The real takeaway is the fact that 99% of well educated Americans know all this, even though their knowledge might be subliminal, but many ignore the implications and results as they feel they can avoid the downsides. The salvation is in the fact that the next generation will not produce enough blinkered individuals to maintain the critical mass of apathy required for this system to feed upon itself. In France, we have been struggling with president Sarkozy prosecutions and trials for more than a decade now. I would love to see you discuss the matter with the french journalist Fabrice Arfi, head of the investigation departement of the free journal Mediapart. His journal revealed some of the President affairs, he is a clear expert on the topic and he is an adorable human being.
Ex--President Jacques Chirac was convicted for putting his party staffers on the city payroll when he'd been Mayor of Paris years earlier. His party repaid the equivalent of the salaries. Sarkozy's stuff is more complex.
It seems there are healthy democracies (relatively healthy, there are major headwinds everywhere) that are willing to prosecute major politicians like France and South Korea. And there are also those who do not, usually for fear of bad outcomes. The US is attempting, seemingly, compelled by massive and obvious criminality, to transition from the latter to the former. I think looking at countries who do it without major breakdowns is informative, but perhaps not as much as looking at others who have transitioned.

I would suggest that we use the term "organized crime" for corporate crime, which is an entire system that encourages crime. "Mob crime" is a mirror image of corporate crime.
Beautifully said! Organized crime doesn't necessarily mean everything they do is illegal. They might have a front that does make legitimate revenue. Corporate crime is a decent term, but sadly it isn't often associated with the pain and devastation caused to the victims. To go on a tangent for the sake of an analogy: If you embezzle a million from your local hospital, shouldn't that be paid back? And should you be responsible for pain caused by lack of resources? How about if you directy steal a thousand bucks in cash from a lonely grandma, and she can't afford her medicine? Why should corporations NOT be responsible for pain even if indirect? And now they get slaps on the wrist where they aren't required to pay back what they stole, let alone having to pay more as a punitive measure. Hospital embezzlement probably gets you in prison and you get a fine. Grandma stealing gets you in prison and you pay damages. Corporate fraud, charity fraud, embezzlement, misleading advertising, union busting... aren't being tackled because there's a sense of disconnect from the pain.

But I’m curious to know what your opinions are on how well non-violent felons do when they are put in prison? After their sentence they just don’t reoffend? Or did it lower the chances of them reoffending when they are given probation and can still get a job and try to become functioning members of society? Perhaps corralling felons on the people’s dime so they can sit around not make money, be isolated from society, only have other criminals to converse and connect with, does not give them a great chance once they are released. But maybe I’m just a problem solving kind of guy rather than opposition for the sake of opposition. Can’t expect you to get it.

Good education is the key. When I graduated high school MANY years ago, I not only had a mandatory government course to take in my senior year so I understood how it all worked but the class had any student who was 18 walk in a class trip to the town hall and register as a voter at the end of the school year. I still remember how grown up it made me feel and the responsibility I had to vote. I have never missed voting in an election.

Graduated in 1986, senior year we had 2 courses in US History and Politics and Society, and we had to go to 4 (each) school board and city council meetings. We also were given extra credit if we went to the USPS to register to vote. Sadly, I was a newly turned 17 yr old senior. Our midterm was writing a Bill and trying to pass it as legislation. Our final was an essay…‘an alien being touches down on Earth and asks us to explain our government’…we had to describe, in depth, our 3 branches of government. I believe ALL American schools should have this as a graduation requirement.

Dr Goff’s grasp of data is amazing. I was the lead teacher in a high school whose niche was credit recovery, some by court order. We had some bad actors, no question, but their transgressions were petty and they were mostly salvageable. Prior to my retirement, I spent 40 years as a banker/financier in the joint venture genre. I encountered scores of crooks. They were invariably stealing millions, and in my judgement incapable of rehabilitation. Hell you’d run into them in country clubs after they were caught. Makes a body proud🎼
Three things: 1. I grew up occasionally hanging around country club types--executives, lawyers, bankers--because my Dad was the Vice President of a private school which their kids attended and of which they were often alumni. They were almost always very smart, business-minded, and friendly but in a really distant and superficial way. They loved drinking and you could smell the stress and the heart disease any time you went to a party. And there was a shiftiness to some of them and though I'm not aware of any of the people that I knew doing white collar crime, it wouldn't surprise me at all if a lot of them were involved in very complicated and shady business transactions. But that's just an impression. Who knows? 2. I retired several years ago after working for many years as an HR adminstrator and executive. My working experience with high level CEOs is this: they are, nearly always, high-functioning sociopaths. Why? I don't think you can effectively run a complicated organization and make difficult decisions unless you are somewhat sociopathic. That's just the way it is. 3. A guy who I was very good friends with about 20 years ago (we've drifted apart over time) has since become the CEO of a cosmetics firm. He came up through sales. He smoked weed everyday on the job and to entertain clients blasted coke and drank like crazy with them. He ran up huge balances on his expense account, but he could justify the expenses because he was crushing it by bringing in business. He would be super friendly and have fun with male colleagues in his industry and then turn around and sleep with their wives. He was a great guy to hang out with. But I wouldn't trust him as far as I could spit.

