the rainforest. Fer feck’s sake! OK already, I’ve seen the Stones five times live since 1964 and they’re my favourite rock ‘n’ roll band of all time, but a knighthood? Keith Richards has something scathing to say about it in his autobiography. If Hats off to Harry Miller gets a knighthood then I swear to God I’ll be there cheering him on.       @@ghostdog4330 Well, I’m halfway there. Or at least my father was. I wrote to the palace in a childish scrawl, pretending to be my dad, saying that he was soon to celebrate his eighth birthday and invited Queen Elizabeth to his party. We got a charming letter back from her lady in waiting saying that the Queen was sorry but she couldn’t make it on that day, but she said happy birthday. My dad, at the time of his imminent 85th birthday, when he stop pissing himself laughing, framed the letter and hung it on the bog wall.

    He deserves a knighthood, and is so right that are graduates just box tickers. If we had a proper intelligent government this hero should be given total authority to reform the police especially this mad Police College. Obviously a very intelligent ex copper, full of energy and drive with tons of common sense which we now need 'drilling'back to the police, teachers, doctors, judges, social workers.

      There is NOTHING unassuming about this guy; although he was treated abysmally by the authorities, it must be remembered that he was once one of them, and posses a slight smugness common to the species we call the Police. I have no doubt that he has 'rubbed up' against some questionable behaviour by his colleagues and kept his own counsel. Social media provides a platform for everyone to fulfil the Andy Warhol prediction of attaining 15 minutes of fame. Sometimes: it's best to keep ones opinions away from social media especially in this environment.

    What was most astonishing is how, by classifying these alleged 'hate incidents' as non crimes, something as utterly fundamental to the law as due process is entirely bypassed.
    No presumption of innocence, or a jury of your peers required, Sir. You haven't broken the law. We will however be recording this incident against your name, and informing potential employers if requested.

    It’s always been obvious to me that “hate incident recording” was illegal, but with all these things, they need to be taken through the courts for anything to happen.
    And that’s really the whole point: I suspect that the College of Policing always knew that “hate incident recording” was against the law, but the process is the punishment. They have all the resources - public resources - for legal action. They are counting on the plebs not having the resources, or being unwilling to lose everything, or not simply wanting public exposure.
    But there are, obviously, far deeper questions here, and this ruling does not address them. How did this ever come to pass? Why does a single policeman feel it is his job to police political expressions, or human emotions? Why are such individuals not weeded out by the selection process, and how do they ascend to the top of the force?
    We need a full public enquiry into this.

    What a wonderful result. Atlas a statement by the court that is clear and precise. Without Mr Miller and his backers taking this case all this way we would be still threatened by the woke culture.     Common law, also known as common sense. Hilarious that a serving Senior officer suggested that common sense has no place in UK policing. Who needs satire.... Congratulations to Harry Miller for pursuing this and helping to protect free speech, at least as far as the law is concerned.

    Mr Miller deserves an MBE for this. We should all be grateful for his tenacity, his knowledge, and his financial security which enabled him to bring this action. Next on the list is removing the human rights role from the police. How can we (Joe public) help with that? BTW: WTF is the "College of policing" for?

    Really enjoyed this. The way to follow up on this victory is for a large scale civil litigation case against policing for those who have been a victim of this illegal behaviour.

    I'm sooooo grateful he kept going, even after his first "victory". This is the best news I've heard in a very, very, very long time. Harry Miller is a hero! I propose we start a fund raiser for a Harry Miller statue in Parliament Square Gardens 😁

    I think this is a very important turning point- much has been introduced in policies in UK/Aus/USA/Canada under the guise of human rights, often sidled under the door by bureaucrats & politicians unthinkingly “complying” with UN/EU etc treaties. But some of these policies have altered common law fundamentals eg definition of woman now includes men; the human rights of a minority take precedence over the majority; someone’s “rights” create loopholes that are exploited by bad faith actors. Common sense has been replaced by policies made by quangos that most won’t challenge if their livelihood & safety depend on compliance. We’ve seen this before in the past in Germany/ China etc and now in English speaking democracies as well as much of modern day Europe. It has to be challenged by is all. Congrats Harry

    Well done to Harry for taking this to the high court and well done to Peter for featuring the topic. I hope all the people who have been classed as committed or logged as a suspect of hate crime all take the police to court and demand their records are amended.

    While I'm glad he's won. I feel nothing but despair for the Uk and the human race in general. Look how far we have fallen that he had to spend 100.000 plus k to fight this and if he didn't he would have a hate condition on his record.
