    OK for those of you watching this video now in 2022 or later, I wanted to let you know that in regards to the line that says Title/Authorization what we have suggested is to put “Owner“ on that line. Also it is important to note that starting in 2022 you can file for your homestead exemption immediately and do not have to wait until January 1 of the following year. There is a new law that was just put into place recently. Hope this helps to answer some of your questions. Thanks again! Roland

      Do I have to move into my new home before I file the homestead exception? The home is still being built. When is best time to apply?

      @@Bloodspiller777 This new law allows you to apply for your homestead exemption immediately upon closing and possession of the property. You cannot apply until it is officially your home and has closed and funded.

      Hello, I'm filling out the Brazoria County Property Tax Exception documentation and the last pages have instructions stating that the completed application and required documentation is due no later than April 30. Also at the top of the application ask if I'm filing a late application. May I know where to find this new law that allows owners to file immediately after buying a house? Please advise. thanks.

    Thank you this is so helpful! My form has the following question: "Is the applicant identified on deed or other recorded instrument?" And if yes it asks for the "court record/filing number on recorded deed". If I have a mortgage, would the answer be yes? And where would i find the court record/filing number? Thank you for any help you can give!

      Hi Jamie. Sorry for the delay. As long as you are on the loan then you will be on the deed. If you are in a common law state such as Texas and married to the person on the loan then you would also be on the deed. You should have received a copy of your deed from the title company a few weeks after closing. If you did not then I would contact them to request this info directly from them as they would possibly have it on file. Thanks!

      On the signature line next to where I filled in my name I put "Owner". You would put something else in that line for example if you were the Power of Attorney or something else applicable in that line.

    Thank you for making this video! I just have a question, I'm a co-morgator, I'm on the title of the house but I'm not on the loan. Does that mean that my husband and I own 50% and 50% of the house or just my husband owns it 100%. I'm confused on that question of the application. Thank you!

      I am in the same boat except the other way around. So I am very curious what The right Choice Group has to say about this situation. I live in San Antonio. I am the only person on the Mortgage. My ex is only on the deed for now. Divorce is next month and he waived everything so I am 100 percent owner of everything we accumulated during marriage. So I just put Single Adult and 100% ownership. Now thinking my application might be rejected.

    So here's scenario. We bought the home in August, and the loan is ONLY under my name. We got married in December. We are currently filling out the form for 2022, and the loan is still ONLY in my name. Do I put married couple, but 100% next to my name for ownership?

      Hi Michael. Since you are married at the time you are filling out the exemption you will put married and 50% for each of you. You live in a common law state in Texas so it is half hers no matter if she is on Title or not in this circumstance.

      I normally just tell people to put "Owner" under Title/Authorization. Have not had any issues with that.

    can I drop off the application, with the supporting documents, at the appraisal district office physically instead of mailing? I'm not able to find the appraisal district account number online, can I leave it blank?

      Hello Shyam. I don't see why you could not take it directly to the tax office as I have not heard otherwise. I would recommend calling them first to verify. Do you have a realtor that helped you with your purchase? They should be able to provide your lot size. Also you can google search your home and if it was listed you can often find your lot square footage on sites such as Movoto.com or even Realtor.com. I just did this for my home and found it quickly. If you can't find the appraisal district account number then make sure all of your address info is correct. Perhaps by taking it into the office you may be able to have someone help with the remainder of filling it out. All of the info is public record at the courthouse as well where your deed is recorded and can be pulled.     Does the full property tax exemption apply to raw land for 100% disabled veterans?

      Unfortunately I do not believe so Tom. The 100% property tax exemption can only be applied to the disabled person's homestead meaning that a home would have to be placed on that land and it would have to be the person's primary residence for that to occur.

    I have a question for section 3. The question "Is the applicant identified on deed or other recorded instrument?" If you have a deed of trust then that's not a deed, correct? Would I have to select no because I am financing the house?

      That would be the warranty deed they are discussing. If you are married in Texas or if there was a co borrower on the loan with you when you purchased the home, in either case they would be on the deed. Even if you are financing the home you would still answer this question. If you are married and the person is not on the loan they are still on the deed so you would answer yes.

    Great video and thanks for the explanations. I went from 80 % to 100 percent disability va. Do I need to resubmit this form again since there has been a change?

      Hi Leslie,
      Yes make sure you resubmit or better yet call your appraisal district to verify what you have to do but do it immediately. If you are now 100% disabled you should qualify where you do not have to pay property taxes at all. You should be eligible for a full exemption at this point.

    I just found your video here in 2021. I hope you are still monitoring. I have a question about the income producing part. I have a 5.6 acre farm with a small set of chickens. We sell their eggs but they take up a small part. What do put in for this part? Help please :)

      Josh that is a tough one. The way I understand it to read is only if you use a portion of the property commercially such as a rental and make income off of that. For example if you had a triplex and use 2/3 of the triplex as rental income and live in one unit. I am not sure if selling of chicken eggs would technically qualify under that category but to be safe I would recommend a quick call to your local appraisal district just to confirm.

