  • This is ONE OF THE WORST easements I've ever seen! This around 3-4 years of untamed brush growth and it is a NIGHTMARE! I got most of it with the MTL XCT but we ended up having to get MUNCHIE TOO! It turned out GREAT!

An easement is a reserved right of travel/use on otherwise private land. Typically in most easements the property owner still needs to maintain the land. Changing of easements usually requires going through a re-zoning by the city/town/county and public hearings. This could have been spawned by anything from a complaint, a city inspector noticing it, a change in policy enforcing something that was ignored before, or a utility company giving notice that next month they are running fiber through here and need everything in the way cut to the ground.
The most common forms of easements are Utility easements. This is where you own the land with the exception of the rights for a utility company to enter to run or maintain their utilities through the land. Drainage easements are reserved for culverts or channeling water. Sidewalk easements are reserved for public pedestrian use. Each easement will have restrictions and rights specified in the deed or zoning records (and usually there is one line buried in the sale of property agreement saying you agree to all posted easement restrictions).
Restrictions can be things like: no buildings/structures, cannot limit/block access, aerial (height), no digging, requirements to maintain clear pedestrian access; in some rare situations where you own land surrounding another property you may have an easement allowing a road to the other property through your land.

I grew up in a neighborhood thats was built in the 1910's-20's....There was a 4 (6) ft easement between all the back yards..well over the years 98% have been taken over by the homeowners, so alot of folks got a 6 foot deeper back yard.

    • @tthomestead2763
      @tthomestead2763 ปีที่แล้ว +18

@@1voiceofstl in reality though that isn't theirs so if someone finds those records and comes through to claim that easement and the homeowners have built fences or sheds on that easement they will get fined and either have to move it or be charged for the removal. If it's a utility easement they don't always let the homeowners know before they go through and tear things up.

Technically, an easement (i. e. public right-of-way) does not give the government legal ownership of the property. It gives them and the public the legal right to use the property to build roadways, put in pipelines, power lines, etcetera.
An easement does allow the owners to use the property but restricts what they can use it for. A residential street for instance may have a 60 foot easement but they may only build a 30 foot wide road, leaving 15 feet on either side that the owner can use.
But they can not build any permanent structures, put in a substantial fence like one made of concrete or bricks that would be hard to remove, and these days any trees that will grow over a specified size. Generally things like grass, sidewalks, flower gardens or decorative bushes are okay. And most cities require the resident to take care of the excess easement and keep it looking nice.
But there are always those who decide that if they can not do whatever they want to do with the property that it is the government's responsibility to take care of it. That normally does not work for them but in this case it appears to be an easement for something they thought they were going to build a road through but never did and the property owners on either side got away with never taking care of it.
Now that the government has decided to build the road or run something through it, they are paying to get it cleared because of their failure to enforce the owners to maintain it. Which is a good thing. Although there may be a bureaucrat who decides to tack the cost onto the two owners property tax bill that they will send out in the next couple of months. Even if the current property owners are not the ones who originally let the easement go wild and grow a jungle.

I thought I saw a car tire close to one property. It's amazing what people dump on others property. My moms house needed mowed and when I went down to her property there was 8 TRUCK tires sitting by the curb of her house. I called the sanitation department and they knew they were not there the week before and they kindly came and got rid of them and did not charge her. Grrr that made me mad. A neighbor said they got the first 3 digits of the truck plate and gave them to the police. My mom will be 90. Dumping on a 90 year olds property, really? I'd make them pay $1,000 or spend an entire day cleaning up a mile of the highway.
I am amazed at how much labor is saved by the use of that machinery. Can you imagine if it was like 1940 and two people had to clear that lot? IT would take weeks.

@@kipsterchi7418 I can understand why the app is good for hunting but for someone sitting at a computer wanting to know more info about a house or land, GIS is the way, not that app. And btw I’ve used that app before and it doesn’t always work.