To the point made towards the end of the podcast, the lack of elite accountability also encourages more bad actions by elite. If the consequences for criminal actions are minor or missing then many people will try to game the system when the potential upside (lots of money, prestigous university positions) are so great. We are, in effect, rewarding bad actors.

For so many years, I've been saying white collar crime is so much worse than any other crime. Perhaps with Trump's indictment, more people are becoming aware of how bad this is and how politics is so tainted by these crimes affecting your personal life.

I'm a young GenX. I'm also a black woman. I grew up in the 80s, and was under the impression that we were a post racial society. I attended well funded schools and graduated from a college prep high school. Often tested in the top decile on standardized tests. It wasn't until I entered the workforce was I aware that maybe things weren't so equal. I don't think any generation that is living while Trump is still alive will be salvageable. Honestly, I don't think the US of A will still be a first world country a century from now; the proletarian and middle class are delusional.

White-collar doesn’t want to sue white-collar. For over 30 years, I did expert witness work in the world of Construction litigation. I am (retired) a general contracting construction expert. Again and again, and again, I would see when the architect and their team had made mistakes the attorneys would “explain” why they weren’t as important to sue as the blue-collar guy who put the bricks in out of alignment. I pointed this out many times: the attorneys just denied it was true and smiled and the builders just “cried.” Thanks for a very informative discussion.
I got a deferred prosecution, for something I didn't even do. I got obstructing a felony investigation for telling the truth that destroyed the DA's case.
@Martcapt , it's not that exciting. When I was 17, I sold a bag of weed to my friend. He was getting it for someone else who, in turn, wore a wire on him. Well, the police were targeting my other friend, whom he was supposed to get it from. The buyer lied and said it was my other friend who sold it to him (who wasn't even present, and he wasn't friends with). He literally had nothing to do with any of it. I didn't even buy from my friend. Well, I am around 21, and stop by my friend's house and he is freaking out because he being indicted. They investigated him for four years and had that one charge against him, but he had two from when he was 16, so this was three strikes and you're out. He was not guilty. I read the statement, and remembered that night exactly. Talked my friend that snitched, and he confirmed it was really me but they wanted my friend and he didn't want me in trouble (I may or may not have punched him in the head with keys, he was lying to put a friend in prison). Then I gave a truthful statement to the police against myself for selling the bag. The DA realized he couldn't win the case with my testimony, so he offered a plea deal to my friend that was nothing but a charge, no time, no probation, nothing. My friend took it. Then, the DA charged me with obstruction of a felony investigation. I had to write a letter to the DA every month for a year giving updates on my living status, occupation, and do 100 hours of community service. It was all pure corruption and bullshit. My friend they were targeting made it through the bullshit, works two jobs, owns his own home and has a fmily now. They would have ruined all of that, just for conviction rates.

I really didn't think anyone in the media would ever connect the dots like this, I am SO glad you did Jon, and brought these guys on!
This was so well explained through this debate. They brought a major issue claimed by lowly citizens, on all sides of the fence, and tackled one of the major smokescreens in place to avoid not only the real solutions, but keep the narrative so they will be unwilling to see through them.

Easily one of the best podcasts around. It's really crazy how informative these episodes are.
In France, we have been struggling with president Sarkozy prosecutions and trials for more than a decade now. I would love to see you discuss the matter with the french journalist Fabrice Arfi, head of the investigation departement of the free journal Mediapart. His journal revealed some of the President affairs, he is a clear expert on the topic and he is an adorable human being.
Ex--President Jacques Chirac was convicted for putting his party staffers on the city payroll when he'd been Mayor of Paris years earlier. His party repaid the equivalent of the salaries. Sarkozy's stuff is more complex.
Great idea.
It seems there are healthy democracies (relatively healthy, there are major headwinds everywhere) that are willing to prosecute major politicians like France and South Korea. And there are also those who do not, usually for fear of bad outcomes. The US is attempting, seemingly, compelled by massive and obvious criminality, to transition from the latter to the former.
I think looking at countries who do it without major breakdowns is informative, but perhaps not as much as looking at others who have transitioned.
@@jsrodman Yeah, don't get too exited about France, political and white collar criminality is mostly ignored here too. In fact, as a French, I never thanks NYC enough for stopping us from electing a sexual predator as president in 2011.

