    Acting Immigration Minister Alan Tudge revealed new details of the English language requirements, announced in Tuesday's Federal Budget, for people applying for partner visas.
    The test also applies to an applicant's spouse, if they are a permanent resident rather than an Australian citizen.
    "This will apply to prospective partner visa applications, from about the middle of next year," Mr Tudge said.
    "What this will mean is that we will require an applicant and a sponsor to have met functional level English or to have at least made reasonable efforts to learn English.
    "And by reasonable efforts we mean for most people that would be doing about 500 hours of free English language classes."
    Mr Tudge pointed to a previously announced overhaul of the Adult Migrant English Program, giving migrants access to unlimited English classes free of charge.
    Partner visas are processed in two stages and the minister's office said the new language requirement would not need to be met until someone was applying for permanency, usually after two years of being able to live in Australia on a temporary partner visa.

    In a new rule announced as part of the Federal Budget earlier this month, applicants and their permanent resident sponsors applying for a partner visa will be required to have functional-level English or will have to demonstrate that they have made reasonable efforts to learn the language.
    Defending the requirement that has drawn widespread criticism from Opposition, industry insiders and applicants from India, Minister Tudge said the measure is in the interest of the migrants and would allow them to maximise their employment opportunities and contribute to the social fabric of the Australian society.
    “Only 13% of people with no English in Australia are in a job and moreover it is so difficult in Australia to fully participate in our society if you don’t have at least a basic level of English so it’s in the migrants' interest as much as in the society’s interest for everybody to at least have that basic level of English and hence we are putting on this requirement that a person makes a reasonable effort to learn the language.”
    Responding to the critics who have dubbed the policy “racist” claiming it would disintegrate marriages instead of promoting social cohesion, Mr Tudge said the government is only asking partner visa applicants to demonstrate reasonable efforts to learn the language and are not asking them to sit for “hard and tough” English language test a mandatory requirement for the skilled stream.
    “Indian and Chinese are number one and two of that skilled program, which already requires an English language test but actually a hard and tough test for the primary applicant.
    “I can reassure every single applicant that if they make a reasonable effort to do the free English language classes available to them, they will meet that hurdle with flying colours,” he added.

    When is best time to do medical and biometric for 309 visa applicant offshore? Once we lodge the 309/100 visa application for offshore partner applicant, then the Department soon sends request letter for biometric and medical tests, and some applicants think they have to do it immediately and do so but some think it's waste of money to do it so early as it will expire after some months and will have to do it later again and they wait until may be another request from the department later. Is this the same for both medical as well as biometric or only for medical? How long is biometric expiry and how long is medical tests result expiry? Then how many months after application lodgement would be good time to do biometric and medical tests? I have one friend who has done 2 times medical but still waiting for visa grant and may have to do 3rd time medical test before visa is granted which is so much waste of money. So to be more economical when would be the right time after application lodgement to do the biometric and medical or is there any alternative ways to ask the visa processing officer to give more precise accurate time to do medical and biometric only when they actually need it so that whatever has been done won't go in waste?
    Is there any way we can ask the department to use the same Biometric for 309 visa processing for the applicant which was done earlier in February 2020 for his/her tourist/visitor 600 visa application? Or it must be done separately?

      is this visa means the visitor visa or tourist visa for famly member? I think the government's 2020-2021 plan of giving 160,000 visas is for those who can come to Australia and they can later become eligible to apply for PR, but on top of 160,000 there will be allowed as much as possible tourist visas and student visas to come to Australia which is out side of the 160,000 is my understanding.:- Here is below, the copied pasted from news:
      First off, the immigration intake set for 2020/21 will remain at 160,000. Although there is no fall in the maximum capacity, there has been a trend of actual visas granted falling further and further below the intake ceiling.
      Onto the details. I’ll start with the bad news. The Immigration Department intends to begin imposing an English requirement on Partner visas. Details haven’t come in yet but I expect it will be reasonable and fairly low. The budget papers states;
      “The Government will introduce English language requirements for Partner visa applicants and their permanent resident sponsors. These changes will help support English language acquisition and enhance social cohesion and economic participation outcomes.”
      This is big news nonetheless and we expect it will receive a high degree of opposition within some community groups. One has to wonder of course, why does the person you love and want to sponsor need a minimum English requirement?
      The good news is that visa application charges, or VACs, will be refunded to those currently holding certain temporary visas and are unable to enter Australia due to the travel vane. The temporary visas holders able to access this refund include those on the prospective marriage 300 visas, pacific labour scheme and seasonal worker programme visas. This is a huge relief for 300 visa holders unable to enter Australia after paying a VAC of nearly $8,000 and whose visas are about to expire.
      For those on temporary skilled work visas and visitor visas, no refund will be provided. Instead, you will be given a waiver when you apply for your next visa to return to Australia when travel restrictions are lifted. This isn’t bad per se, as it means Australia still wants you back. Working Holiday visa holders can either have the fee for their next visa waived or choose a refund.
      As mentioned in a recent update, we are reminded that Student visa holders who require a further student visa to complete studies or remain in australia as they are unable to leave due to the travel ban will also have VACs waived. International students and recent graduates wanting to apply for the temporary graduate 485 visa but cannot travel into Australia, can apply offshore.
      In terms of order of consideration, onshore applicants will receive priority. Employer sponsored, global talent, business innovation and investment visas will also be given preference.
      Family stream visas will be given a greater allocation moving from 47,732 places up to 77,300 places, which is 160% more. This is a one off increase. Partner visa applicants with sponsors living in designated regional areas will also receive processing priority.
      Working Holiday 417 and 462 visa holders are also cut a break if they are currently working in food processing or the agriculture sector. They will be eligible for a further visa and will be exempted from the 6 month limitation with 1 employer. 417 and 462 holders will also be allowed to do construction work, paid and volunteer disaster recovery work. This is to support bushfire recovery efforts. Those in disaster recovery work may work with the same employer for 12 months instead of 6.
      Seasonal work programme and pacific labour scheme workers in the agricultural sector whose visas are expiring can have their visas extended by 12 months for work under approved employers.
      For New Zealanders in Australia, the income requirement for permanent residency on the Skilled Independent 189 visa will be made easier. Special Category 444 visa holders will be eligible if their taxable income for 3 of the last 5 income years, including the latest income year meets the temporary skilled migrant income threshold which is currently set at $53,900 in an income year.
      Finally, $29.8 million will be injected into developing a global business and talent attraction taskforce to encourage top tier businesses and exception talent to Australia as part of the economic recovery response and to create jobs. This builds on the global talent initiative, business innovation and investment programme and the new initiative announced on 9 July earlier this year relating to attracting talent from Hong Kong.
      More news will be following with an analysis of what impact some of these provisiosn will mean for potential migrants.
      UPDATE!
      The Migration Program Planning Levels have been released and the numbers support the recent announcements made for immigration that came with the Australian Federal Budget 2020. Many visas such as the Skilled Independent 189, State Nomination 19, Skilled Work Regional 491 and Skilled Employer Sponsored Regional 494 visas have had their quota’s halved. The capacity for Partner, Business Innovation & Investment Program and Global Talent visas has been substantially increased.

