    "Resignation is the formal pronouncement or relinquishment of a position or office. It is the voluntary act of an employee who is in a situation where he believes that personal reasons cannot be sacrificed in favor of the exigency of the service, and he has then no other choice but to disassociate himself from employment." - Central Azucarera de Bais, Inc. and Chan v. Siason, 765 Phil. 399 (2015)
    3) Test of Voluntary Resignation:
    "The intent to relinquish must concur with the overt act of relinquishment; hence, the acts of the employee before and after the alleged resignation must be considered in determining whether he in fact intended to terminate his employment." - Central Azucarera de Bais, Inc. and Chan v. Siason, 765 Phil. 399 (2015)
    4) Defense of Voluntary Resignation:
    “In illegal dismissal cases, it is a fundamental rule that when an employer interposes the defense of resignation, on him necessarily rests the burden to prove that the employee indeed voluntarily resigned." - Central Azucarera de Bais, Inc. and Chan v. Siason, 765 Phil. 399 (2015)

    2) Custodio v. First Farmers Milling, and Marketing Cooperative, Association, Inc., 265 Phil. 579 (1990)
    3) Intertrod Maritime, Inc. v. De La Cruz, 275 Phil. 351 (1991)
    Article 300, Labor Code of the Philippines:
    a. An employee may terminate without just cause the employee-employer relationship by serving a written notice on the employer at least one (1) month in advance. The employer upon whom no such notice was served may hold the employee liable for damages.

    b. An employee may put an end to the relationship without serving any notice on the employer for any of the following just causes:
    1. Serious insult by the employer or his representative on the honor and person of the employee;

    2. Inhuman and unbearable treatment accorded the employee by the employer or his representative;

    3. Commission of a crime or offense by the employer or his representative against the person of the employee or any of the immediate members of his family; and

    4. Other causes analogous to any of the foregoing.

      Hello po sir! 11 years na po ako sa work at regular po. Balak ko po mag resign kasi po hinde na sapat ang sinasahod ko po. Kasi po nag less 20% po ang kumpanya sa sahod namin at mwf lang ang pasok ko sir. Kung mag resign po ako sir ano po ba ang makukuha ko sa company sir? Thanks po

      Good day sir itanong ko Lang po kc 1week po ako nagtraining sa trabaho ko tapos natapos po Ang 1 week pinagpirma po ako as a probationary sa jobdiscription ko as waste water pag tapos po Ng 1 week pinagpirma ulit ako Ng isa pang probationary as a waste water/sanitarian pagkapirma ko Po nun Hindi Napo ako pumasok dahil Hindi Naman po ako sanitarian at Hindi Naman sanitarian Ang inaplayan ko..at Ang job hiring Nila tanong ko Lang po Kung makukuha ko ba Ang maging sahod ko?

      Magandang itatanong ko lang po kung to tama po ba yung sinabi sakin ng agency ko.
      Bali nag work po kasi ako ng seasonal or 1month work lang po tapos po delay po ng 15days ang salary ko.. nag start po ako nung December 9,2020 tapos nag end contract po ako nung January 15,
      Yung sahod ko po ng January 15 dapat makukuha ko ng January 31,2021 kaso po sabi sakin ng agency 90day ko daw po bago ko makuha tama po ba yon..
      Salamat po ng marami sana po matugunan nyo po ang aking tanong..

    Good day atty. Sana mabago na ang labor code natin dapat ma protektahan sana ang manggagawa na ngserbisyu ng mahabang panahon sana may matatanggap na separation pay kahit wlng policy sayang kung nkapag serbisyu kana ng 20yrs at wlang matatanggap dahil sa wlng policy ang company.

    Do we have a court decision that we could cite when an employee failed to serve the 30 days prior termination notice? And that the Employer could charge damages?

    Sir may kukuha ba yung kapatid ko.. under agency po sya bali 20 years na sya sa agency at dahil po sa pandemya isa po sya sa nawalan ng work sa pinapasukan nya at pag narereport naman po sya sa agency ang sabi wala pang available na work dito sa metro manila ang tanging location na may available na work ay mga probensya. hindi naman po nya kinukuha yung work Bukod sa malayo na mahihirapan sya sa transporation uwian araw araw at pandemya pa ngayon. ganun lagi ang ginagawa nya nagrereport lagi sa agency kaya parang napapagod na po sya sa ginagawa nya kaya naisipan nalang po nyang mag resign. may matatanggap po ba sya kahit hindi naman nya kagustuhan ang mawalan ng trabaho?

