In my opinion, Mal is 100% correct on this one. If you own a copyright, trademark, etc. jointly any one of you can do whatever you want with that product. You will have to give a percentage to the other owner(s), but you can use, market or sell the product.

Mal definitely is still holding onto some unsavory feelings. It’s painfully obvious. Comes off a little bitter. I can appreciate Rory’s take on the situation especially considering that Joe and Royce said that Joe never turned it down, he just had some additional questions and wanted to see the paperwork. Royce said he wasn’t doing it without all the members.

In my opinion, Mal is 100% correct on this one. If you own a copyright, trademark, etc. jointly any one of you can do whatever you want with that product. You will have to give a percentage to the other owner(s), but you can use, market or sell the product.

If one of the joint owners is doing something that causes brand confusion or damages what’s called the “good will” of your company you can take it to court. But, just be clear, you will have to go to court and win the case to stop the person.

The only way you all have to agree is if you have a separate contract that actually says you must agree before that intellectual property can be used…And even then most people include a clause that says you must be reasonable in making the decision to agree or disagree. That clause is used to stop people from just refusing without a good reason.
