      Yup! I am solidly in the McQuade camp on this issue. I don't think the prosecution should give another mention of it until closing, and then matter-of-factly say pretty much what Professor McQuade said. 90 seconds is forever for people who have an agenda and are familiar with one another...in 90 seconds you could talk about the wives, the kids, dinner last night, the weather today, AND two or three business matters. Every conversation is not a meandering conversation.

      You don't need to believe in Cohen. You just need to see the 11 different signed checks for legal expenses. 1 or 2 or 3 you can see it was an oversight. But 11 separate checks, trump knew 100% they were to reimburse cohen for the payment. He is even on video saying it.

      What job is done and was it illegal? Does that not have to be identified? Maybe a contractor was trying to overcharge Trump and Cohen negotiated it down? They still haven’t explained how any of this was illegal? Except maybe for Cohen sending fraudulent legal invoices to his client…Trump should sue for his money back.

Cohen was sending fraudulent invoices at the behest of Trump and his CFO, who had to remind him (in writing, which the jury has seen) how much each invoice was supposed to be for, because Cohen wanted one lump sum payment and didn't want to send invoices. The entire plan to gross up the $130,000 payment for taxes and then have Cohen send invoices for legal fees that didn't exist as a cover for reimbursing the $130k without admitting what it was actually for is the thing that was illegal. The relevance of the phone call is that it shows Trump knew what was going on, but there are many, many, many other pieces of evidence (many recorded or in writing or seconded by other witnesses besides Cohen) saying he knew what was going on, so that one phone call isn't a huge deal. If Trump's argument is that Cohen did tell him "Hey that thing is taken care of" but he had no idea it was about Daniels and thought it referred to some contractor thing or whatever, Trump has to go on the stand and say that and the jury decides who to believe.

      I was so impressed with Katy Tur once upon a time but not for long. She got special access to DJT during his first campaign, and within a few months wrote a book. Since then, I refuse to watch any shows on MSNBC, I just watch highlights.

    With the huge preponderance of evidence against Donald Trump, it's ridiculous to think (or, presuppose that the jury would think) that the whole case is dependent upon this minor issue with Michael Cohen's recollection about a single telephone call.

    Cohen's podcast is a stress valve for him, as I see it. He is trying against all the odds. What no one is taking into account, is the fact that Cohen has endured constant threats to himself and his family, even to this day, because he decided to change his ways and come clean. He has a seedy past, but it does appear he is sincere in his efforts to be a better person. Too many characterless people are trying to make money off this. Makes me sick.

      I'd agree. If they don't call him then this amounts to nothing. All they have is that of the many phone calls Cohen made to Trump through Schiller, he might have forgotten that this one mentioned another matter which soon became irrelevant to the bigger issues. There's quite a few intelligent types on the jury, I'd be surprised if they don't put a script together of what might have been said and time it just to see how much could have been said in that time.

      There's no evidence that Trump was using anyone else's phone. The text messages sent to that phone was about a 14-year-old boy pranking Michael where Michael was told to call the phone and did one minute later. The idea that he then spoke to Trump is only based on his words and it's the only corroborating evidence that puts Trump at the helm. It feels like the case has completely fallen apart because they put a seasoned liar on the stand and he lied yet again.

It will matter that he is sitting there saying that in his plea deal he was lying to the federal judge and then add that to all the other times he has lied. Put it all together and there's nothing but reasonable doubt that he isn't being truthful about this conversation he supposedly had with Trump. Now it's just his word versus Trump's. His word would have so much more weight if he hadn't been caught lying and if he hadn't continued lying after he claimed to get on the right path of justice. Admitting that he lied to the federal judge who is sentencing him on top of all of the other admissions He's lucky that judge is no longer with us or I'm sure he'd be in some deep water right now.

    I remember testifying in a case and the lawyer started acting super cocky, cause she “caught me in a lie”. But it was literally that in my grand jury testimony I said “people on my left were screaming at him as he came out from behind the van”, and during the trial I said, “there were people screaming to my left, but I couldn’t see what they were screaming at. Then I saw him step out from behind the van.”
    That’s kinda the level of “oh, caught you in a lie” they got with Cohan.

      In my case the guy got 10 years for shooting a bunch of random people (including me) with projectiles, and spraying myself and several others with bear mace. There was some kind of political street fight going on; but it was midday, and most of us were just random pedestrians, not affiliated with any of that nonsense. That was my first time learning what a proud boy was (I had lived abroad for years, and just returned to America).

      It wouldn't have been a problem if he had come out and spoken to the initial reasons for the call, but seeing how he didn't and has such crystal clear memory about everything until questioned, he now looks like a liar. On top of it, he's admitted to lying to the federal judge who sentenced him far after he turned the page to become an honest man. He sat there yesterday and said that the judge he was lying to was corrupt, impugning the whole system, which he's a part of now. Not to mention, he said that he has a personal stake in Trump going to Jail. With the only thing that genuinely tied Trump directly to this being that phone call, this case has fallen apart. The fake invoices were produced by Michael and paid for by Trump. The number of indictments are based on how many invoices he fabricated and sent. Had Michael made honest invoices and Trump rewrote them and then paid that, it'd be different, but that's not what happened, leaving it solely on his word, and we can all tell what his word is worth? It's a complete catastrophe.

    This could be like the OJ trial with the gloves. They simply ask Cohen to say the following things "Hey Shiller, is there anything we can do about these stupid phone calls?" Shiller: yeah, we'll look into it." Cohen: "Thanks, can you put the boss on please?" Trump "Michael?" Cohen: "It's all taken care of with the Daniels thing," Trump "Thanks Michael, bye". I read it myself and it takes about 20 seconds. That leaves over a minute for embellishment. In this case it looks like the gloves fit.
