What do you do if there are a lot of errors in the ALJ decision?

    OK, you just received your decision from the judge and you are mad. The judge just denied you and you are totally caught off guard. Now that you take an opportunity to review the judges decision, you realize that there are a lot of errors of the judge put in the decision. Clearly, in your mind you think that these things should make a difference in an appeal.     Thanks, Reeves, (in my case) the judge has made factual errors, referencing subsections of SS code that do not exist. If i was a judge reviewing her work, I would negate and over rule anything else she put forth. Assuming that if she can't accurately site and reference social security code accurately,,, she probably can not rule accurately either.

    This is what I needed to hear, as my hearing was a joke. I have 5 serious back injury, and he used one. He said I could do a CNA job, again, when the voc. expert said there are none. There's even more, and i'll see the lawyer next week.

      I hear you, I recently attended my ALJ clown show,,, im still laughing at the antics of the ALJ.

    Mr reeves, you do such a great job of breaking down all the complex rules of social security. Can you address an issue where an ALJ, upon his second hearing with the same claimant ( after an Appeals Council remand to the same judge), issued a fully favorable “recommended decision”? Note: the claimant has waited SEVEN years and the appeals council did NOT force or state that this ALJ has to make a recommended decision. What happens next? How long dies this take? And why would an ALJ do that to this claimant? (Now it will take longer for this claimant to get relief. )

    So judge asked one hypothetical question is there any jobs the vocational experts came back with house keeper. My attorney then questioned vocational expert where she had to recalculate because she had considered one if the facts she recalculated and stated that there were no jobs I could do my attorney was confident that I would be approved.
    Well I wasn't and the alj reason given was that the vocation expert stated I could do house keeping which is a fact that was stated incorrectly
    My attorney filed with appeals council which I just received another denial siding with alj of work being a house keeperstated by vocational expert. I have spoke to attorney yet I just found out Friday.
    My question is is the both law judge broke or factual statement is wrong and what now go on to next step.
    Do the alj have word recognition software to make the job easier? How can the not even mention that vocational expert after refuguring stated no job thank you

    I have a problem with my knee. The ALJ denied me citing that my doctor's diagnosis was not a listed disability in the Blue Book. I learned later that my problem WAS listed in the Blue Book as "Major dysfunction of a joint due to any cause". It just wasn't worded that way in my claim. I seems like I was denied over the semantics of a disability diagnosis. Will things like that be considered at the Federal appeals hearing? Is that the type of error of applying the law considered by Federal court of appeals? Will the Federal court of appeals hear the audio from my ALJ hearing?

    Are you saying that if there are multiple factual errors that had the judge didnt contradict medical records and surgeon diagnosis would be a legal error because if the facts were taken as they are the decision would have been different?

    What happens if new medical evidence submitted, before the ALJ hearing, to Appeals Council meets a defined listing under SSA law? Would Appeals Council recognize this and automatically grant benefits?

    Hello Anthony: I received an unfavorable decision last week and wish to appeal to council. I would like your opinion as to whether you feel the judge may have made a procedural error. The ALJ admitted additional evidence into the file ( medical records) that were requested prior to the hearing but never made it in. The judge stated she wanted those and did received them according to the decision, but I was unable to comment on them. If they were available at hearing, I may have been questioned during testimony regarding those records, which could have in fact resulted in a different outcome. Could you please advise? Thank you!

    I was just reviewing my denial letter and I had an a-ha moment but I’m not sure if I’m right. One of my conditions is an autoimmune lung disease (chronic eosinophilic pneumonia) and asthma and he said I didn’t meet the listing because of my FEV1 which makes sense but there is no mention of the autoimmune part of the disorder. If my condition was evaluated also as an autoimmune disorder, I think it may have met a listing. Maybe possibly?