    Question: Nag split ang company. Both company are active. Dahil malilipat sa kabilang company. Nag send ng voluntary resignation letter yung 1st company at nag send ng new contact ung 2nd company. May makukuha bang separation pay from 1st company dahil may voluntary resignation at new contract for the new company? Ano ba ang rights ng employees sa gantong situation. Thank you.

    Forced resignation po kc wala ng contract ang company.
    Wala daw pong makukuhang separation pay kc mayroon namang available na trabaho pero sa malalayong lugar. Halimbawa sa Cavite, at mas malayo pa sa tirahan ng Worker.

    atty gud morning po.ask ko po kung na preventive suspension ako ng employeer ko for 30 days..Pero wala po sila napatunayan sa alleged na kinaso sa akin. Pinagagawa nila ako ng incident report wala namn sila initial investigation for five months. nagkaroon kami ng clarificatory hearing pero wala pa rin sila result kaya nag file ako ng early retirement effective for 30 days effective july 15. after 30 days period.nagbaba ang boss ko ng termination july 24 pero at forfetid ang retirement ko for 26 yrs. Pa retire na ako atty. wala due process po ba ginawa sa akin?

    Atty. laid off po ako ng company last march 2023, due to retrenchment pero status ko po is still employed sa company nila. Ano po magandang gawin? Mag resign po ako? or wait ko na icall ako until mkabalik sa work? Hanggang ngayon kasi di na ako kinokontak ngcompany namin.

    Arty magandang umaga may tanong po ako.august 10 nag file angl asawa ko ng sickness l 120days by neuro doctor pero ni reject ng SSS ang sickness ng asawa.ang sabi ng evaluator doctor ng SSS.ma total disability claim .as advice ng doctor kailngan magresign para makakuha ka ng COE para magka pension na kasama ang dalawang bata.Not 3 nag pass ang asawa ko ng voluntary resignition para sa COE is one requirements ng total disability claim .kahapon nag text yong company sa kanya ang nakalagay sa ay 14k lng ang kanyang matangap for 18yrs. Tapos health related. Ang tanong may matangap ba ang asawa ko ng separation pay ?

    May tanong po ako, ganito kc nagfile n ako ng complaint sa dole against my age ncy, and kahapon lunes ung second hearing namin. At dahil sa complaint ko po hindi ako pinaduty at ung sahod ko n pasok sa payday o sweldo(10-25) ay hindi po binigay sakin ung sasahurin ko po this payday(10 of Jan). Ano po gagawin ko sir and saan ako pede magsumbong maliban sa dole?

    More than 3 years po siya as a sales lady under agency.

    Maraming salamat po dahil sa video na ito nalinawan po ako dahil yung mga tauhan namin ay bigla bigla nalang nag resign at nag sulat sa bond paper kung ano dahilan nila kaya sila nag voluntary resign. Nag resign sila noong araw mismo ng sahuran ng Saturday po ngayon nag message sila saakin at nangungulit na kung kailan nila makukuha ang 13month pay nila dahil nga bigla bigla sila nag resign at di pa tapos ang mga trabaho nila ay sila pa nag mamadali na kumuha ng 13 month pay nila ngayon po ano po kaya magandang gawin ko po. Ngayon napanood ko po ito na video niyo nalinawan at alam ko po na may batas din po pala akala ko po kasi is lahat ay nakapanig sa mga employee po kapag sila ay nag reklamo. dahil wala pa nga kami na ibigay sa kanila kahit ano dahil sila ay biglaan nag resign di natapos ang trabaho nila kaya sobrang nahihirapan ako mag hanap ng mga papalit sa kanila para tapusin ang kanilang trabaho.😢

    i have question.. my employer told me to file resignation . kasi nalaman nila na im applying for abroad pero hnd pa nmn po mttuloy . im trying for nextyr.. kinausap nila ako na magresign nlng daw . wala naman daw ganun na gngwang option ung company kpag wala pa ung pag aabroad eh stay muna.. wala daw ganun.. i told her na baka by decmber mag reresign ako. ayaw nia po tanggapin gsto nia magresign na daw ako.
