    True story: The "You could say that," "I did say that, would you say that?" exchange happened to me almost verbatim. I was sued for mid-six-figures over a fender-bender, and my attorney was cross-examining the plaintiff when it happened. I immediately though of My Cousin Vinny and this scene.

      @@theemeraldking3251 I sure did. The jury returned what my attorneys said the plaintiff was entitled to down to the cent, which was in the high four figures but half of what the insurance adjustor (I think that was her title) offered in mediation. My insurance covered that of course, as well as the attorney fees, the attorneys being provided by the insurance company (standard practice I believe). Naturally my premiums went up, but aside from that the whole process was so painless for me that let's just say I will be staying with that insurance company for the rest of my life.

      @@PrinceJackTheFirst That's good, I just recently started driving regularly, and on this one road, I had the right-of-way and this one person wasn't paying attention and I almost bumped into them! I swerved off the side just in time and no damage was done on mine or their cars but they decided to speed up in a 65 mile zone I might add while it was raining like a coward. I'm glad I didn't hit them because I really hope to never have to go to court over that cause I worry I might lose

    I received a jury duty summons once. I sat in a ballroom with 800+ people for days finally on the following Tuesday was called into a court room for jury selection. When the first lawyer was allowed to ask one of us a question, he turned straight toward me and inquired "what do you do for a living" I responded "I am a student" he queried "what are you studying" I retorted "Criminology and International law". I swear I heard every lawyer in the room (even those that had nothing to do with that case) yell "id like to dismiss this juror". I have never been asked to attend a jury pool ever again. :(

      Ray B Criminology is not an expertise. Especially after you’re completion of a Bachelorette Degree. You are defined at that point as a Criminal Law Sociologist. Considering this, you would be more than misinformed and make up your own mind based on only what you’ve learned prior to finishing you’re full curriculum into Masters. This then would make you an unreliable juror for both plaintiff and defendant. You know enough to harm either side because you would not listen to either side but instead try to breakdown what they are saying and how they say it, and make leads in the psychology of all being questioned to formulate your own idea instead of what each party is plainly laying on the table.

      Sounds like the judge during jury selection for a weapons charge case when i told him i was a member of the NRA and was prejudiced because of a public case on gun possession where a judge refused to tell the jury about an exception in the law despite the jury asking multiple times. :))

      What if it turns out along the lines of this?
      “So it does, in fact, turn out, that all lawyers are really just money-sucking vampires who want to rub their hands at the chaos they create and laugh at the power that they have. (Fangs grow) I vant to suck your money, bleh bleh bleh!... (Cut to new clip without fangs) No, I’m only kidding. In reality, if a vampire like Mr. Milton did try to start a law firm, then people may ask questions as to why an undead person wants to start a business of any sort using either his name while he was alive or some made-up name. He would likely be disbarred and someone else, who would not have his supernatural powers, would need to take his place and the law firm would likely cease to exist shortly afterwards.”

      @@daydaviddunn that is reality though... you just hope you have a lawyer that is able to prove that one guy cant tell time, one guy has dirty windows and untrimmed trees, and that one lady has horrible eyesight. It is ALL OF THAT that makes this case look rediculous.... we just dont learn any of that until vinny screws up his ability to have the case thrown out and it goes to trial.

      There's something totally awesome about the formula of an expert in their field giving their take on something we all recognize or can identify with. This guy is frigging great.

      I have to imagine most of the viewers aren't in law school or planning to be in law school. Honestly one of the things I like about all these crime docu-series that have become really popular is they seem to be providing a more realistic depiction of what trial and the legal process actually entail.
      Regardless I think this is the kind of stuff everybody should be watching. Unlike other professions, what it is lawyers do is pretty relevant to all of us. There's so many examples of people getting totally fucked over because they don't understand how the justice system works, and the more the average public knows the better. And not just because we are all potential jurors, but because we're all potential defendants and all potential plaintiffs as well. We're all subject to the law, and each and every one of us can be totally and completely fucked by the state if we don't know what's up. Or even if we do know what's up. But especially if we don't.

      I think that's kind of the point. If you're already a lawyer, you would know a lot of the things he's saying. If you're not, it can be interesting to find out how much of courtroom movies are accurate and how much is artistic license.

    Hey mate, I'm not a lawyer, nor a law student, however I'm loving your videos! You have a very clear and concise way of explaining which helps a lay person like myself. Just an idea for future videos for you to consider: I'm up to the bit where you mention that NDAs don't stop court proceedings which is something I didn't know at all. It would be an interesting video series if you took some common misconceptions about the law (e.g. that NDAs are more or less bulletproof), and broke them down into what happens in real life.
    Anyway, love your videos, thanks for them :)

    Counselor, you claim to have covered My Cousin Vinny but failed to include the climactic scene where Miss Mona Lisa Vito completely destroys the prosecution’s case by demonstrating that the tire tracks left by the perpetrators’ car could not possibly have been left by the defendants’ metallic mint green 1964 Buick Skylark convertible but instead must have been left by a 1963 Pontiac Tempest, which had independent rear suspension and positraction and was also available in metallic mint green.
    That is a crime against TH-cam. You’ll be hearing from my commenters.

