    If this is what they are doing than yes they should be held accountable . No one should be manipulated into purchasing overpriced accessories and home goods just to be considered to buy any bag . Way too much snob factor for my liking . It does drive me crazy to think women make videos talking about how they sell their pride to buy a Birkin or Kelly and then and how they feel so blessed that they were chosen by the Hermes god to buy one .

      I hear you. I think I read some notes from the case that those clients spent a ridiculous amount of money on numerous occasions. The smart thing to do was to stop and just buy from a reseller. The premium they’d pay would have been less than their pre-spend. BUT the emotional side of that would be that doing so would take away from their desire to feel being “the chosen one.” Brands profit from messing with us emotionally.

    I know a lot of ppl say “ oh its not that deep. I never was one to complain. BUT after shopping with my SA for over 1.5 years who is super nice guy. I was getting bride a bracs, picotins etc. I spent over 25k ( not counting bags) just on jewelry and home stuff. I also have a friend who shops as much. And he keep asking her to but coat to increase chances. But she doesn’t line the coat. And doesn’t want it. I understand spending to get a birkin we all accepted this but like has to be drawn somewhere.
    Last time he told me “ oh I am so torn between you and your friend I don’t know who should get bag first. Buy a watch” mind we want completely different bags. This dirty games just turned me off. To be honest I don’t want birkin that badly I much rather buy a chanel flap.

      To be honest, I feel I been played all this time by my SA. I feel I been being string along with continue spending but still have not been offered any quota bags. My current ratio is 5:1 and no offers as of yet.

    They are not protecting from reselling by doing that. They have created this "resale monster" with desirable products that very, very few of us can get. And the result of this alleged "link selling" is that they feed the resale market because people prefer buying from resellers even premium to have the exact bag that they want when they want.

      yeah the resale sites/stores aren't lacking in birkin and kelly stock. i think hermes and chanel make up the majority of their stock.

    Great video diving into this topic! I have also heard reports from shoppers saying that SAs have told them a *specific amount of money* they need to spend in order to buy a B or K. Unfortunately (for the consumer) H corporate has been very careful about what they say or do regarding linked sales - cue the cashier sign you showed. So I think it’ll be hard to prove in court, and if push comes to shove they’ll throw SAs under the bus (no pun intended lol). Just my opinion obvs. 😄

      I think we're all secretly wanting this. But I also think that the relationship between that client and that store/SA is probably very problematic and maybe that staff is unreasonably taking advantage of these customers. I definitely don't think this is reflective of all Hermes stores.

    On point video about this topic and your discussion regarding linked sales! I live in California and have purchased from my home store in OC and while on vacation at the Hermes stores in Las Vegas, Miami, Lisbon and Paris. I have specifically been told by an SA in the US to have more of a purchase history (they cannot link or see my EU purchases) and proceed to take my wish list. I veer on the side of believing that if I stuck with an SA and purchased from the same store, chances are better for the quota bag in the US. Overall, I do appreciate the Hermes quality and colors of the multiple items in different categories, that I have purchased over the years, and enjoy popping into the stores that are in the cities I travel to.

      Well said! I am the same. I shop in a few different stores while travelling - simply since I enjoy shopping while on vacay - it's more relaxed since I'm not rushing to tend to may usual duties. Also, different stores have different stock - if I really like something I'm not gonna hold back. I really wish the systems did get linked so they can view globally what you've bought. Dior and LV have that and its so nice when an SA can pull up your profile and can look up past purchases. Makes this a lot easier when it comes to repair or service requests.

    i been on a waiting list for 6yrs i've only purchased a baby blanket and baby clothes and perfumes no call nothing i think they should get sued it's discrimination they can't really do whatever they want as no one can in reality it's exactly in comparison to racism and extortion

    it'll be really interesting if they can prove the implicit v explicit case for this. honestly aside from not being ready to buy one if offered. the very idea of "the journey" has put me off from every buying from Hermes outside of trying my luck in Paris. Also i'd have to shop in LA, which would be a lot of competition. Like if i want something from Fendi (granted i have a relationship with an SA there now), i can just ask and they'd let me purchase it. It's a lot less stressful.

    The company is going to deny their involvement in the quota situation saying their S.A.’s did it on their own probably knowing good and well that they encourage their associates to make the customers play the game. But nothing is in print so no one can really pin it on Hermes. They know what’s going on even if they are turning a blind eye (of course they would it’s good for business) they can’t be that “dumb” and blind that they don’t know what is going on in their own stores. I hope the lawsuit nails them. This situation is out of control 😅

      Oh absolutely. While corporate doesn't formally condone link selling, there is heterogeneity amongst staff members within and amongst boutiques who exercise it.

    I’ve seen vlog footage of people looking at scarves etc and quota bags being offered “if you complete this transaction first” we all know they do it. You either play their game to get one or walk away because you dont like it, but a lawsuit seems extra, like, you need damages for the ‘suffering’ of being denied a birkin? 🤔🤪

      Lawsuits are often to require a change in practices. Not just a cash grab by plaintiffs. You have to sue to get businesses to follow the law sometimes.