      I think the entire 309/100 is not priority, what is true is if the sponsor partner is living in designated Regional area will be given priority over the sponsor partner living in Melbourne metropolitan, Sydney metroplitan and Brisban metroploitan which are not classified as regional areas, and this regional area sponsor versus non-regional area sponsor priority is given for offshore applicant also, not only for onshore applicant. And when it comes to onshore applicant vs offshore applicant the higher priority is for onshore applicant, Therefore 1st priority is onshore applicant-living in designated regional area, 2nd priority may be onshore applicant living in non-regional area, 3rd priority is offshore applicant whose sponsor is living in designated regional area and 4th priority to offshore applicant whose sponsor is living in non-regional area. However, within regional area also there are Category1 regional area, category2 regional area and category 3 regional area where 3 is higher priority over 2 then 1.

      Hi RV I can totally understand your anxiety and difficulty due to uncertainty, but please stay positive and calm just to keep you and your health, mental health emotional condition safe and strong. Just wanna let you know, Australia gov has not said when the international travel restrictions will stay until. I Aus gov has not said when it will open or when it will remain closed untill because no one knows the answer due to uncertinty of covid situation as to what may happen and how it may look like in the future. It will depend on number of factors such as which country will be more safe to allow international fights with depending on the covid19 situations in those countries, whether vaccin will be available or not, when will it become available, what else other options may Aus gov implement for bring more people to Australia to uplift it's economy, what other covid safe methods may be applicable such as home quarentine etc, and based on how the australia would like to manage 160,000 migrants it intented to bring to Australia in 20-21 financial year to enter into australia in 20-21 financial year as per migration announcements in the 20-21 budget recently. All the answers to the solution are not clear yet. These matters are still under gov discussion as to whom the goverment will give free quarantine and who should pay for quarentine cost when they arrive in australia. The Aus gov wants to open international border as much as Aus wishes to but that is not entirely in the hand of Aus gov because it depends how soon some countrys can tackle to become more covid safe countries. For example NewZealand is becoming covid safe country so Aus gov is now allowing people from NZ to come to Aus now, similarly for example if any other country "XYZ" becomes covid safe country according to covid situation based on WHO data then Aus gov will start opening its international fights with people of that country only. So there is no 'one size fits all' answer in relation to opening international border with all countries of the world. Same rule will not apply with all international countries. It will depend on how soon your country will become covid safe for Australia to consider opening travel restrictions with people of that particular country. There is no total ban on international flights at the moment nor there is free movements across international borders as it used to be before covid19 started. Currently there are people who have been given travel exemptions by Aus gov and australian citizens from overseas returning to australia but travelling internationally is highly restricted and is allowed only by immigration departement for urgent/necessary cases....Have a listen to this most recent news in google directly from the mouth of Aus Primeminister

    Infact partner visa is very sensitive and partner is basic need of human rights, so it should not be more than 2--3 months maximum waiting time, so why cant anybody take the responsible goverment to court of legal justice for failing to provide partner visa in no excess of 90 days, it is inhuman and detrimental to life of people in mu opinion. Can anyone give ideas why nothing is being done when the processing time goes increasing upto 26 months, whose fault is leading to such delays showuldn't be held accountble?

      When you said 'spouse visa", which visa number you mean...can you pls calrify so I or others may be able to give you appropriate answer? I think she can apply for spouse visitor visa and dont know it will be granted or not, but to apply for Partner visa 309/100 the sponsor person spouse must be australian PR or citizenship or new-zealand citizen. But I m not totally sure about my own answer, so please dont rely fully on my answer as it is my personal opinion/guess or understanding which may be wrong , so always good to double check with migration agent, migration lawyer or relevant expert

    SKilled Visa has gone down. International students plz donot come to Australia. This country would not give PR. Look how cleverly this agent did not talk about skilled 189, 190 and 491. Bcz she knows it would have wrong impact on business.
