  • The trucking market is down, and as things become more challenging, people become more creative in bending or breaking the rules. Some carriers choose to ILLEGALLY hire B-1 Visa workers from Mexico to haul within the U.S. which in turn costs US truckers jobs, and drives rates down.

Speaking from personal experience here. I just left working at a walmart meat and produce dc in central florida. I was a back up yard driver, but when i wasnt flipping trailers, i would take drivers paperwork to them so they could leave quicker so we can keep the flow of trucks going so everyone made their appointment times.
Im not being overly dramatic right now, well over HALF of the drivers that i would wake up couldnt speak or understand ANY english. To put the term half into perspective, we would do anywhere between 95-115 trucks in an 11 hour time period.
Thank you for making this video, as it makes sense for what i was seeing with my own eyes!

They need to get on everyone. Too many American Truck Drivers do things that make it worse for themselves. Too many Drivers were busy chasing the money to pay attention. How many Drivers speed, work off the clock, bypass scales, Carry too much weight? Working too fast, not logging in and carrying too much weight is a sure way to take work from someone else and eventually your self. Truck Driver greed is part of the problem.
Fueling your truck during your first 30 min break is helping the company. If 28 Drivers do this, why hire the 29th. I think it’s better if Drivers fuel the truck, park and then take the 30 minute break. Actually that time is better spent by taking a walk for exercise. If 28 drivers actually used their 30 minute breaks like it’s meant to be, the company would need to hire 2 more drivers to get the same amount of work done. Companies are taking advantage of Driver greed and Drivers are working themselves out of their jobs.

The real prison issuing CDL licenses to non English speaking individuals here in America. You are required to "speak and interpret the English language ". It's in the FMCSA book. It has destroyed the freight market. On top of they are getting a pass at scale houses due to the language barrier. Seen it happen with my own eyes

If you read the regulations, it only applies to drivers involved in interstate commerce. So a non English speaker is legal to get a CDL and work in intrastate commerce. In California where they do not have a farm exemption, the farm workers are required to get a CDL.
The problem comes when that person is laid off from seasonal work. Then they go OTR.

I live in Texas and here’s another scoop on what’s going on here. I have a friend that runs a wrecker and he went to a roll over and the driver was an illegal with no driver license. They wrote him 10 tickets and turned him loose. The owner of the truck paid cash for it and just used the dot numbers on the side. When they called him he is in Mexico and told them to just keep the truck and trailer because he has no insurance. I have another buddy that hauls rock and he said the other day dot put 77 trucks on the hook out of one quarry. This was all illegal”s, no dot #”s or no insurance. This is why they can haul it for cheap and we can’t.

I used to work in the oil fields and the amount of drivers with international licenses from Mexico was out of this world. I don’t necessarily blame the drivers who are trying to provide to their family, even if illegal, but the companies, the politicians, the insurance companies that are turning a blind eye to the problem that is so evident in their face. The way they would do it is through someone that has their own authority who adds these illegal drivers to their policy and then works for the carrier. Texas passed a law last year but it is not enforced consistently. I would say add criminal liabilities to insurance and companies playing the game of willful blindness and vote the politicians out that don’t do shit to protect the American truck driver. These Mexican international licenses are purchased, so it is also a dangerous practices to allow drivers who often times don’t even have the training.

More Canadians are currently involved in such act. Not to be racist but the panjabi companies are in full throttle in such activity. They come here and work for months before heading back.
How? Simply by revising the BOL and changing the pu location to out the country location every single time. So that it they ever get inspected BOL has already been plagiarized.
While paying them $300 per week. So that how they can afford the cheap rates.
Fmcsa / government NEED TO DO SOMETHING ABOUT THIS. because if not it’ll only get worse and turn this country upside down.

Great show. Love to hear your opinions. I have been a truck driver in the trucking business and import-export since the '90s in Laredo. The ups and downs of freight have always existed, even before the B1 drivers. I remember when we first blamed the brokers when they entered the market and drove down the rates. Later, we blamed the owner-operators for taking cheap loads, which undercut the big companies with significant overhead during the economic collapse.
I don't believe the B1 drivers are the cause of the cheap rates at all, but they are a good scapegoat. It all boils down to what you said in your last show. We still have a huge surplus of trucks that came in during the golden time of COVID-19. Everyone wanted in. I am confident that all will bounce back up again like it always has, but not necessarily with a supercharged comeback like during COVID-19.

I’ve mentioned this in comments on your previous videos but concentrated my invasion comments on the most recent influx of Euros brought over to fill the mythical driver shortage and of course many of them Illinois based are misclassifying employees as 1099 contractors to dodge taxes and benefits that a carrier is required to pay with a W-2 employee. I have stated for years that not only are Canadian carriers violating cabotage laws but that they should stay in their own country and drop in a border zone like Mexican carriers previously were all required to do. NAFTA was such an American job killer and wage suppressor that it wasn’t until TRUMP’s presidency that it got renegotiated to make it more “fair” for the US. I remember roughly 20 years ago I and a French speaking Canadian Fed Ex Contractor were brought into a Nebraska state scale for a level 1 inspection and since the DOT officer couldn’t communicate with the Fed Ex contractor driver because he couldn’t or wouldn’t speak English so instead of putting him OOS let him go and then settled on tying me up for 30 minutes because a “no Hables” excuse wouldn’t work for me. It’s like you summarized, it’s not just one thing but a combination of stupidity , incompetence and outright criminal behavior by politicians, bureaucrats and industry bad apples! I am a retired flat bed driver, For the two years before I retired in 2018 It was common to see a driver who could not speak English Come in and hand the shipper or the receiver a phone,
He would speak to the person on the phone in English than hand the phone back To the driver, The driver Would then speak to the person on the phone, Usually in an eastern dialect, Russian ,etc; Then hand the phone back to the receiver or shipper, Who would talk to the person on the phone in English.