Walmart settled in the BILLIONS for their role in the opioid epidemic and no one was held accountable. But they’ll want to see your receipt upon leaving their establishment in certain neighborhoods.
Please don’t get me started on Walmart. They don’t pay their employees a living wage. Many Walmart employees need government benefits to make ends meet. That is insane.

We, the people, don't stand up and fight anymore! We hear what is going on. Like Walmart, and we shake our heads and remind each other how greedy these people are and the system is one-sided, etc. Yet many people still shop at Walmart, they still keep their money in certain banks. They vote for those running for office when they know they are crooks. We don't come together anymore and oppose the system together. Boycott, sit-ins, etc.

I would suggest that we use the term "organized crime" for corporate crime, which is an entire system that encourages crime. "Mob crime" is a mirror image of corporate crime.

Beautifully said! Organized crime doesn't necessarily mean everything they do is illegal. They might have a front that does make legitimate revenue.
Corporate crime is a decent term, but sadly it isn't often associated with the pain and devastation caused to the victims.
To go on a tangent for the sake of an analogy: If you embezzle a million from your local hospital, shouldn't that be paid back? And should you be responsible for pain caused by lack of resources? How about if you directy steal a thousand bucks in cash from a lonely grandma, and she can't afford her medicine?
Why should corporations NOT be responsible for pain even if indirect? And now they get slaps on the wrist where they aren't required to pay back what they stole, let alone having to pay more as a punitive measure.
Hospital embezzlement probably gets you in prison and you get a fine. Grandma stealing gets you in prison and you pay damages. Corporate fraud, charity fraud, embezzlement, misleading advertising, union busting... aren't being tackled because there's a sense of disconnect from the pain.
Since when do “billionaires” need to beg for money for defense fund or whatever grift he’s running right now. You’d think his cult would at the very LEAST catch on to that.
He is their guy, no matter what he does or doesn't do. The Republican party has convinced them that the Democrats are their enemy, so it no longer matters how much Democrats do for them as long as they get to "own the libs".

Only violent interactions involving White cops and young Black men are. Enlighten me with your little brain though. What is the one side's solution to this class war? Ending capitalism? But I’m curious to know what your opinions are on how well non-violent felons do when they are put in prison? After their sentence they just don’t reoffend?
Or did it lower the chances of them reoffending when they are given probation and can still get a job and try to become functioning members of society?
Perhaps corralling felons on the people’s dime so they can sit around not make money, be isolated from society, only have other criminals to converse and connect with, does not give them a great chance once they are released.
But maybe I’m just a problem solving kind of guy rather than opposition for the sake of opposition. Can’t expect you to get it.

Unless lobbying/lobbyists is banned/illegal, make all forms of bribery a crime again. This country will always have the best government money can buy.
Good education is the key. When I graduated high school MANY years ago, I not only had a mandatory government course to take in my senior year so I understood how it all worked but the class had any student who was 18 walk in a class trip to the town hall and register as a voter at the end of the school year. I still remember how grown up it made me feel and the responsibility I had to vote. I have never missed voting in an election.

Graduated in 1986, senior year we had 2 courses in US History and Politics and Society, and we had to go to 4 (each) school board and city council meetings. We also were given extra credit if we went to the USPS to register to vote. Sadly, I was a newly turned 17 yr old senior. Our midterm was writing a Bill and trying to pass it as legislation. Our final was an essay…‘an alien being touches down on Earth and asks us to explain our government’…we had to describe, in depth, our 3 branches of government.
I believe ALL American schools should have this as a graduation requirement.
This is perhaps one of the greatest conversations I have ever heard. This needs to be shown to everyone because holy they distilled the problem with our society and government in a very disgestable way.

