I have been saying this for years. In Australia there is a lot of noise being made about Chinese activity in the SCS. My arguement has always been the same: Why would the Chinese follow international norms and laws if nobody else has to? The selective application of international law weakens it to a point of uselessness.
The hyperventilating over the threat of China is all the more absurd when you point out to people China is yet to invade anyone (aside from Tibet) compared to the actions of nations of the global north.
The fact that Ben Roberts Smith is considered a hero by a whole load of Australians is telling.
@@coasterblocks3420to be fair, the U.S. and NATO have made it all but impossible for China to invade anybody. There are a lot of places that China would invade if it could. And it's not just Taiwan. They've been having skirmishes on the Indian border for a while now. They have disputed territories with Russia. The West has done all it can to keep China and Russia and the like contained, pretty much since the collapse of the Soviet Union.

its not a merger, what made capitalism an existance is the country state institucionalization. Capitalism is based upon holding private property over means of production, and who gives legitimacy and protects such property? the state. Now who funds the campaigns, influence politicians interests and build think tanks to breed new waves of politicians to reverb their interests? capitalists. We are led to believe that state and capital are at odds with eachother, what we have now, as a less discriminatory and fascist governments compared to the 19th and 20th are a result of 200 years of resistance from the masses. Its this progress that the capital perverts into a product and attacks the real meaning behind it.

Interesting timing. A little over 13 years ago, an Australian publisher published evidence of US war crimes. The evidence was in the form of voice recordings and helicopter gunship footage from a camera mounted on an autocannon. It showed the helicopter killing a journalist and some bystanders who were looking at the photo he'd just taken with a long telephoto lens, and then shooting the civilian who tried to help the wounded, as well as the children in the vehicle that good Samaritan arrived in. That publisher has just ended 12 years under arrest, without trial. Much of the time was served in an embassy of a neutral country to avoid being shipped off to some US black site. That publisher was freed two days ago. The helicopter crew was never charged.

International law is selectively applied only to the global south/imperial periphery. The ideas behind them are good but these institutions as they are presently, fundamentally serve the neocolonial apparatus of the Western states. They must be dismantled and rebuilt entirely to actually fulfill the role they were supposed to. At that point, they will truly be new institutions in themselves.
Fascists stick together and it's never been clearer than now.

all laws are fundamentally based on a threat of violence that's the only way they work. Liberalism has this idea that laws are somehow derived from
mutual consent, this is a fundamentally wrong idea, and it makes people think that you can make a system of international laws which military superpowers are as accountable to as anyone else.

You are correct that this is how it’s currently interpreted and enacted. I've come to a realization: in the realm of Western nations, particularly Europe and Israel and the USA, there exists a perplexing pattern. These countries, while bearing the weight of their own transgressions, often take it upon themselves to investigate the very crimes they have committed. It's a truly remarkable situation, one that leaves me astounded. Perhaps it's high time for a transformative shift, a bold decree stipulating that nations with a history of criminal activities ought not to be entrusted with the task of investigating their own wrongdoings. Such a measure would introduce a new era of accountability and impartiality, ensuring that justice reigns supreme while dismantling the cloak of self-protection that has shrouded the truth for far too long.
which country is going to start? Colombia is going thru an actual peace process that people seem to be ignoring for some reason. Hope is expensive and difficult and requires complicated conversations, there's no good or evil nations that should be judging or being judged, that game never ends.
Not exactly what you're proposing, but every socialist experience went through some form of transitional justice which investigated, judged and sentenced all major collaborators of the former oppressive regimes. More than just international accountability, we need a justice system that answers to the people, to the oppressed classes, not to the elites. If we were to rely on the elites of each country judging each other, we would have nothing different from what we already have.
There are no alternatives, no workarounds for the revolution. The other countries aren't going to save us, and the elites won't have a change of heart and accept losing their power. We need to save ourselves.