    Some people go to Hermes and get their dream bag easy peasy. Some go to Hermes, get the head-to-toe judgy look by the SA then the item you want is not available. Let’s discuss the other elephant in the room-they are discriminating against who to sell their bags to. It is what it is. At the end of the day it is JUST a bag. Give your money to a brand that will treat you better. Maybe Dior, maybe Lous Vuitton. Whatever it is, it is not Hermes. Life is too short for games like this.

      Very well said! Also, if this commission structure factor is heavily weighted, some SAs may take advantage of those clients who appear super desperate and have the funds to buy erroneous items.

    i was near my Hermes boutique monday. i wish i would had gone and tried to score one now that this is out lol. because last time I went I was told I needed to show love for the brand, that I wouldn't get one as their asian customers spend more and they get them, I was better off going to the real real to get one. i was shocked. also if Hermes justification to not tying is they only give to those that love the brand or want to lower reselling, then tell me why there are so many Bs in the resell market that are brand new! not much love I see. i hope they get their sales data and show x customers spent x and got a B versus those that didn't spend got no bag or were only a low amount of customers.

    I think this is one of those cases where the intention is more so to change the business practice as a whole… And set the precedence For any other brand that wants to transition their business model similar to Hermes. (Think about the luxury car and watch industries)
    Let’s be honest, the system has really gotten out of hand, and with the use and access to social media… It’s hard to avoid the elephant in the room with the subtle link-selling. There’s just too much information out there of folks sharing their experiences.
    Hermes is also not clear about what makes a client “loyal” … the metrics is clearly not consistent. What makes one person more “worthy” of a bag over the other? Because now you will have another situation at hand - Discrimination. Why does one person have to spend 2:1 3:1 or even 4:1 to get offered meanwhile another is spending 1:1 or 0.5:1??
    I’m sure if the clients didn’t have viable proof there wouldn’t have been an effort to pursue this case.
    I will say this might be a great time to shop at Hermes now - Since I can see the sales associates and the stores tiptoeing until this case has been resolved🤣🤣

      Excellent insight! Yes, I agree, it’s likely they do have some concrete proof that will back their case. But, I think Hermes will wash their hands and throw their SAs and managerial staff of said store under the bus. The system has definitely got out of hand over the last few years.
      I also see that other brands implicitly link sell hot, upcoming bags to more loyal clients (big spenders or clients who purchase high ticket items, like fine jewelry and ready to wear). So it’s a very grey area.
      Let’s see what happens. Will this Sherman law apply to luxury items? Perhaps this case, if it gets far, will set precedent or it may give an example of where this law doesn’t apply.

    Why do you want to spend your hard earned money on a bag that is heavy and clunky and will get you killed walking around town with it??looking at you Birkin! Don’t understand the hype or the demand. But that’s just me and my opinion. 🤷‍♀️

    Great coverage! I went into Hermes last year with my husband. He asked for a birkin and I was terrified. But she basically gave the vibe that they had bags, I just needed to name the particular combination I guess. I didn’t entertain the conversation further and before leaving she said if I was interested, we can start a wishlist. I already felt dumb for not knowing the exact terminology that I said “maybe next time”. Honestly, I think it may have mostly been what I’ve heard on socials that maybe interfered with what was actually happening to me at the store that day. (I never gave my name or details so she didn’t know if I was a spender there or not.) 🤷🏻‍♀️

      This is an excellent point. I think peoples experiences at select boutique have set a precedent for all of us on social media whereby we all assume that their experience will be ours. Every boutique and its staff can operate differently - some may operate out of their policies and take advantage of clients. And other SAs don’t.

    As the owner of a dozen designer bags (Chanel, Fendi, Gucci, Celine, Vuitton, Meniere), I don't own a Birkin or Kelly and am a bit baffled as to their value, other than exclusivity and any elan that confers. You own some of these bags and Chanels, etc. Do YOU see a material difference that makes the Hermes bags worth these astronomical prices? I sincerely am curious.

      So I addressed this when I first unboxed my pink birkin - I said that yes, they are beautiful, but I didn’t see a stark difference that would award such high prices. And I got ripped apart by some people in the purseforum who called me “ungrateful” lol.

    Imao their VIP or VVIP are most likely the resellers. Most of them are because I’ve seen on resellers web pages plenty “rare” bags that the brand surely won’t sell or even think to offer to a commoner client like me 🤣✌🏻 So the evil is in their adored high spenders VIPs

    This is giving posh Karen energy - what is the expected outcome of this case? Do folks want compensation for the money they’ve spent on silk scarves and sushi plates, signs in every store like those in Canada or Hermès dropping bags like Telfar?
    As a handbag lover and luxury shopper, I would never say that these are frivolous topics but for me this really isn’t a moral issue and legal action is the epitome of ‘doing too much’.
    If there is a bag and it’s reserved for a client who shops in the store often, que sera sera. No one is forcing you to shop at Hermès, buy ‘Birkin bait’ or to go on a ‘journey’.