    For "Title/Authorization", I can put "Owner" even if I am under a mortgage loan?

    Question, my husband bought the home in oct 2017, would we put 2017 or 2018? Also I am a disabled vet would I need to send other documents like my VA disability letter with the form? Thank you

      Because the Homestead exemption can be placed in arrears by 2 years I would most likely put 2018 for you for the year you are claiming exemption. For you being a disabled vet you don't have to wait and it is separate from the Homestead form. Make sure to contact your local appraisal district to be sent a VA Disability exemption form.

    We were claiming a previous residence exemption in another county in Texas but sold it as of August 2018. Would we put for Tax Year 2018 or 2019 for homestead exemption? Also the we purchased the home in 2012 but had it as a 2nd home so the date of the occupancy would be when it became our primary residence of August 2018?

      If you bought a new home in 2018 that became your primary residence you would will fill out the form in 2019 claiming the homestead exemption on that home for 2019 and beyond. You file for the homestead exemption after Jan 1st of the year following the year you purchased the home that became your new primary residence. Fill out the form claiming homestead starting in 2019 and you should be good in this case. Also note there is typically a deadline to apply of April 30 of the same year but I would just go ahead and fill it out claiming the exemption still for 2019 and if there are any issues they will alert you.       No, you home is already assessed by the county. After filling out this form you will see roughly 20,000 taken off of your total property tax value, thus decreasing the total annual taxes paid out of pocket by you. You only have to file this once and it is in effect after that.

    So this is a letter I received from the Appraisal District:
    “Dear taxpayer,
    This letter is to advise you that the exemption amount for your property for the above referenced tax year(s) has been changed from 100% to 50% pursuant to section 11.41 of the Texas Property. This modification of this exemption will change your tax liability for the noted tax year(s) 2017-2019.”
    What does this mean? Thank you for your response.

      Section 11.41 of the Texas Property Code relates to ownership of the property. See the following situations:
      (a) If a person who qualifies for an exemption as provided by this chapter is not the sole owner of the property to which the exemption applies, the exemption shall be multiplied by a fraction, the numerator of which is the value of the property interest the person owns and the denominator of which is the value of the property.
      (b) In the application of this section, community ownership by a person who qualifies for the exemption and the person's spouse is treated as if the person owns the community interest of the person's spouse.
      Do either of these apply to you? Are you partial owner of the property with someone else other than a spouse? If not, I would suggest placing a call directly to your tax district for further clarification as to why you received this letter.

    Hello! This is my situation:
    We built a new home in 2019, we started paying interest on the loan I believe on May 2019. We moved in December 3rd, 2019 when the house was completed and inspection passed. What will be the Date you acquired this property, under section 3 of the form? The date it was completed or the date I started paying the loan? Thank you for your willingness to help us.       Hi Deborah, sounds like a custom home build if I am reading this right. The interest you paid originally was most likely on the upfront construction costs as they need to complete the home. The date I would go with is the date your home was completed and then you move in, sounds like Dec 2019. That is less important. The real importance is making sure it was closed and funded in 2019. As long as it was you are good to file your exemption now for 2020. Thanks again!

    My husband has our home address listed for his side business, although he does not work at all from here, he just needed an address, all his work is done outside the home, do we put something under "income producing" and if so how do we figure out the percentage? Its a small side business he made about 5K this past yr.

      If you are not using your home address as a commercial incoming producing property then I would not think you would want to list it that way or it is possible you may not be able to claim your exemption. If it is not registered that way I think you would be best suited most likely filing for a regular homestead exemption and if there are any questions your appraisal district would most likely notify you via mail from there.

      Since Texas is a Homestead state if you are married you are both on the deed. You would have a received a copy of the warranty deed from the title company you closed out about 4-6 weeks after closing. It is also recorded at your county courthouse if you need a copy to get the filing number. You can also call the title company you closed at (assuming you did close at a title company of course) to see if they can assist you in locating your warranty deed. If you do not have a copy of your warranty deed I would still send in the form and see how they respond. The county has a record of your deed and they should be able to obtain it if you cannot find it.

    For section 2 property information, were not married just common law but were both on the mortgage. I work and shes a stay at home mom so would that also be 50/50 or just me at 100%.

      If you are not married but she is still on title then yes you would choose 50/50 for ownership. Same would apply if you were married even if she was not on title, just as an FYI since Texas is a Common Law State.

