    Crosswalks are usually placed at intersections, where traffic can be coming from many directions, drivers are more distracted, and it’s harder to predict what they will do. I feel much safer crossing in the middle of a long straightaway where cars can only come from my left or right. I can wait until no vehicles are nearby in either direction and take my time crossing without affecting anyone.

      This also occurs with pedestrians on stroads in Orlando. The signalized intersections on a stroad, like OBT, were often more dangerous than just jaywalking midblock. The key difference with Florida to most states is that our stroads have continuous central medians that effectively act as a pedestrian island for jaywalkers and only have to cross one direction of traffic at a time. I also did this when I was dropped off at a bus stop that wasn't near an intersection.

      Counterpoint: it's -10°F some days when I'm walking across the unmarked crosswalk at the intersection between my apartment and my parking lot. Everyone driving is warm and listening to music. I am cold and trying not to die. Is the brake pedal that hard to use when I'm standing in the parking lane, fully upon the crosswalk, waving for the driver to pay attention to their legal obligation to yield the right of way?

      @@cbar687 Sadly, it’s way too easy and tempting for drivers to ignore them. We need to be more willing to slow down and de-prioritize cars. That’s the only way pedestrians can be safe, and there’s no feasible way to make everyone stop being pedestrians, especially since environments where the maximum number of people drive are unsafe for the drivers, too.

    In the Netherlands the rule used to be: if there is a crossing (a zebra, or with pedestrian lights) available within 30m (or 100 feet) you are obliged to use it. Otherwise you are free to cross the street directly. Exceptions exist for blind people, who always have priority if they have the appropriate cane with them. Pedestrians are never allowed on larger roads of highways, so crossing them is not a concern. It's a simple rule, but that is what traffic rules need. Easy to understand.
    Edit: Upon researching this further I found that this rule was dropped a while ago. There is no obligation whatsoever anymore. Belgium seems to still have this rule.

      in Oregon there is a rule that any road junction is implied to have a pedestrian crossing, whether it is marked or not, unless it is specifically posted that it is not a pedestrian crossing. it is also a rule that a driver must always give way to a pedestrian wanting to cross at a crossing; unless there is a traffic light or other traffic control, at which point, everybody must obey the traffic control.

    In my experience, jaywalking is no more dangerous than crossing at a crosswalk with a lighted “walk” sign. Drivers just don’t notice, don’t care, or even become aggressive when they see pedestrians or bicycles. No matter how you cross a busy road, you need to assume everyone wants to kill you - if you start with this assumption, you will not be disappointed.

      The tide is turning. Washington state is removing the "right on red is allowed" law in heavy pedestrian areas, so places like school zones and shopping centers. The logic being that cars wind up hitting people in crosswalks because they think "I can go on red, I don't have to think about it." I'm talking about when the cross sign is white. People just don't stop on right-reds a lot of the time.
      It's good that we're finally removing all these lobbied pro-car laws that only exist because car companies lobbied to get foot traffic banned. Jaywalking, quite literally, was a term that was made to shame walking pedestrians.

    Only times I have almost been hit crossing the street, I was crossing according to the letter of the law, when the crosswalk light was on for me, and cars were supposed to yield. But people were in too much of a hurry or just didn't care that I was already out in the crosswalk and went anyway - even cars that had stopped for the red light or just went right through as if there wasn't one. Usually they were in big cars that were so tall that the front end nearly comes up to my shoulders, which makes it extra dangerous.
    Meanwhile, every time I have crossed against the signal, I have not had this problem, but of course I am doing it when there is a lull in traffic.
    I also noticed every time I bring this up people try to look for a way to blame my behavior when I did everything right - hence why these were near-misses rather than collisions - rather than people behind the wheel in too much of a hurry, driving oversized vehicles with dangerous blind spots and not having *any* regard for the rules of the road or the responsibility inherent in driving such a massive machine.

    I can't count how many times I've had to jump out of the way of a car when I was legally using a crosswalk. Either from them turning or just running a stop sign or traffic light. I've even dealt with drivers cursing me out and honking when they tried to turn right during an all walk signal and there's a massive "no turn on red" sign. There's a 4 way all stop intersection in my neighborhood that is notorious for people running through so I prefer to go a block down the street and jaywalk. That way I only have to look in two directions for traffic instead of having to figure out if the people are going to actually stop or if they're turning and just not using a signal. I've almost been hit at that intersection even as a driver so it's not like they just can't see me.

    Great video! I appreciate how hard it can be to talk about jaywalking in the US because the topic can be so heavily politicised over issues like racism and car centrism, and I think you handled it very well by saying grounded in the practical effects of the law as it currently stands, and the impacts on pedestrian and driver safety.
    As a Brit I do often have to be careful abroad since jaywalking laws pretty much don't exist here, you can only be arrested if you are walking on a motorway, or anywhere where a "no pedestrians" road sign is present. In terms of crossing the street you have no obligation to cross at a pedestrian crossing or obey the pedestrian crossing signal. However, if you are hit by a car who couldn't have reasonably stopped in time then the driver can't be charged with a crime and you won't win suing them for damages, and if you stop in the middle of the road for no good reason and hold up traffic, you absolutely can be arrested for "obstructing the highway".

