Unfortunately I wouldn't call it easy. He can fight it and try to get it knocked down to a lesser charge, but I had a similar situation in Georgia. The state will just claim that it was obvious they were racing and there's nothing you can do to prove you weren't racing, or in my case "reckless driving and street racing" when it was just 3 cars speeding at a constant speed on an empty highway. The cops can say basically anything they want and unless you have proof otherwise, or lots of money to drag out the fight, it's not easy. I only managed to get the street racing taken off and had to plea no-lo to reckless, but the state wasn't going to drop it to a speeding fine.
DA has no case as soon as the officer said “I have the authority to seize property”. Someone didnt take his class in unlawful search and seizure or chain of custody.
How is this an unlawful search? The officer saw both cars and had suspicion beyond a reasonable doubt that they were speeding/street racing. If you are arrested then they can impound, seize, and book all of your property into evidence. Chain of custody? what does that have to do with street racing? that is when you process evidence, they take pictures of the car/property.

Doesn't matter in CA. Sound alone can get you an exhibition of speed ticket (street racing). You can be sitting completely still and rev your engine and an whole cop can write you up for a misdemeanor. I got one for generating too much noise and accelerating too quickly to 25mph (not even 1/2 throttle) for an officers liking in a stock Porsche GTS.

At least 6 police SUVs sat in a parking lot at a busy intersection while I was doing a delivery job, according an ex coworker they were just there to meet their quota for that month even they said they were there to bust distracted drivers. With how many cars there were, I'm sure everyone noticed their presence.
I had a similar situation happen to me. I was racing in my Evo at the time. I got clocked going 120 on a 45. Cop pulled me over and the first thing he said is I can take you to jail right now. I knew I was in deep shit. The cop didn’t take me to jail but gave me a ticket to appear in court. I lawyer up and they couldn’t proof I was racing because they never pulled over the second car. He never gave me a ticket for speeding just racing. So I got the charges dropped. But it’s Florida things are way more lenient than Cali.

Now I'm no lawyer and neither do I live in Cali, but a quick Google about Cali laws tells me this officer is bs. Let me establish what I have observed based on the video: 1. Never tell the officer anything, you have the right to remain silent and lawyer up. Anything you say can be used against you in the situation. You can be cooperative but never compromise yourself. 2. He was looking for ways to justify his decision to make his arrest before arresting you. He was looking for video evidence of you alleged "Street racing". He did not inform you on how he arrived at the decision of you "Street racing" shows that he does have any hold on you. Did he observe reckless driving/speeding and measured the speed with a radar gun? 3. He definitely does not have the right to seize your vehicle. You can be sitting completely still and rev your engine and an whole cop can write you up for a misdemeanor. I've seen similar. At least 6 police SUVs sat in a parking lot at a busy intersection while I was doing a delivery job, according an ex coworker they were just there to meet their quota for that month even they said they were there to bust distracted drivers.

I had a similar situation happen to me. I was racing in my Evo at the time. I got clocked going 120 on a 45. Cop pulled me over and the first thing he said is I can take you to jail right now. I knew I was in deep shit. The cop didn’t take me to jail but gave me a ticket to appear in court. I lawyer up and they couldn’t proof I was racing because they never pulled over the second car. He never gave me a ticket for speeding just racing. So I got the charges dropped. But it’s Florida things are way more lenient than Cali.

Hey Gordon, been watching your vids for quite a while now and I was really doubtful about that officer who arrested you. Now I'm no lawyer and neither do I live in Cali, but a quick Google about Cali laws tells me this officer is bs.
Let me establish what I have observed based on the video:
1. Never tell the officer anything, you have the right to remain silent and lawyer up. Anything you say can be used against you in the situation. You can be cooperative but never compromise yourself.
2. He was looking for ways to justify his decision to make his arrest before arresting you. He was looking for video evidence of you alleged "Street racing". He did not inform you on how he arrived at the decision of you "Street racing" shows that he does have any hold on you. Did he observe reckless driving/speeding and measured the speed with a radar gun?
3. He definitely does not have the right to seize your vehicle. An officer must obtain a warrant OR be under one of these exceptions:
Searches/seizures done with someone’s voluntary consent;
Searches/seizures incident to a lawful arrest, where the police are looking either for weapons that might be used against them or for criminal evidence that might otherwise be destroyed;
Inspection searches, such as those at international borders;
Searches of vehicles when police have “probable cause” to believe the vehicle contains evidence about a crime (this is known as the “automobile exception” to the warrant requirement);
Searches of obviously incriminating items that are in “plain view” while law enforcement is conducting an otherwise lawful search;
Searches/seizures in emergency situations that are necessary to prevent physical harm or serious property damage, or to locate a fleeing suspect;
The “stop and frisk” of a criminal suspect (that is, a search of his/her outer clothing) while s/he is being temporarily detained (this is sometimes referred to as a “Terry stop”), to look for weapons that might be used against an officer;and

That Gamballa Mirage GT was purchased from a dealer here in western Germany (Cologne). Still remember when it was for sale a few months ago. It was around 670.000€ (790.000$).
The car was bought from it owner in Monaco for way more than that.

You can check out the dealerships Instagram page @ amiancars but it’s a bit further down on their page. The car was once registered in Monaco yes. But was sold in Germany. The car was much cheaper because this was originally the Orange on orange Mirage GT that was crashed many years ago. It was rebuilt and painted dark blue.