I have a question cause we didnt update our driver license address yet, is it ok to just attached proof of billing address, house title with our names in it and a letter explaining why our driver license didnt matched our home address? cause we just renewed our driver license yesterday.       I would send it in and see what they say. If you have at least a paper copy of your temporary drivers license I would send that in with it as well. They will need something showing the new address on a Drivers License at some point. Even if you just renewed your Drivers License but it still reflects your old address you will unfortunately need to renew it again with the new address I'm afraid.

    At the time my husband and I purchased our home my father in law helped us out and became the co-borrower on the loan since my husband had some legal issues. On Section 2, do I put my husbands name as property owner 2? And put that he his 50% ownership interest? Or do I put my father in laws name since he is on the loan? Thank you so much for helping out.       Great question. I believe you would put 33.3 percent for each of you. All three of you would be on Title in this situation. Yourself, your husband (Since you are married and Texas is a common law state) and your father in law. Just fill two names in on one line if needed but that would be my recommendation.

      These are certainly unique times for sure. My recommendation would be to submit the form along with a letter of explanation and also two forms of property identification such as utility bills, etc. to show that you are indeed the owner of the property. If you have a copy of your warranty deed that you would have received from title I would send that as well just in case.

      Only in 3 circumstances that I am aware would you fill out Affidavit Form 50-114-A:
      1. AFFIDAVIT FOR OWNER/APPLICANT WHO IS AGE 65 OR OLDER AND OWNERSHIP INTEREST NOT OF RECORD
      2. AFFIDAVIT FOR OWNER/APPLICANT WHO HAS QUALIFYING DISABILITY AND OWNERSHIP INTEREST NOT OF RECORD
      3. AFFIDAVIT FOR OWNER/APPLICANT WITHOUT WRITTEN OWNERSHIP DOCUMENT FOR MANUFACTURED HOME

    I mailed it a while back in January but never received any type of confirmation. How do you know you successfully submitted and received the exemption?

      You can call your local county courthouse to confirm it was received. They don't mail anything out unfortunately at least from my experience but you can call them to confirm it was put in place. That is what I did in my case.

    New to Texas from California, was given Homestead Exemption application by a relative. My mom qualifies being over 65 and I am 50% owner. She filled out the paperwork and signed it. I didn't sign it as 50% owner. Will the application be rejected because I didn't sign it?

      It is possible it may be rejected or accepted but without you on there. I would suggest you contact your appraisal district and let them know and they can advise you on if it is in place or not and you can decide from there if you need to send a new one in. Hope this helps!

      @@Bloodspiller777 Yes 50/50 no matter what even if one spouse is not on the loan or making payment. Texas is a common law state so automatically 50/50 for ownership if married.

      Not a problem Antonio. You would want to put 2020 in that scenario as that is the first year you can apply and qualify for the homestead exemption. Jan 1st of the year following the year you purchase the home. The only exception would be if you had bought the home in 2018 but did not apply for the homestead exemption until 2020 then you could have put 2019 as the year you wished to apply the exemption. It will let you go back a maximum of 2 years in that situation. Hope this helps!

      I believe you are still okay with the exemption, as long as you live there as your full time residence and don't rent the house out more than 30 days at a time without you being there such as for AirBnb or VRBO. As far as if you renting out a couple of rooms in your home that is considered taxable income you would want to claim for tax purposes but I am unsure if that then makes your home an income producing property for the homestead exemption specifically.     Hi, thank you for this video. I am completing the 2021 Form 11.13 (01/20). It is exactly the same as the form in your video except for the one thing I have a question about. Under SECTION 3: Property Information the question is "Is the applicant identified on deed or other recorded instrument?" If YES, applicant needs to fill in the court order/filing number on recorded deed or other recorded instrument. If NO, required documentation must be provided. How would I answer this question as the property owner? Thank you.

      Title should have sent you a copy of your warranty deed in the mail post closing. You typically receive it about 4-5 weeks after closing in the mail. If you did not receive it try reaching out to the Title Company that closed you to see if they can provide that number for you. If not you can also try to call your appraisal district to get that info as well or just leave blank on the form and they can reach out from there if needed.

      I had the same question. I went to my county clerks website, looked up my name in public records, and found my deed, which includes the filing number. You should also be able to find online if you cannot find the mailed info.

      It is recorded at the county courthouse and is public record. You can call your local county courthouse to request access or possibly even access it online.

      Hello Mary, is this now your permanent residence? You can apply for the homestead exemption under your name but it has to be your primary residence. If it is a secondary or investment property it will not qualify. If it is a permanent residence I would suggest putting the date from the date you took possession and made it your primary residence, unless that was longer than two years ago in which case you would put two years ago or 2017.

