My parental rights have been violated as well as my civil rights have been violated. I will give the state EVERY penny I make the rest of my life. This is happening due to my cousin being and head supervisor for dcf and my son was NEVER swabbed at the paternity lab. I need a lawyer do you study law in Pinellas county?

Is the state trying to incentivize marriage through the use of the natural guardian law. Why can't it just be joint custody regardless of martial status?

Wait , I'll blow all your mind. I had my son aug 23 2016 , my sons mother was married to a man in the FL D.O.C. but he was the Legal father of my son. Even with a DNA and the fact he was incarcerated the Judge still gave him visitation. I had to establish paternity. But now I need custody.

I have a question. my husband had a 2 year old prior to us being married. His mother (the child’s grandmother) adopted his daughter in order to terminate the mothers rights who abandoned the child, but my husband still retains his full parental rights of biological father. We are married and have a child on the way. We would like to have myself adopt his daughter, but his mother is going through a mid life crisis in my opinion and is essentially overly attached to the child. She refuses to let anyone adopt the child, and refuses to let the child live with her father full time which was the original verbal agreement between the two.Is there anything we can do to have her removed since she is not the biological mother?

Im a mom whos exhusband rarely sees our kid and tells everyone i keep our kid from him. Im not saying that is the case here but Florida and most states are actually very good about enforcing court orders regarding parenting time. If what your brother is saying is true then he should file contempt of court against her and place a child abduction report with police. If he hasnt then he is likely lying.

I have a question, I about to go to my final hearing in a couple months and watching your video u say that if we aren’t married, I as the father don’t have rights to my child, so by me signing the birth certificate when he was born still means I don’t have rights?

    • @TheJosephFirmPAMiami
      @TheJosephFirmPAMiami  7 ปีที่แล้ว

Thank you for the question. Presuming this is in the state of Florida that is correct. Unfortunately, soley signing the birth certificate DOES NOT establish your rights to the minor child.
However, if your final hearing is on a Petition to Establish and/or Determine Paternity you are well on your way to establishing those rights.

    • @TheJosephFirmPAMiami

Depending on the type of crime the conviction is based on, it can be a factor in the Court's consideration of responsibility and timeshare of the children.

Im moving from California to Florida. I have sole custody and my ex-husband has very limited visitation rights due to child neglect, child emotional abuse, substance abuse, his inability to follow court orders, and many other issues. Im a little concerned now that i know Florida is an equal parenting state. Does this mean they wont adopt my California court order once i try to register it there and they will force a joint custody situation on us? My ex hasnt seen our kid in almost a year now and has only seen him about three times in the last four years. Im hopeful i can register our court order there and immediately file to terminate his parental rights via step parent adoption.

There is a better way. Parental custody of children is actually a very simple matter to solve given the true desire of “What is best for the child”.
We need to separate and discard marriage from family law as they no longer seem to be connected and "Marriage makes people treat each other as articles of property and no longer as free human beings. Einstein".
We can develop protocols that confer (over time) equal parental rights and responsibilities,…..once parentage is proven.
Children’s natural maturation process has 3 essential stages of need.
A.The unconditional love of the mother from birth until about 7 years of age. The mother to have “thefinalsay” and to receive child allowance.
B.The conditional love of the father, who takes his children out into the world, gives security and teaches social boundaries from 7 until about 13 years of age. The father to have “thefinalsay” and to receive child allowance.
C.The friendship and respect of peers from 13 until 18 years of age. The child to have “thefinalsay”.
If these 3 stages are not gone through in order, maturation is unlikely to be satisfactorily achieved and mental resilience reduced. This has now become generational.
Such a regime of equal parenting rights (over time) would bind parents into a co-operative relationship, because (over time) each will hold the power of “thefinalsay” sequentially when they are best favoured to use it.
Such family protocols would be the default position, (allowing love, courtesy and humour to prevail) but could in exceptional cases be varied by the court.
    Buckminster Fuller said:-
“You never change things by fighting the existing reality. To change something, build a new model that makes the existing model obsolete”.
To alleviate suffering is worthy. To prevent it is divine, but thankless.
