China's SCS CLAIMS are invalid by UNCLOS Ruling

  • China's "SCS claims are Invalid according to UNCLOS on a legal victory for the Philippines over China.
    China reaffirmed its claim over the disputed Scarborough Shoal in the South China Sea after the Philippine government removed the floating barrier to prevent Filipino fishing boats from entering the area. Chinese Foreign Ministry spokesman Wang Wenbin said the shoal and its adjacent waters are China’s inherent territory, and therefore Beijing has indisputable sovereign rights in the disputed waters.
    The Chinese claims are mostly based on its historical rights during the Han Dynasty, dating back over 2,000 years ago. In modern history, China backed its sovereignty claim and related rights over this territory in accordance with the 1943 Cairo Declaration and the 1945 Potsdam Proclamation. After World War II Japan returned to China the Chinese territories it had occupied, including Taiwan and the Penghu Islands, the Xisha Islands, and the Nansha Islands.
    However, the 2016 Arbitral Tribunal under the UN Convention on the Law of the Sea invalidated China’s historical claims over the disputed waters of the South China Sea.
    The tribunal dealt with the question of whether China’s claims to historic rights within the nine-dash line, now 10 dash line were in conformity with Unclos. It was first observed that this area - in which China claimed rights, formed in the long historical course, to living and non-living resources like fisheries and petroleum resources - partially overlaps with areas that would otherwise comprise the exclusive economic zone or the continental shelf of the Philippines.
    In the view of the tribunal, Unclos establishes a comprehensive maritime zones regime and allocates rights in these areas to the coastal state and other states: in the areas of the EEZ and the continental shelf, the coastal state enjoys exclusive sovereign rights to the exploitation of living and non-living natural resources.
    Concerning the rights of other states in these areas, the tribunal found that Unclos does not permit the preservation of the historic rights of any state within the EEZ or the continental shelf of another state. Therefore, after the entry into force of Unclos, the historic rights that might have existed for China within the nine-dash line in areas that would otherwise include the EEZ or the CS of the Philippines were superseded by the maritime zone’s regime created by Unclos.
    That means the pre-existing historic rights no longer exist as they are not compatible with Unclos. Accordingly, the tribunal concluded that China’s claims were contrary to Unclos and exceeded the geographic limits imposed by it.
    The award addresses three main substantive issues first the so-called nine-dash line and China’s claim to historic rights in the South China Sea. Second, the status of certain maritime features in the South China Sea, and Third the legality of Chinese activities in the South China Sea. Because of jurisdictional limits, however, the Arbitral Tribunal did not deal with matters related to territorial sovereignty over the disputed maritime features between the parties.
    That means that the tribunal did not decide who owned the maritime features located in the South China Sea, such as the Spratly Islands, that are claimed by both China and the Philippines or any other coastal state in the region. Similarly, the tribunal did not delimit any maritime boundaries between the Philippines and China in the South China Sea.
    The tribunal also ruled on the legality of the activities of Chinese officials and Chinese vessels in the areas of the South China Sea located within the Philippines’ EEZ and continental shelf. It concluded that China breached the provisions of Unclos, in particular by temporarily prohibiting fishing in areas of the South China Sea falling within the Philippines’ EEZ.
    Failing to prevent Chinese vessels from fishing in the Philippines’ EEZ at Mischief Reef and Second Thomas Shoal, and preventing Filipino fishermen from engaging in traditional fishing at Scarborough Shoal. Regarding China’s construction of artificial islands, installations, and structures at Mischief Reef - an LTE that is part of the Philippines’ EEZ and continental shelf - without the authorization of the Philippines, the tribunal also found China to have violated Unclos.

      That's the head scratcher for me. For what, 70, 80 years, the US Navy patrolled those waters (with the exception of the WWII years) and during that time I never heard of the nine-dash line. Why did it take the USN and USAF leaving it's bases in the Philippines for the CCP to then claim sovereignty over practically an entire ocean?

    What is the point of China's senior position in the UN, especially as a permanent member of the UN Security Council, if they refuse to recognise the legal conclusions of UN Legislative organs such as UNCLOS?       During the occupation of US in Philippine, the US had already dicovered that big deposit of oil there. look for Collier Encyclopedia. so that spratley was already discovered. But because US had been given Independence from England and at that time the US also give independence to Philippines. and It is July 4. . The problem of Pilipino since they know about that treasure their, our Phillipine government never doubt that that China would develope interest when they are given contract by our goverment to discovere this oil. Then they found that big treasure..but the Philippines is the authority in that area. since then they do not want to relingquish that area any more..but it is in the part of the Philippines.

    China and Philippines are both signatory to UNCLOS where it specifically noted_ specified the limits/ bounderies the rights of every nation with respect to her Exclusive Economic Zone( EEZ ) with respect to resources of the seas and oceans The limit of each country EEZ is 200 miles from her shores .So even if the Hague ruling of 2016 is not used to define Philippines EEZ by just following the International Agreement the UNCLOS itself China could not use the 9 Dash Line as basis as she is signàtory to UNCLOS

    The problem is many Filipinos are fighting for the EEZ while what we should really be fighting for is sovereign territory. It belonged to us even before the Spaniards came to our country.
    When the Spaniards arrived in the Philippines, the Spaniards
    drew the map as if to tell us, Hey Filipinos, this is your sovereign territory. Our claim doubled when the EEZ came into effect.
    That's why our sovereign territory is also our EEZ.
    Due to the EEZ this limits our claim to 200 NM.
    EEZ is bad news for the Philippines.

    (2) On October 27, 1955, the first Pacific Regional Air Navigation Meeting of the International Civil Aviation Organization was held in Manila, the capital of the Philippines. Sixteen countries and regions attended the meeting, including Australia, Canada, Chile, the Dominican Republic, Japan, Laos, South Korea, the Philippines, Thailand, the United Kingdom, the United States, New Zealand, France, as well as South Vietnam and the Taiwan authorities of China. The conference was chaired by the chief delegate of the Philippines, and the chief delegate of France was the first vice-chairman of the conference. The meeting believed that the Pratas Island, the Paracel Islands and Spratly Islands in the South China Sea were located at the Pacific strategic passage, and the meteorological reports from these areas were of great importance to international civil aviation relations. Therefore, through Resolution 24, the attending delegates required the Taiwan authorities of China to strengthen meteorological observations in the Spratly Islands (four times a day). At that time, when this resolution was passed, including the Philippines and South Vietnam representatives, no representative of any country objected or expressed reservations.

    FYI: china's historical claim are false.
    Official Atlas Ancient Maps of China which they cannot disowned. The Tang dynasty(1098-1100 AD), the Nan song dynasty(1136 AD), the Yuan dynasty (1343), Ming dynasty (1389) and the Qing dynasty (1644-1912) all saying that the southern most territory of china is Hainan thousand years ago and they don't know about the "Panacot island" now called "Scarborough shoal" and the Los Bajo's de Paragua now called Spratly's island. "The Philippines has the oldest legitimate map (1734) which includes the Scarborough shoal and Spratly's island. So china's 10 dash line is delusional.