    It is important to remember that the jaywalking laws at the time was largely placed by legislatures lobbied by auto interests. Pedestrian safety could have easily been obtained by stricter licensing requirements and speed governors.
    This decriminalization of jaywalking is a step in the right direction, since it slightly shifts the responsibility of pedestrian safety to drivers. Ironically, car technology has gotten to the point where we can in theory have speed limiters based on the current speed limit.
    Keep up the good work. I hope the state I moved to, New York, takes a hint from California and largely legalizes jaywalking.

    • @CRneu
      @CRneu ปีที่แล้ว +3

      another important thing to consider is that the braking systems on early cars, really cars up until the 1960s, were absolute garbage. Cars quite literally could not stop. So instead of creating better braking systems they just lobbied to get foot traffic off the road.
      Since you mentioned speed governors being reasonable with today's tech, the NHTSA is trying REALLY hard to make all SUVs and Trucks in the US have emergency auto-braking systems. The reasoning is that trucks and SUVs kill more people in what would otherwise be routine traffic accidents. So what should be a small fender bender turns into a fatality because some dumbass has to drive a giant vehicle.
      Vehicle size is also why everyone complains about headlight brightness now. Try driving around in a small hatchback sometime. Almost every SUV/Truck will be basically brighting you. This gets even worse if you live in an area where "truck culture" means everyone is modifying their trucks without adjusting their headlights.

    I got a jaywalking ticket in Hollywood in '89 (crossing Ivar half a block from Hollywood). Motorcycle Cop saw me in his rearview and was either having a bad day or hadn't met his quota. Went to court to fight it and tried the old driving school trick to get out of paying anything. Judge said there was no such thing as "walking school". Whole courtroom got a good laugh but he dropped my fine to $50. Another LA Cop let me off for vagrancy once - I wasn't homeless or anything, I was 17 and didn't have a drivers license or state issued ID yet. So, California is aligning with the Canadian practice. In Ontario, pedestrians should cross the road only at a designated crossing if one is nearby (which is not defined, but I have seen lawyers and police online say about 30 m away is considered the limit of being near). If crossing otherwise, pedestrians should not interfere with traffic. Otherwise, it is cool. And if you are crossing while the light switches from green to red, you still have the right of way.

    12:00 that's basically how some of our rules here work - it's legal to lane filter on a motorcycle on a multilane road, so long as it's safe - This stops you from getting fined simply for lane filtering but if you get into an accident while lane filtering it brings heaps of scrutiny to the rider because it's clearly not safe (the argument becomes then "was it safe when they started lane filtering, etc, etc")

    The fundamental problem with American culture is the idea of personal responsibility being the end all be all of anything that happens. Instead of building infrastructure that makes it physically impossible for cars to hurt pedestrians the pedestrian (and sometimes driver) is blamed. Where are the raised cross walks, pedestrian only zones, narrowed streets, bollards etc.? Easier to change infrastructure than fallible human beings. Signs and paint are NOT infrastructure.

    • @rogerwilcojr
      @rogerwilcojr ปีที่แล้ว

      I disagree. It is much easier to teach children right from wrong when they are young, and enforce it with a good swat on the backside. The problem is that this is not being done anymore. I've seen pedestrians cross under pedestrian bridges, and they had to climb walls to do it, but it was faster and easier than doing it the right way.

    • @CRneu
      @CRneu ปีที่แล้ว

      @@rogerwilcojr you basically just said "beat your kids instead of building sensible infrastructure." stop advocating child abuse. "The problem is people aren't abusing their children anymore" is peak idiot-american speak.
      If there's a quicker way to cross something then that's poor design from a foot-traffic viewpoint. "but it was faster and easier than doing it the right way" is a weird way of saying "the pedestrian bridge was poorly designed and implemented" When things are designed with humans in mind then human behavior needs to be accounted for. When it isn't accounted for then people won't use it as designed. That's not a reason to BEAT YOUR KIDS.
      Stop advocating people blindly follow rules that aren't well thought out. That isn't how humans operate or approach problems.

      Not enforcing it doesn't work and most of the arguments against it are specious. Blaiming the enforcement of the law for people killed for stealing a cops gun and being shot as a result is a stretch at best. Since the local cops stopped writing jaywalking tickets and making the guilty go to educational classes, it's been a mess. I've nearly hit morons who were wearing all black and were completely invisible apart from where they blocked the light coming back from the lane markers. That is inevitably what happens and yes, that would still technically be illegal, but you don't get the opportunity to intervene while some education might make a difference if it's not allowed for officers to use it as their primary reason for contacting the jaywalker.