Even before watching, and I don’t want to sound like Nietzsches here: Laws are in the end only constructs that at best represent accepted tabus within a specific culture. That already makes the whole concept relative. So far so good. First add the fact that these laws are in practice always finely tuned to give the ruling elite maximum leeway. Thirdly: Unethical behaviour is at best punished if the perpetrator is stupid and arrogant enough to get caught. In other words: Lying is rewarded. Fourth: If you are rich enough you can even then ride out the wave you creates for decades by appealing again and again. So what happens if an elite with such ethics and accountability moves outside of a national / cultural framework? As far as the actual content of your video goes: 👍.

To reiterate Lenin's words - "bourgeois democracy is when every few years the oligarchs allow the workers to elect a representative from their oppressors".
By definition, a republic is not a democracy. Votes do not and have never mattered to a republic, and every "democracy" on the planet is a republic. The only thing that defines a republic is that officials represent groups of people in the eyes of the government. That's all. If there are representatives, it's a republic.

the correct question is “why doesn’t international law apply to big states?”
And the answer is because the international system/order is anarchic, meaning there is/are no over arching authority/ies to enforce laws aka treaties. We only enforce it on each other in accordance to each of our own interests or perceived interests. That means more often than not, strong states will do the enforcing while rarely having enforcement applied to them and vice versa.
@@brianfox771 It's very literally the opposite. The answer is that the international system is hierarchical, meaning all enforcement is done with the consent of those at the top of the hierarchy. It's wild that you describe a system where the powerful rule and then claim its the fault of a term that literally refers to a lack of rule by the powerful.

@brianfox771 in political science, anarchists are opposed to systems of hierarchy and coercion. I think anarchy only came to mean "chaos" because anarchy is an anti-state position and, to the layman, they can't fathom order without the state apparatus. Anarchy ("without authority") and hierarchy is by definition opposed.

This isn’t unusual behavior sadly for both the West (in particular America) and much of western aligned nations of the world unfortunately.
In my own short lifetime (and before I was born) alone the U.S. and western neoliberal/neoconservative capitalist establishments had initially denied the factual legitimacy of no less than 40 notable modern and historical human rights abuses.
Ones they eventually had to admit were real and did in fact happen regardless of how inconvenient that was to their geopolitical interests and narrative propaganda at the time.
This list of course includes those near genocidal atrocities committed in the nations of Africa, former Yugoslav republics, Central Asia, Southeast Asia, Latin America (concerning state enforced displacement of indigenous populations and mass disappearing of political dissidents), Eastern Europe post Fall of the Soviet Union, Middle East (by U.S. or EU backed regimes), even in China and Russia (when the U.S. was still committed to courting them into their sphere of influence), etc.
Hell there were still attempts to deny the full extents of the Allies, Entente, Western Imperialists, and expanding American colonists own historical atrocities against various groups from the 1500s to the 1960s. Of which are taught in schools today as indisputable historic fact.
With many conservatives still desiring to force schools to teach a white washed morally sanitized revision of history that strategically leaves out the legacy of slavery, racism, sexism, homophobia, genocide, colonialism, imperialism, illegal land acquisition, and even tacit endorsement of many authoritarian regimes (including the Axis Powers prior to WW2).
Whoever controls the present controls the past. Whoever controls the past controls the future.

The very concept of "International Law" is inherently imperialistic. By it's very nature it centres one view of legality over others, invariably the the view of whatever nation or alliance can bully the rest of the world. It is no different from when the British forced it's own legal system on the rest of the empire, and called it a benefit for the colonised.

It's insane because many of the international treaties that our countries signed and ratified "casually" always end up harming developing countries in some way or another, and they also function as an excuse to intervene in foreign cultures and impose the "cultural values" of powers on others. Most of these international treaties undermine the sovereignty of nations too.
This comes with the presumption that hierarchy is an inextricable part of all cultures, societies, and governments. That's not actually true. While I would agree broadly that our current systems in place for "international law" are extensions of imperialism, it's simply not the case that all possible systems of international law would be inherently imperialistic.
