थोड़ी देर के लिए धर्म को साइड करके लॉजिकल तरीके से सोचिए यदि कोई व्यक्ति अपनी पत्नी को तलाक देता है तो क्या ओचित्य रह जाता है महिला आज़ाद है दूसरी शादी करे या अकेले जिंदगी गुजारे...यहां चीज़े कंडीशन पर डिपेंड करती हैं यदि महिला के साथ उसके बच्चे भी हैं तो पुरुष पर लॉजिकल बच्चों के भरण पोषण की जिम्मेदारी होनी ही चाहिए ...या बच्चे पुरुष के पास रहें..
दूसरी बात यदि महिला बूढ़ी हो चुकी है और उसका कोई और सहारा नहीं है तो भी भरण पोषण की जिम्मेदारी पति पर आ सकती है ..लेकिन यदि महिला कमा सकती है या दूसरी शादी के योग्य है तो ऐसी स्थिति में पुरुष पर तलाक के बाद भरण पोषण की जिम्मेदारी डालना तार्किक नहीं है..इस कानून का कई महिलाएं दुरुपयोग भी कर सकती हैं इसीलिए इसमें नियम व शर्तें होनी चाहिए.!
ऐसा करना इसलिए जरूरी होता है क्योंकि अक्सर महिला एक शादी मे होने की वजह से आर्थिक रूप से स्वतंत्र नही होती , क्योंकि आमतौर बहुत सारे पुरूष ही ये चाहते हैं की महिला कोई काम ना करे और परिवार का पालन पोषण( आर्थिक रूप से) केवल पुरूष को ही करना चाहिए।
लेकिन प्रश्न ये भी उठता है की आर्थिक रूप से एक पुरूष भी तो महिला पर निर्भर हो सकता है, इसलिए हर ऐसे मामले मे एक स्वतंत्र जाँच होनी चाहिए की आर्थिक रूप से असमर्थ कौन है, पुरूष या महिला, उसी के आधार पर ये तय होना चाहिए की किसे गुजारा भत्ता मिलना चाहिए, पुरूष को या महिला को

But it was diluted by The Muslim Women (Protection of Rights on Divorce) Act, 1986.

@@GamerGlitchz ऐसा नही होता भाई /बहन (तुम जो भी हो ) हर बात में बस महिलाओं के चरित्र को सन्देह कर के पुरुष अपने आप को निर्दोस बना लेता ....कई महिलाओं का उत्पीड़न होता, और भी बहुत सारी पारिवारिक कठनाइयों का सामना करना पड़ता है...तब भी एक महिला तलाक का निर्णय नही लेती जब सारे रास्ते बंद हो जाये तब वह तलाक जैसा अंतिम निर्णय लेती हैं... सब महिला को एक ही पैमाने से मापन सही नही और उनको चरित्रहीन बताना भी सही नही ..चरित्रहीन.यह दोनों हो सकते बस हम पुरुषों से मर्दानगी नाम दे देते ,और महिलाएं बेचारी वेश्या की श्रेणी में आ जाती ..जबकि गलत दोनों ही ।।