      Since you are married at the time you are filling out the form you will want to put married. You will each be filing for the homestead exemption jointly since Texas is a common law state and since you are both owners of the property as a result once you were married.       Hello Maria, thank you for watching! If you bought the home in 2018 when you fill out the form you are applying for your homestead exemption in 2019 so that is what you will want to put on the form. For the signature on page 6 I am confident you are safe signing it as the principal owner but when my wife and I filed our exemption we just both signed on the signature line and had no issues with it being put in place so that is safe as well.       You will fill out one form and put both of you on there as 50% ownership each. If you are married in Texas you will both be on the deed. If you do not know the deed number just send it in without it.

      Hello Michael. The only difference is that the county version of the form has their info filled out already. The Comptrollers version is just blank for that section. Either will work fine if you find your county version as well.

      Hi Alexbboy, do you remember how it was filled out at closing or on the deed? Were you married when you purchased the home or after you made the purchase? If your co-borrower is not living in the home as their primary residence then they most likely cannot claim the exemption which should allow you to claim the max exemption. I would suggest a call to your local appraisal district on this question just to verify. My thought would be you would claim your portion as 50/50 with your spouse but it may end up being 25/25 with your spouse with the co borrower being the remaining 50% ownership so I would just suggest a quick call to them regarding this matter before you finalize it.

      Hello Ryan, I believe you can add this exemption back for 2 years so if you have not yet filled out a form on your home I would suggest putting 2017 in the line. Send in the form along with a copy of your Drivers License and just make sure the address on your drivers license matches the home address. If anything is different you will get a notice letting you know what needs to change. Thanks again!

    I am a DoD contractor living overseas. I also own and rent a house in Bell county Texas. Can I claim the homestead exemption? My home of record is Texas but obviously can't state on the application that I am living there due to my work location. Any exemptions for Americans working overseas?

      Hello Ben, unfortunately I am not aware of any clause that would allow you to claim homestead exemption on your home when it is not in fact your primary residence. They do have something for active duty Military but not for anything else that I am aware of.

      That would be if you obtain possession of the home through right of heirship such as a parent passing down to a child upon death. This usually occurs when a will is not present upon death.

      @@dh6035 Make sure to check the important information page at the end of the form. Here is how it reads:
      Heir property is property owned by one or more individuals, where at least
      one owner claims the property as a residence homestead, and the property was
      acquired by will, transfer on death deed, or intestacy. An heir property owner
      not specifically identified as the residence homestead owner on a deed or other
      recorded instrument in the county where the property is located must provide:
      • an affidavit establishing ownership of interest in the property (See Form
      114-A);
      • a copy of the prior property owner’s death certificate;
      • a copy of the property’s most recent utility bill; and
      • A citation of any court record relating to the applicant’s ownership of the
      property, if available.
      Each heir property owner who occupies the property as a principal residence, other
      than the applicant, must provide an affidavit that authorizes the submission of this
      application (See Form 50-114-A).

      Is it a manufactured or mobile home? If so often times that information is located on the frame of the mobile home or in the interior.     I’ve had my condo coat owned with my sister for over 20 years, couple of years ago they sent out a letter saying we had to re-apply for homestead exemption, my sister hasn’t lived here the full 20 years but we can go on it, they have made it difficult to reapply saying we didn’t provide enough information twice after we provided what they asked for bills, etc.
    I can’t afford the taxes now on this small run down condo, was told I should be getting money back from the past after Homestead exemption is reinstated but how do I do this?
    School district tax alone for the year is over $1000, it used to be around 500 with Homestead if I paid it on time

In certain circumstances if you had lived in the home 2 years for example and are just filing it now you could have put 2019 but in your case you have only lived there one year so you will want to put 2020 on the form.       Guillermo, in order to qualify for the homestead exemption you must claim this property as your primary residence and be living in the property at the time you apply for the exemption which is why they want to see your drivers license match you home address. There are a few but very specific situations in which this does not apply as I go over in the video but you must match one of those reasons in order to apply for your homestead exemption if you are not occupying the property.

      You can apply retroactive up to 2 years I believe so you would put 2018 on the form for the year you are seeking exemption to start. You would need to use the property address as mailing address as it is meant to be your primary residence of course to get exemption.

      Hello David, thanks for watching. We are happy you enjoyed the video and found it helpful. Here is what I found for your situation. You can apply for a retroactive exemption up to one year after the property tax delinquency date (normally February 1st). ... If your homestead is damaged or destroyed by disaster, you can qualify for the homestead exemption for up to two years from the date physical preparation for rebuilding begins. So in your case, because you bought your home in 2016 but have not yet filed for your homestead exemption, I would suggest putting the exemption year for 2018 since it would be retroactive for one year after the property tax delinquency date. Once you file for this homestead exemption you will not have to refile again. If you have any other questions please feel free to reach out to us again. Thanks!

    The application that I received gives me the option to put "COMMUNITY PROPERTY"

      You would not want to put community property unless it is a co-op or something like that. If you are married you can put ownership as 50/50 but would not select Community Property unless it is something like a co-op. For a single family home you would not want to select this option.