@@zfilmmaker cool story, used the app three times today mulching for a customer and it worked great to show where we were and where they wanted us to go. Something else to remember is not all counties update GIS on a regular basis. GIS is very detailed for some of our counties and is a good tool as you mentioned for ownership info and for a plethora of other information. Working on land you are not supposed to be on is not a good thing in our business.

great work, reminds me of when a friend bought a piece of land that he wanted to live and build on, so a group of us friends went out with him to clear a path for a road onto the property and we had all the equipment we would ever need, started with clearing an over grown ditch to clear and put a culvert in and rock/gravel over it, we then walked the property to see where he wanted to put the road in to where the shop/house site would be and our jaws nearly hit the ground when he stopped about 600 ft or so into the walk we took, we had 6 people , 6 pieces of equipment and chainsaws, etc, etc, 🤣 and he thought it would be done in an afternoon, 2 full weekends, first 2 days was clearing everything for the road trees, rocks, etc, the next was smoothing out the high/low spots bringing in just under a $100,000.00 in stone and gravel and that road bed mat to stop erosion in the end it was 4 full weekends and 8 and sometimes 9 of us there helping him out, and it has turned out to be his home with a shop most of us only dream of owning and has become a bit of a getaway and only 70 miles away in a quiet area, place to disconnect to reconnect with yourself 👍

If that is an easement, then the two properties probably DO meet in the middle. They just can't build on it. An easement usuallly is in place to give access over someone's property to another property or for some sort of utility line. People often confuse a RIGHT OF WAY, which is owned outright with an EASEMENT, which isn't.

They have t ask for permission and we have to put our pets in the house while they trim trees or do repairs to the transformers that fail.

Oh Davin, what a diverse mix of comments? The usual positive & supportive ones, helpful ones, funny ones & then just…ummm…the opposite of what I just said🤔🤣 Criticism over the time of year you did it, it will just grow back in a few years, not dealing with the fallen tree, not cutting a path “through” the fallen tree, more like 150ft not 900ft, now thieves can do their bad stuff without any protection of cover. My personal favourite one though, could’ve been done with a “simple trimmer”🤦🏻‍♀️ Legend has it that this particular person can still be seen out there “trimming”🤣 Great job as usual Davin, tag teaming the MTL XCT with the Mini & Munchie. Take care & cheers🐨🦘🥰

I've never seen a machine like that! Wow, very satisfying and calming. Thank you so much for sharing! Wow, I can think of a LOT I could do with a piece of land that large! The owner doesn't want it, sell it to someone who does and can make it into a lovely home!

Basil: (pointing to the lovely view) "That is Torquay, Madam."
Mrs Richards: "It's not good enough!"
Basil: "May I ask what you were expecting to see out of a Torquay hotel bedroom window? Sydney Opera House, perhaps? the Hanging Gardens of Babylon? Herds of wildebeest sweeping majestically past?..."
Mrs Richards: "Don't be silly! I expect to be able to see the sea!"
Basil: "You can see the sea, it's over there between the land and the sky."
Mrs Richards: "I'm not satisfied. But I shall stay. But I expect a reduction."
Basil: "Why?! Because Krakatoa's not erupting at the moment?"

I'd think the nighbors would be happy to see all that brush cleared out. After awhile it gets out of control and encroaches on your property and pushes your fences over. Will cut down on vermin living in there.

When I was a young bachelor I rented a ramshackle house for $100 per month. It had a huge overgrown back yard that with much work I turned into a beautiful vegetable garden. One day I returned home to find my garden had been asphalted into a road. I didn't know it was an easement, or what we call a "paper street."

Is it wrong that the first thing that popped into my head when I saw this was "Welcome to the jungle"? Also just ignore stupid comments. You aren't destroying nature. All I see in there is invasive weeds, invasive vines (wild grape vine which doesn't actually produce grapes), and a very invasive bush sumac. Pretty much everything had to go.

My friend had a small green space near her place. It was filled with milkweed grown wild. Someone cut it all down, who ever they were didn't look or didn't understand....the signs that said 'No Mowing', or maybe took them down....and never noticed the milkweed was heavy with Monarch Butterfly cocoons. Monarch and other Butterflies are endangered now.... and, a few hundred less will be born now. They were once so populous that you could see their migrations on radar, now....and far too soon..... Monarchs will be as rare as Ivory Billed Woodpeckers.

There was a property like this years ago behind by mates house he was the last one at the end before his big meadow. He approached the owner a few times to purchase and never heard back. Few years later the wife called and said he died and did he still want to purchase! So yep went ahead about a mile long and 30’ wide. Cleaned it up fenced the whole strip and gated each end, added stone all the way down! You should of heard the complaints from the neighbors who had encroached and use some, it was a nightmare! To this day they still cause trouble! But it’s nice a clean lol