      I further posit that the state’s “expert” was suspect in his own testimony. There are 3 measurements used to define a tire’s size. (Example 255-75r14) The first is the width of the tire - in this example 255mm wide. The second denotes the ratio of height vs width - in this example 75. The final “r” designation merely denotes the rim size.
      An expert who investigated the tire marks left at the scene can deduce many things from the marks including width and the specific chemical composition of the tires. However - the two values this particular expert gave in his testimony are the exact two dimensions he could not possibly have ascertained from analyzing the tire marks - the height/width ratio and the rim size.
      I have always appreciated the case hinging on Marisa Tomei’s characters knowledge of limited slip differentials and their effects upon the tire marks left behind. It also helps that she is probably the finest looking woman I have ever laid eyes on in this movie.

    I argue that the DA in the scene in My Cousin Vinny *did* know the answer to the question, but, just like Miss Vito said, it was a trick question. His intention was to prove that she was not an expert by asking a question that was a trap. He was just beaten at his own game.
    Also, I'm reasonably certain that lawyers and witnesses are shown in movies as being so close either for the benefit of fitting into the frame, or for dramatic effect. Probably both.

      It's famous for it's accuracy, conduction of a proper cross-examination, and overall brilliant example of how to present evidence so as to create reasonable doubt in the minds of the jury. It's rated third on the American Bar Association's greatest legal movies. And that's despite the tag that says this is not intended to glorify the American legal system. That's how good it is in showing how to practice trial law, and it's pitfalls. I was told to watch it during the evidence portion of my bar examination prep. I aced the bar. I credit the movie ;)

    Like the bit about Jury selection, the stereotyping is absolutely for real. I have been called to be on a jury many times, all I ever had to do to get dismissed was cross my arms, adopt a slightly judgemental expression, and then just answer questions honestly but with the fewest possible words. Immediately assumed to be a crazy loon who just wants an excuse to say guilty every time, defense attorney couldn't kick me any faster if they tried.

    One of my all-time favorite movies is My Cousin Vinny, glad to see it was considered so legally correct for the most part! As someone with extensive automotive knowledge, it was fun to see a woman with automotive expertise lead the case to victory with facts and discrepancies that can actually be proven in the real world.

      Well, it’s legal French. It came in during the Middle Ages from Anglo-Norman, so it’s commonly pretty different from Modern French. Add to that the fact that it came before stuff like the Great Vowel Shift, so a lot of people pronounce it like it went through those changes.
      Though it is odd for Pesci to use the more French-like pronunciation for _voir_ but the more English pronunciation for _dire_, normally you’d expect them to be either both the more French-y pronunciation or both the more English-y pronunciation. Maybe it’s just because it’s more fun to pronounce _voir_ like vwa.

    If a minor cannot enter into a contract does that also not apply to the marriage contract itself? As far fetched as all this is, even if the premise were sound and she had not ratified the contract by failing to terminate it at the age of majority, she would not be entitled to assets because the marriage would not exist in the first place, just as with the prenup.

      TheRealChubDaddy I think rules on marriages are different. Minors in some states can be legally married if given parental consent or the approval of a judge. However the movie kinda flops here as most marriage licenses require a valid photo id and a birth certificate or passport. I'm pretty sure any judge (or someone with a pair of eyes really) would be able to notice that her birth certificate and id are different. Or be able to identify a fake birth certificate if she had one.

      In some cases, common law marriage would apply so she would still be entitled to assets, but I don't think California has common law marriage. Funny enough, this was on my MPT for the bar exam. The case involved a woman, who was a minor, but got married to a man, who was secretly still married to another woman. The man didn't want to give the second wife any assets in the divorce. I immediately thought of Liar Liar while writing my answer.

    The Insider is one of the greatest movies ever. That scene in particular is one of the best. IIRC, the dialogue is actually pretty faithful to the real thing (if not exacly as is).

    Damages(deposition scenes with Glenn Close mostly), Breaking Bad(Saul Goodman's advice scenes mostly), The Good Wife(The whole series, but mostly scenes where lawyers have to deal with different personalities of the judges) ? Also possibly Runaway Jury, A Time To Kill and The Lincoln Lawyer.
    The shows are obviously harder to find clips from, but I'm just putting it out there. Also It's Always Sunny in Philadelphia lawyer scenes(in order of appearance preferably)

    What I immediately thought with Liar Liar: if she was too young to enter into a contract, their marital contract would be void also. The entire marriage would be void, entitling her to nothing.

      I would argue that because he had every reason to believe that the woman was at least of legal marriaging age in that state, and he did go through a marriage ceremony (in church or a Justice of the Peace), then he should not be punished for statutory rape.
      It would be on the same level as sending a man to prison for rape, even after you found out that the woman who accused him of rape in the first place made the whole thing up.

      The takeaway from To Kill a Mockingbird is that trials are won and lost in jury selection. Harper Lee skips it entirely as though it doesn't matter, and Atticus seems to have the same attitude, which is why he loses the case and kills an innocent man with his negligence.

    What the hell? Immediately after the one "performance" on Liar Liar the judge proceeded to issue a verdict and the opposing counsel did not object, and he did not ask her whether she had anything, plus she had the right to examine the woman.

    When I got called for Jury duty I was asked if I had a degree, I told them yes, they asked me what it was in, I told them Engineering, and the defense told me I could go.

    I'm glad you talked about NDAs. On Law and Order, several times, witnesses refused to testify because of NDAs, but it seemed to me that a murder case would trump any NDA. Sounds like it may, if I understood you correctly.

    I would love (and even pay money) to see a lawyers reaction to The Social Network. Facebook aside, The Social Networks scenes are so powerful that it would be interesting to see them analysed by real world professionals.