As a Company Driver, the problem I'm running into is trucking companies buying up short haul runs with a live load on either or both ends a forcing drivers to take those loads at base rates. Effectively, they are running their trucks at 1500 miles per week while generating revenue like they are running double or triple the miles but with half the expenses, while their drivers are starving. Not a Win/Win Scenario.
Next, these Trucking Companies who need drivers are assisting in their own financial suicides by eliminating drivers from consideration because of too many employers who overpromised & underdelivered or who actually terminated an employee who complained about the low miles & pay, because they knew many competitors wouldn't hire those drivers who had been terminated. Additionally, MegaCarriers with extra trucks are hiring drivers like crazy, knowing they can't keep those drivers profitable. They are Effectively taking Chess Pieces off the Board, because anyone sitting in their trucks starving or who have been Effectively Blacklisted can't compete against them with other companies.

FYI: many years have passed since the FMCSA regulation under Part 391.11(b)(2) was downgraded from an OOS (out-of-service) vio to a minor vio for English Fluency (reading sufficient English & speaking it.) This regulation was initiated due to 911. Officials didn't want to lose time communicating with or detouring foreign drivers when & if there was a HAZMAT related incident, or even just to ask if they were hauling HAZMAT if they stopped a CMV.
The criteria is in an FMCSA pamphlet and the test is open to interpretation by each official, but the FMCSA offers basic guidelines of the test as it relates to trucking inspection, road symbols, and questions about what is your name; who do you work for; what are you hauling; what is your destination; & the like.🤔

Im Mexican American, my Spanish has an accent to it so Mexicans can tell right away that I’m American. If unloaded at border cross point the Mexican drivers will pick up loads up and transport the new load anywhere in the U. Mexican drivers will work for about 90 days at a time as team drivers. The driver cross into Mexico for a week or two and start all over again. And here is an open secret. ELDs...or controlled by in Mexico. Driving hours NEVER run out.

I enjoy your analysis on this subject but you're missing the wider spectrum here.
The real subject should be the amount of immigrants coming to this country either illegally or legally and then saturating the trucking industry.. as we both agree there is an over capacity of drivers.. this is # solely# due to the massive influx of immigrants, illegal or not into the trucking industry... The government is to blame in a large part because of all the years they've been saying there's a trucker shortage when there was not.. Trucking companies have given false information to the government for years in order to saturate the market with cheap drivers.. trucking companies where recruiting outside of the US frequently in the last decade..not only do they have more drivers to choose from, but they can pay less.. you will notice in the past 2 years that the starting wage of trucking companies has gone down between 5 and 8%.. this is in a relatively moderate to high inflation environment.. some trucking companies have asked for significant wage reductions from their drivers.. insurance companies are now mandating AI inside facing cameras or they (the trucking client) will be dropped.. they also have a role to play in this fiasco.. safety standards are becoming more rigid for new hires due to the fact that there are now so many drivers in the pool.. the ATA is promoting more safety which would involve experienced drivers being dropped out of the market and replaced with fresh immigrants with clean new driving records disregarding whether or not they can speak English or are used to driving on American roads..
Countries like Australia protect their citizens from this type of behavior by having a government list of the occupations needing to be filled in the country.. if your occupation is not on the list then you do not immigrate then unless you have around a quarter million dollars.. you will just have to wait..

The Companies that are doing this are breaking the law. So, how does this get fixed and corrected in the US ? Well, in my opinion all of the Owner Operators and Company Owners that are not involved with this B-1 Visa Game should allow all of their drivers along with Owner Operators to stand up to our Government and show these Government Officials who truly pay their wages which are the American People. Until we all ban together it will never change and the Government will always get richer while we get poorer. Anyone else have a take on this and what I said ? It is becoming a sad situation here in the USA and I am a Veteran who is not happy with our Government and allowing these illegal things to go on and not protecting our Borders or doing what is right for the American people that put them in power. Check and complain more. Some B1 (LF) drivers make as much per mile as a CDL driver. This income supercedes that of what a doctor or dentist makes in Mexico.
The clincher: the B1 guys aren't obtaining ITIN numbers and paying federal U.S. income taxes. Some are hired by a third party in Mexico, then leased out to a U.S. company. Others are hired directly by a U.S. double-plated trucking company as a 1099 or cash only paid driver.
The IRS is losing out on millions of dollars of revenue!
Another clincher: there's no nationwide database to perform an MVR on a Licencia Federal driver. An LF driver with multiple citations can be allowed to drive by an insurance & trucking company because their record looks clean. Yet, a CDL driver with 1 or 2 citations can be prohibited to drive under the same insurance company and truck company. Not fair!

I respect what you said in the video, but I think some points are not entirely accurate. I think truck drivers working with a B1 visa is not illegal, and there are no specific regulations on how much truck drivers must be paid.. Low freight rates might push carriers to adopt various strategies to manage expenses, including hiring drivers willing to work for less. This isn’t illegal; it’s a response to market conditions.

It becomes illegal when the driver works and moves freight within the US territory not an import or an export load ( you may know what I'm talking about) and yes it contributes to the cheap freight it may not be the main reason but it sure helps some brokers out there to pay crappie rates, they should eliminate the program all together, cross the merchandise to the USA and we take care of the rest, American trucking companies and drivers make all the profit not transnational trucking companies and B1 🤨