Dr Goff’s grasp of data is amazing. I was the lead teacher in a high school whose niche was credit recovery, some by court order. We had some bad actors, no question, but their transgressions were petty and they were mostly salvageable. Prior to my retirement, I spent 40 years as a banker/financier in the joint venture genre. I encountered scores of crooks. They were invariably stealing millions, and in my judgement incapable of rehabilitation. Hell you’d run into them in country clubs after they were caught. Makes a body proud🎼
Three things:
1. I grew up occasionally hanging around country club types--executives, lawyers, bankers--because my Dad was the Vice President of a private school which their kids attended and of which they were often alumni. They were almost always very smart, business-minded, and friendly but in a really distant and superficial way. They loved drinking and you could smell the stress and the heart disease any time you went to a party. And there was a shiftiness to some of them and though I'm not aware of any of the people that I knew doing white collar crime, it wouldn't surprise me at all if a lot of them were involved in very complicated and shady business transactions. But that's just an impression. Who knows?
2. I retired several years ago after working for many years as an HR adminstrator and executive. My working experience with high level CEOs is this: they are, nearly always, high-functioning sociopaths. Why? I don't think you can effectively run a complicated organization and make difficult decisions unless you are somewhat sociopathic. That's just the way it is.
3. A guy who I was very good friends with about 20 years ago (we've drifted apart over time) has since become the CEO of a cosmetics firm. He came up through sales. He smoked weed everyday on the job and to entertain clients blasted coke and drank like crazy with them. He ran up huge balances on his expense account, but he could justify the expenses because he was crushing it by bringing in business. He would be super friendly and have fun with male colleagues in his industry and then turn around and sleep with their wives. He was a great guy to hang out with. But I wouldn't trust him as far as I could spit.
A high-school specializing in *credit recovery* 🤔 Geez, what kind of education system do you have?! No wonder so many in the US are uneducated 😳 Yikes!

To the point made towards the end of the podcast, the lack of elite accountability also encourages more bad actions by elite. If the consequences for criminal actions are minor or missing then many people will try to game the system when the potential upside (lots of money, prestigous university positions) are so great. We are, in effect, rewarding bad actors.

For so many years, I've been saying white collar crime is so much worse than any other crime. Perhaps with Trump's indictment, more people are becoming aware of how bad this is and how politics is so tainted by these crimes affecting your personal life.
Everyone will, except the crazy diehard Trump supporters. They seem to think Trump is above the law.
I wouldn't hold my breath waiting for people to see white collar crimes as crime. White collar crime is engrained into capitalism and in the US capitalism is god and can not be questioned.

My biggest question is how can we reorganize people who have been systematically put into these corners that they don't even know they are in. What mechanisms could possibly in any way help break them out. Or do we just have to work with the next generation?
I'm a young GenX. I'm also a black woman. I grew up in the 80s, and was under the impression that we were a post racial society. I attended well funded schools and graduated from a college prep high school. Often tested in the top decile on standardized tests. It wasn't until I entered the workforce was I aware that maybe things weren't so equal. I don't think any generation that is living while Trump is still alive will be salvageable. Honestly, I don't think the US of A will still be a first world country a century from now; the proletarian and middle class are delusional.
generally speaking, they are not white, male, or college-educated and we do have to work with the next generation, they have a lot to unlearn

White-collar doesn’t want to sue white-collar.
For over 30 years, I did expert witness work in the world of Construction litigation. I am (retired) a general contracting construction expert.
Again and again, and again, I would see when the architect and their team had made mistakes the attorneys would “explain” why they weren’t as important to sue as the blue-collar guy who put the bricks in out of alignment.
I pointed this out many times: the attorneys just denied it was true and smiled and the builders just “cried.”

I got a deferred prosecution, for something I didn't even do. I got obstructing a felony investigation for telling the truth that destroyed the DA's case.

@Martcapt , it's not that exciting. When I was 17, I sold a bag of weed to my friend. He was getting it for someone else who, in turn, wore a wire on him. Well, the police were targeting my other friend, whom he was supposed to get it from. The buyer lied and said it was my other friend who sold it to him (who wasn't even present, and he wasn't friends with). He literally had nothing to do with any of it. I didn't even buy from my friend.
Well, I am around 21, and stop by my friend's house and he is freaking out because he being indicted. They investigated him for four years and had that one charge against him, but he had two from when he was 16, so this was three strikes and you're out. He was not guilty. I read the statement, and remembered that night exactly. Talked my friend that snitched, and he confirmed it was really me but they wanted my friend and he didn't want me in trouble (I may or may not have punched him in the head with keys, he was lying to put a friend in prison). Then I gave a truthful statement to the police against myself for selling the bag. The DA realized he couldn't win the case with my testimony, so he offered a plea deal to my friend that was nothing but a charge, no time, no probation, nothing. My friend took it.
Then, the DA charged me with obstruction of a felony investigation. I had to write a letter to the DA every month for a year giving updates on my living status, occupation, and do 100 hours of community service.
It was all pure corruption and bullshit. My friend they were targeting made it through the bullshit, works two jobs, owns his own home and has a fmily now. They would have ruined all of that, just for conviction rates.
